HomeMy WebLinkAboutSeattle OperaA --~.r6 , AGREEMENT FOR ARTISTIC SERVICE THIS AGREEMENT is made and entered into this 1 *3 day of January, 2010 by and between the City of Auburn, Washington, a Municipal Corporation of the State of Washington herein referred to as "CITY" and Seattle Opera, PO Box 9248, Seattle, WA 98109 herein referred to as "ARTIST". WHEREAS, the CITY desires to contract with the ARTIST to provide an artistic school residency in Auburn, Washington; and WHEREAS, the ARTIST has agreed to perform the work in compliance with the terms and conditions of this Agreement; NOW THEREFORE, the CITY and ARTIST in consideration of the conditions and covenants herein do agree as follows: RETENTION OF ARTIST The CITY does hereby retain the ARTIST to perform the work and services described herein. The parties agree that the ARTIST is an independent contractor and shall furnish all supervision, labor, costumes, and all other incidentals except as specifically provided herein and the ARTIST agrees to conduct and complete the performance in a competent and professional manner in accordance with the terms of this Agreement. 2. SCOPE OF WORK The ARTIST agrees to provide the following specific services in its artistic program: One (1) "Opera Goes to School/Siegfried and the Ring of Fire" residency program the week of February 9-12, 2010 at Lakeland Hills Elementary School, Auburn WA. SITE OF PERFORMANCE The ARTIST will conduct its program at Lakeland Hills Elementary School, Auburn, WA herein referred to as °VENUE/SCHOOL". The ARTIST agrees and represents that it has inspected the site prior to the program and accepts the premises in their present condition. The ARTIST further agrees to indemnify, defend and hold the CITY harmless from any and all injury to any person or property arising out of the condition of or use of the site by the ARTIST for its performance. 2010 Artist in Residence Agreement- Seattle Opera Page 1 of 4 c 4. REQUIREMENTS The VENUE/SCHOOL shall provide the following for this performance: (Reference attached addendum). COMPENSATION In consideration of the services to the CITY in connection with the artistic performance, the ARTIST shall receive total compensation of Two Thousand Doilars and 00/100s ($2000.00). 6. PAYMENT The ARTIST shall be paid by the CITY for the completed work and performance in compliance with the terms of this Agreement. Such payment shall be full compensation for all work performed and services rendered under the terms of this Agreement. The payment to the ARTIST shall be in compliance with the regulations of the CITY Finance Department. The ARTIST agrees to be responsible for payment of any and all taxes which may be due as a result of performance under this contract. The agreed fee ($2000.00) will be paid in the form of a check after completion of performance. 7. PROMOTIONAL RESPONSIBILITIES ARTIST shall provide the following promotional materials to the CITY: N/A. 8. INDEMNIFICATION The ARTIST agrees to indemnify, defend and hold the CITY, its agents, representatives and employees harmless from and against any and all claims, causes of action or demands or any form of liability of any nature arising out of the performance and obligations contained in this Agreement on the part of the ARTIST, its agents, representatives and employees except where such claims arise solely from the negligent acts of the CITY, its agents, representatives or employees. 9. INABILITY TO PERFORM If ARTIST is incapacitated from rendering services through sickness or otherwise or if ARTIST cannot perform because of fire, accident, act of God or impossibility of performance, the ARTIST shall not receive any salary for the time during which the services have not been rendered. 2010 Artist in Residence Agreement- Seattle Opera Page 2 of 4 10. TERMINATION In the event the ARTIST or the CITY defaults or fails to comply with any of the requirements of this Agreement or any obligations hereunder, the CITY may at its option terminate the Agreement. Such remedies shall be in addition to any other right or remedy each may have. 11. NOTICES Any notice required or permitted under this Agreement may be personally served or given in writing and shall be deemed sufficiently given or served if sent by registered or certified mail addressed to the respective parties as follows: City of Auburn, 910 Ninth Street SE, Auburn, WA 98002; Justina Schwartz, Seattle Opera, PO Box 9248, Seattle, WA 98109. Either party may at any time designate a different address to which notices shall be sent. Notice given in accordance with these provisions shall be deemed received when mailed. 12. GENERAL PROVISIONS The following provisions may apply: A. No waiver by either party of any breach or default hereunder shall be deemed a waiver of any preceding or any subsequent breach or default. B. This Agreement may not be changed or modified nor any . provision hereof waived'except in writing agreed to by both parties. . C. This Agreement shall be construed in accordance with and all questions with respect hereto shall be determined by the laws of thetState:of W68hingt'on. D. The ARTIST agrees to pay all reasonable costs, attorney's fees and expenses that may be incurred by the CITY in enforcing the provisions of this Agreement. E. Tuned Piano Rehearsal/Performance Space Teachers: Coordinator To handle space/schedule requirements - Main Contact Any Teacher Responsible for students in rehearsal Music Teacher Coordinate instruments, casting orchestra Art Teacher Art projects: masks, costumes Students: • ALL STUDENT PARTICIPANTS WEAR BLACK or DARK BLUE pants. • In all of the solid tee shirts mentioned below, PLEASE NO ADDED LOGOS, WORDS, OR DESIGNS. • Girls can choose to wear leotards, rather than tee shirts, if they have one in the required color. • Students can choose to wear a long or short sleeved shirt. 't~\) FIRE SPIRITS: • Both boys and girls (8 -12 participants) - this group works as a team, and ideally would be filled with students with a lot of physical energy, and who can learn fire choreography set to music. • They also sing. • Dancers and athletes are great choices. • Each fire spirit student provides a SOLID RED or SOLID ORANGE TEE SHIRT, long or short sleeved. • Seattle Opera will provide fire wands and hats. VALKYRIES: • All girls (6 students) - this group works as a team but with individual assignments. Ideally, the students would be comfortable having solo spoken lines. They are confident actor/singers with expressive, large voices. • Each Valkyrie provides/wears a SOLID BROWN/ TAN COLORED TEE SHIRT, or leotard, long or short sleeved. • Each Valkyrie student will create a Valkyrie crown. See instructions in enclosed disc. • Seattle Opera will provide additional costume accessories. BIRDS: • Boys and Giris (10 - 18 students) - Singers and actors who learn group movement and a song. Ideally, students in this grouping are physically expressive (dancers/athletes) and like to sing. • Each forest bird provides/wears a SOLID PURPLE TEE SHIRT, lorig or short sieeved. • Each forest bird creates a feathered 1/2 mask in school, prior to the residency. See instructions in enclosed disc. • 2 Ravens (both boys). These two are on stage in a scene with Wotan. Ideally, these students work well independently, take direction well, remain focused, and are responsible. • Each raven wears a SOLID BLACK TEE SHIRT, long or short sleeved. • Each raven creates a Black Bird Mask in school, prior to the residency. See instructions in enclosed disc. ORCHESTRA • 12-20 (both boys and girls). This group plays percussive instruments and are housed in the audience area. They are able to execute individual assignments as well as work in a group. Ideally, these students play an instrument, or have a great sense of rhythm. They are able to remain focused, and remember details. They work well with their hands and have a memory for sound. • Each member of the orchestra wears a SOLID BLACK TEE SHIRT, long or short sleeved. SCHOOL TO-DO LIST MAKE SCHEDULE in cooperation with Seattle Opera 1. We'd prefer access to the performance space throughout the entire residency. Load-in of set and costume pieces will happen on the morning of the first day. DIVIDE STUDENTS INTO GROUPS 1. Student performers should be cast into groups as specified above. 2. Please arrange name tags (to last all week) for each student which indicates their group. Names should be large enough to read from several feet away. PREPARE STUDENTS 1. Review Study Guide with student performers and school audience 2. Prepare Forest Creatures Song, Valkyrie, Magic Fire songs and solo instrumentalist (for horn solo) in advance of residency. PREPAREORCHESTRA Schools need to provide instruments for the orchestra. 1. As many percussion instruments as there are players 2. Pitch-producing instrument (tone bars, glockenspiel, xylophone, etc.) to play A below middle C to C above middle C, in F inajor (with Bb) 3. The orchestra will illustrate fire, water, storm, forest murmurs, dragon, and sword- forging. So use your creativity when assembling an orchestra! PREPARESPACE 1. Tune the piano. 2. The orchestra will need enough chairs to hold the full orchestra and a table for certain instruments 3. The director will want to use a microphone on Day 3(Tech/Dress Rehearsal) 4. We'll want to lay down "spike" tape on the floor, on stage and in the audience to denote exits and aisles. It's easily removed and will not damage the floor. PREPARE COSTUMES 1. Detailed description available above. Valkyries: Brown or tan shirts Magic Fire: Red or orange shirts Birds: Purple shirts, masks Ravens: Black shirts Orchestra: black tops 2.
