AUBURN,, WASHINGTON TUESDAY OCTOBER 15. 1M
Regular meeting of the City Council of the City of Auburn,
held at $:00 P.M. in the Council Chambexs at the City Hall.
The meeLing was called to order by Magr or Clark.
Councilmen present: Hitchcock, Kuehn, Rugert, Stalder, ,
Snodgrass and. Raven.
Councilman absent: Petersen. '
Minutes of the previous maeting held Oct. 1, 1957 were approvod
as mailed. '
WATER CONlMITTEE REPORT '
Councilman Rupert reported foe the Water Committee saying
they had met with the representative from Rohr Aircraft and it ~
was the Water Committees' recommendation that the City Attorney
draw up an agreernent with Rohr to pay them 50 percent of their ~
cost in constructing the turnk sewEr to their factory site and
that Rohr not be assessed for further sewer rights on their `
present property, subject to the L'ity Attorney's approva. ~
It was moved by Rupert and 2nd by Stalder that the r ecomm-
endation of the Water Committee be adopted. MOTIc7N CARRIED s
Mr. Shepard, Rohr's Secy. said this decision was
agreeable to Rohr.
STREET CUMMITTEE REPORT
Councilman Stalder reported for the Street Committee saying
the Street .Dept. will take care of the disposal of the trash
cans in accordance with the request of the Jr. High Student Body.
Councilman Stalder reported for the StreeL Committee re-
commending that the request of 0. Blomeen and Mark Hedman to
vacate the alley between Auburn Ave. and B''t. N.E. be denisd.
It was moved by Stalder and 2nd by Kuehn that the recommendat
of the Street Committee be adopted. MOTION CARRIED
Councilman Stalder rsported for the Street Committee saying
the Committee, Police Chief and Engineer are studying the 3rd St.
N.E., from Auburn Ave. to C St. N.e, prQblsm.
LIGHT COMMITTEE REPORT
Councilman Raven reparted for the Light Committee saying they
had worksd out a plan for 1~rrowhead Park Street Lights for 3 300
watt directional lights on~23rd St. S.E.; 1 300 watt on 24th St.
S.E. and 2 300 watt on 25th St. 6.E. He asked that the City Clerk
be instructed to write a lttter to Puget 9aund Power & Light 'o.
authorizing them to carry out this plan.
ENGINEER'S REPORT
The City Attorney said that all the concrete work for LID 130
is completed and tnere is only the szreet work Ieft to do.
He said he is working on the storm sewer plans now.

It was moved by Stalder and 2nd by Rupert that Ord. No. I201
entitled "An Ordinance of the City of Auburn, Washington, transferi
funds from the LZD reimbursement fund to the materials and supplie:
fund and to the extra payroll fund", be adopted with the following
roll call vote bsing recorded, Hitchcock, yes; Kuehn, yes; Rupert,
yes; Stalder, yes; Snodgrass, yes; and Raven, yes.

It was mozed by Hitchcock and 2nd by Kuehn that Ord, 1204
entitled "An Oedinance of the City of Auburn, Wash,, amending
Sect. 4 of Ord. 119$, which Ord. 119$ is relating to and pro-
viding for the annexation of acontiguous area of land lying
adjacent to the southerly marginal line of the existing city limit
of the City of Auburn, which land is described in a petition duly
filed with the City Clerk of the City of Auburn, so that section 4
as amended shall provide for the proper lega2 description of that
area of land to be annexed to the City of Auburn", be introduced

ORDINANCE N0. 1205
It was moved by Hitchcock and 2nd by Kuehn that Ord. 1205
entitled "An Ordinance of the City of Auburn, Washington,
adopting the Budge-V for the City of Auburn for the year AD 195$11,
be introduced ar_d adopted with the following roll call vote being
recorded, Hitchcock, yes; Kuehn, yes; Rupert, yes; Stalder, yes;
Snodgrass, yes; and Raven, yes.
ORDINANCE N0. 1206
It was moved by Rupert and 2nd by Kuehn that Ord. 1206
entitled "An Ordinance fixing the amounts of tax levies necessary
to raise the amounts of estimated expenditures of the City of Aub
for the yaar 195$ less the amounts of estimated revenues from
sources other than taxation including available surplus, and such
expenditures as are to be met from bonds and warrant issues,
local improvement guaranty funds and cumulative reserve £unds,
and the expenditures for salaries and wages, maintenance and
operation and capital outlay of and for the free public library
of the City of Auburn, all for the year i958^, be introduced
and adopted with the fo llowing roll call vote being recorded,
Hitchcock, yes; Kuehn, yes; Rupert, yes; Stalder, yes; Snodgrass,
yes; and Raven, yes.
ORDINANCE N0. 1207
It was moved by Hitchcock and 2nd;:by Kuehn that Ord. No.
1207 entitled "An Ordinance repealing Ord. No. 1059, which is an
Ordinance amending Sectinn-two of Ord. 1043, relating to levying
an admission tax on persons paying admissions or who are admitted
free or at reduced rates to any place in the City o£ Auburn tffd'
repealing Ord. 1043, which is an Ord. relating to levying an
admission tax on persons paying admissions, or who are admitted
free or at reduced rates to any place in the City of Auburn, fix:bg
the amounts and providing for the collectinn thereof., prescribing
penalties, providing for exemptions and repealing Ord. No. $54
and 1006", be introduced and adopted.
The Mayor said that due to the £act that the City Attorney
was out of town the City Attorneys office had requested that this
Ordinance be introduced only therefore he would entertain a
motion ta introduce this ordinance dnly.
It was moved by Hitchcock and 2nd by Kuehn that Ord.1207
be introduced. MOTION CARRIED
Mri. AgEe asked how the Council could adopt the other
Ordinances when the City Attorney had not made them up. He asked
if the City Attorney's signature was on the budget Ordinances?
The City Clerk said they were nbt.
It was moved by Kuehn and 2nd by Hitchcock that the decision
of the Mayor's to introduce the Ordinance only, be appealed.
The following roll call vote was recorded, In sustaining the
naling o£ the Mayor, Hitchcock, no; Kuehn, no; Rupert, yes;
Stalder, qes; Snodgrass, yes; and Raven, yes.
FITZGERALD CASE
Councilman Hitchcock asked about the r'itzgerald Case.
`he Mayor said this matter had been referred to the City
Attorney.
ROHR ANNEXATION
Councilman Ravaz asked if the request of Rohr to annex
had been considered.
The City Engineer said that there are several petitions
out to annex the area arouhdr:Rohr and they will consider all that
area including the Rohr property at one time.

CONDEMNATION 4F PROPERTY
It was moved by Stalder and 2nd by Raven that the City
Attorney be instructed to prepare the necessary papers to condemn
the Webster property for the 3rd St. S.E. right of way.
MOTION CARRIED
PARK BOARD LETTERS
A letter was received from the Park Board recommending that
the locomotive be placed 75+ due west of the Memorial Bldg. in the
Park.
This letter was ardered placed on file.
A letter was received from the Park Board objecting to the
removal of the locus trees in the Citp Park.
This letter was ordered placed on file and a copy of this
letter be sent to Mr. Nick6lsen.
CHAMBER OF COMMERCE REQUEST
A letter was recezved from J. W. Warren Jr. Secy. of the Chamber
of Commerce, asking that holes be placed in tne concrete on main
street for installing flags.
This was referred to the Street Committee, Street Supt. and
'Police Dept. for study with pcw er to act. '
FIRE CKIEr RE _UEST
A letter was received from the Fire Chieg requesting that the
!east side of B St. S.E. from Main St. to the alley, be made a
;fire lane.
This was referred to the Fire Committee for study with power
ito act.
~ QUARTERLY REPORTS ' -
The quarterly reports on Cemetery aperations and Amse. Game
~land Punchboard and Police Judge Office were received.
These reports were ofdered placed on file.

EASEMENTS
An easement was received from Myron and. Margaret Massey.
This was referred to the City Attornay for recording.
LETTER FROM AUBURN CITIZENS CQMMITTEE
' A letter was••received f rom the Avburn Citizens Committee
asking several questions about the Auburn Water System.
i The Mayor submitted a letter he had written to Mr. Fulmer
~n this matter. This letter was ordered placed on file. '

Councilman Hitchcock asked the Water Committee if they had
ver met with this Auburn Citizens Committee? Mr. Rupert said
he Water Committee has never met with this Coramittee. ;
Councilman Raven aaid he felt the Mayor should appoint a ~
ammittee to study this water prob].em.

roblem. The motion passed with the followirig roll call vote

~rying to get rid of the Water Supt, He said that this was not

0. W. PIERSON REQUEST
A letter was received from 0. W. Pierson asking that he be
informed when somebody files a damage claim against the city.
Councilman Kuehn suggested that just as soon as the City
hears anything about anyone suing the City that they contact the
Cityts Insurance Agent.
MULLENDORE REQUEST
Mr. Mnllendore asked what the status on the admission tax is.
The City Clerk said the Ord. repealing the admission tax has
been introduced and it will come up for adoption and passage at
the next council meeting.
L.I.D. FINAL ESTIMATE
The Engineer submitted the final estimate for Carl Nilson &
Son for LID 130.
It was maved by Rupert and 2nd by Stalder that the final
estimate for Carl Nilson & Son be approved and also the claims
of Zaugg's Concrete Masonry, Harrison Pipe Co., and Rental
Machinery Co." be approved and payment be authorized.MOTION CARRIEI

It was moved by Rupert and 2nd bp Stalder that the following
claims against the cit , all having previously been passed and
