WASHINGTON TUESDAY MARCH 17. 1959 Regular meeting of the City Council of the City of Auburn, held at $:DO P.M. in the Council Chanbers at the City Halls. The Mayor asked everyone to stand while Rev. Yaryan gave prayer. The meeting was called to order by Mayor Denise. Councilmen Present: Aaby, Petersen, Kammeyer, Stalder, Fitzsimmans, Towner, Pregcott. Councilmen Ablent: None Minutes of the previous meeting held Mareh 3, 1959 were approvcd as mailed. PUBLIC HEAftING The Mayor declared the Public Hearing open on the Annexation oP prcpertp North of town, ATorth to 2$$th. There being no one present to voice their opinion against this annexation, the Mayor declared the Public Hearing closed. It was moved by Kam.meper and 2nd bp Preseott that this anu+exation be approved, and the City Attorney be instructed to draw up the neeessarp ordinance. MOTION CARRIED The Mayor declared the Public Hearing open on the assessment roll for L.I.D. #133. There was no one present# tv voice their opinion for or against, so the Mayor dedlared the Public Hearing closed. It was moved by Fitzsimmons and 2nd bp Petersen that L.I.D. #133.be approved, and the City Attorney be instructed to draw up the necessary ordinance. MOTION CARRTED The Mayor declared the Public Hearing open on L.I.D. #135• Mr. Ray Heigghly stated that the City doesntt have a deed on the south side. Mr. Heigghly presented papers that he had acquired, to George Schuler, showing that the Cit,y had no deed. Meorge Schuler requested that the Public Hearing be held over till next meeting. BIDS There were no bids. GOMMI'TTEE REPORTS FINANCE No report PURCHASi111G No report FIRE No report LICENSE The License Committee is turning down the request of Robert Lucas to obtain a City license for an independsnt taxi. It was moved by Prescott and 2nd by Stalder that this request be granted. MOTIHN CARRIED ORDINANCE #1300 It was moved by Prescott and 2nd by Kammeyer that Ordinance #1300, entitled, An ordinance of the City of Auburn, Washington, relating to and prvviding for the annexation of a contiguous area of land lying adjacent to the northerly marginal line of the existing city limits of the City of Auburn to the City of Auburn, which land is described in a petition duly filed with the City Clerk of the City of Auburn, be introduced and adopted with the following roll call vote being recorded: aaby, yes; Petersen, yes; Kammeyer, yes; Stalder, yes; Fitzsimmons, yes; Towner, yes; Prescott, yes; ORDINANCE #1301 It was moved by Petersen and 2nd bp Prescott that Ordinance #1301 entitled, An ordinance of the City of Auburn approving the piat of "Forest Qillar aceording to plat thereof on file with the City Clerk of the Citp of Auburn, Washington, be introduced and adopted with the following roll call vote being recorded: Aaby, yes; Petersen, yes; Kammeper, yes; Stalder, yes; Fitzsimmons, yes; Towner, yes; Prescott, yes; 4RDTNANCE #1302 It was moved by Towner and 2nd by Petersen that Ordinance 11302, entitled, An ordinance of the City of Auburn, Washington, providing for the rezoning of certain property in the City of Xeburn, changing the zoning class of said property from R-50 to RG Residential multiple dwelling, be introduced and adopted with the folloaing roll call vote being recorded: Aaby, yes; Pqterson, yes; Kammeyer, yes; Stalder, yes; Fitzsimmons, yes; Tawner, yes; Prescott, yes; The City Attorney read a letter from Bogle, Bogle, and Gatez informing the City that no agreement with Jeffst Orphan Home can be entered into. It was stated tn the will of Richard Jeffs that no portion of the real estate could be sold, or mortgaged, or leased for a longer period than ten years. 2herefore, a portion of this praperty cannot be bought for the chlorination plaht. The City Attorney recommended that ths Water Supt. check for another suitable site, and if none were available condernnation proceedings would be in order to obtain this property. ORDINANCE #1303 It was moved bp Fitzsimmons and 2nd by Towner that Ordinance #1303, entitled, An ordinance of the City of Auburn, Washington, providing for the rezoning of certain property in the City of Auburn, changing the zoning clas s of said property from R-60 to RG-Residential multiple dwelling, be introduced and adopted with the following roll call vote being recorded: Aaby, yes; Petersen, yes; Kammeyer, yes; Stalder, yes; Fitzsimmons, yes; Towner, yes; Prescott, yes; PAGE 2301 AUBURN. WASHINGTCTN TUESDAY MARCH 17. 1959 WATER SUPT. REPORT There was anot er fish kill last weekend. There was approx- imatelp 3000 gals o bleach that got into the river. They notified the officials in Olympia and the pol.ution dept. in this area. , Lyle Schneider stated that the only possible thing that could ' ',,be done would be to create an ordinance that would punish , ' violators. ' STREET SUPT. REPOBT No report ENGINEER REPORT The State Highway Dept. has called for bids on the following loeations: A St. S.E. from Main to railroad tracts; Streightening curve at 9th & C St. S.E.; C St. N.E. from Main to 2nd N.E. Ordinance #1041, Article 4, Note 9, Special property use, must be changed to read as follows: "The following Board vf Ad,justments may grant a special property use in any use district upon the recommendation of the Planning Commission after a Public Hearing has been held and all interested parties notified of the Public Hearing." It was moned by Towner and 2nd by Petersen that the Citp Attornep be author.ized to deaw up the necessary drdinance to amend Ordinance #1941. MOTION CARRIED OLD BUSINESS X question was raised about the railroad crossing on M St. A committee is checking whether or not they could put signals on the crosszng. NEW BUSTNESS There was no new busineas. CORRESPONDENCE The City Clerk read a letter from the Auburn American Legion rquesting the City Council to approve on the locatian of the carnival at the athletic field near the Auburn Senior High School. A petition was presented to the Council opposing this site. There was considerable conversation both for and against this location. ftepresentatives from the Legion stated that they have looked all over town for a location and have not been successful. A recommendation was given, naming the site where the new fire stateion will soon be built. It was m4ved by Aaby and 2nd by Petersen that this approva3 be tabled till the American Legion, as abody, can vote on a new location. The Mayor appointed Aaby, Prescott, and Fitzsimmons, at the request of Dave Hopkins, secretary of the American Legion, to work with the American Legion Committee on locating a suitable spot for thecarnival. MOTION CARR.IED The City Clerk read a letter from Harry Olsen and Frank King, requesting for the installation of street lights on 22nd S.E. It was moved by Kammeyer and 2nd by Aaby that this request be feferred to the Light Committee. MOTION CARRIED The Citp Clerk read a letter from John B. Robertson, requesting permission to buy some property from the City. It was suggested that they hold this request till they find out if the state will deed saidpraperty. PAGE 2302 AUBURN, WASHINGTON TIIESDAY MARCH 17, 1959 The City Clerk read a letter frorn the Auburn Planning Commission on the request of J.C. Ewing to build a service station on the propertq descriUed in the letter. The Planning Commission recommended that this request be declined. It was moved bp Towner and 2nd by Kammeyer that this nequest be held till next meeting. MOTION CARRIED Mr Ewing was present to voice his opinion about this service station. He stated that the property is located in such a position that nothing could be done to the jproperty. The service station would be ieased to a eompany and not a private individual, so there wouldntt be anq building constructed that would# lower the looks of the area. The City Clerk read a letter from the Auburn Planning Commission on the request of the St. Matthews Episcopal Church to replace a shield wall, and also permission to move their present chapet. The Planning commission recommended that these requests be granted. It was moved by Prescott requests be granted. and 2nd by Petersen that these MOTION CAR.RIED The City C1erk read a letter from the Auburn Planning Comrnission on a petition submitted by David Botting requesting the rezoning of property deseribed in the letter. The Planning Commission recommended the granting of this petition with s ecial recommendations listed in the letter and also that all ##O plans and specifications be submitted to the Planning Commission for final approval bBfore any building permit is issued. It was moved by Petersen and 2nd by Aaby that the reoommenda. tions of the Planning Commission be approved. MOTION CARRIED The Citp Clerk read a letter from the Auhrn Planning Commission requesting an emergency appropriation of $750.00 to supplement the Plarining Gommissions budget. It was moved bp Petersen and 2nd by Kammeyer that this rqquest be granted and the k'ity Attorney be authorized t o draw up tge necessary ordinance. MOTION CARRIED The City Clerk read a letter from Hugh Rippep requesting permission to construct a new White River Presbyterian Chruch on 12th St. S.E. It was moved by Petersen and 2nd by Kammeyer that this request be referred to the Planning Commission MOTION CARRIED Thresolution was presented to the C3ty Council by the Puget Sound Power and Light Co. This contract would run for ten years. Mr. gspinwall stated that tis was just a contract, same as before. It was moved by Kammeyer and 2nd by Prescott that this resolution be approved, with the following roll call vote being re=rded: Aabp, pes; Petersen, yes; Kammeyer, yes; Stalder, yes; Fitzsimmons, yes; Towner, qes; Prescott, yes; AUDIENCE There werer three gentlemen present requesting thatasome- thing be done about the street in front of their home5. Engineer, George Schuler, tald the men that he would write a letter to the company from whom they bought their homes, asking where the money is that the buyers gave to fix the stetitts. Tom Agey was also prESent and gave reasons why the 'City couldn't have sueh a high rate for the porpose of fixing the streets. It was mowed by Prescott and 2nd by Petersen that the water ' ' increase be revoked and the City Attorney be instructed to prepare! the necessary ordinance. MOTION CARRIED CLAIMS It was moved by Petersen and 2nd by Kammeyer that the follow- ing claims against the City, all having previously been passed and signed by the Finance Committee, be approved and the City Clerk be authorized to draw warrants in papment.
