The meeting was called to order by Mayor Pro-Tem Petersen. Councilmen Present: Aaby, Petersen, Kammeyer, Fitzsimmons# C Towner, Prescott Councilmen Absent: Stalder Minutes of the previous meeting held September l, 1959, were pproved as mailed. PUBLIC HEARING The Mayor Pro-Tem declared the Public Hearing open on the vacation of a portion of alley lying between lots 6 through 15, 31ock 2, Youngts First Addition. There being no abjection, the Mayor pro-Tem declared the ?ublic Hearing closed. It was moved by Towner and 2nd by Kammeyer that the City kttorne~y be instructed to prepare the necessary Qx-dinance. MOTION CARRIED The Mayor Pro-Tem declared the Public Hearing open on the vacation of an alley lying between lots 7 through 11, Block 1, Hartman's First Addition. There being no objection, the Mayor Pro-Tem declared the Public Hearing closed. It was moved by Kammeyer and 2nd by Prescott that the City Attorney be instructed to prepare the necessary ordinance. TUESDAY SEPTEMBER 15, 1959 The Mayor Pro-Tem declared the Public Hearing open on the vacation of a 10 foot walkway running North and South between lots g and 9, 16 and 17, of Block l, lots 8 and 9, 25 and 24, of Block 3, and lots $ and 9, 24 and 25, Block 2, All in A.L. Wolf t s Addition. There being no objection, the Mayor Pro-Tem declared the Public Hearing closed. It was moved by Fitzsimmons and 2nd by Prescott that the City Attorney be instructed to prepare the necessary ordinance. MOTION CARRIED BIDS There were no bids. CQMMITTEE REPORTS PURCHASING COMMITTEE No report FIRE COMMITTEE No report LICENSE COMMITTEE The City Attorney will read an ordinance on the Dance License, STREET C OMMTTTEE CounciLnan Towner stated that the Street Committee recommend- ed that the petition for two hour parking on C Street S.E. be denied because some of the property owners had not signed the petition. WATER COMMITTEE Councilman Kammeyer requested that the Council approve the taansfer of money from the Well Fund to the Meter Fund and the Pipe and Fittings Fund. They have completed the new well with out using the entire amount budgeted. It was moved by Kammeyer and 2nd by Aaby that they transfer $4,000.00 into the Meter Fund, and the balance into the Pipe and Fittings Fund. MOTION CARRIED LIGHT CONIMITTEE Councilman Prescott requested that they hang a light in front of the Cemetery Bldg. at the Cemetery because they have had trouble with youngsters in the Cemetery. They Ooped this light would correct the situation. It was moved by Pressott and 2nd by Towner that Puget Sound Power and light be instructed to hang a light at the Cemetery. , MOTION CARZIED ORDINANCE #1343 ~ It was moved by Kammeyer and 2nd by Aaby that Ordinance ~ ~#1343, entitled, An Ordinance of the City of Auburn, King County, Washington, relating to and providing for the vacating of a certaix 10 foot walkway, be introduced and adopted with the following roll call vote being recorded: Aaby, yes; Petersen, yes; Kammeyer, yes; Fitzsimmons, yes; Towner, yes; Prescott, yes; ORDINANCE #1344 It was moved by Towner and 2nd by Fitzsimmons that Ordinance #1344, entitled, An Ordinance of the City of Auburn, Washington, granting a special property use, be introduced and adopted with the following roll eall vote being recorded: Aaby, yes; Petersen, yes; Kammeyer, yes; Fitzsimmons, yes; Towner, yes; Prescott, yes; r,,%GE 2~52 AUBU_RN. WASHINGTQN TUESDAY SaEPTEMBER 15. 1959 ORDINANCE #1345 It was moved by Aaby and 2nd by Prescott that Ordinance #1345, entitled, An Ordinance of the City of Auburn, Washington, 'relating to and providing for the vacating oF a certain alley in ' 'the City of Auburn and reserving an easement thereon to the City 'of Auburn for utilities, be introduced and adopted with the 'following roll call vote being recorded: Aaby, yes; Petersen, yes;' 'Kammeyer, yes; Fitzsimmons, yes; Towner, yes; Prescott, yes; ORDINANCE #1346 it was moved by Fitzsimmons and 2nd by Kammeyer that Ordinance`' #1346, entitled, An Ordinance of the City of Auburn, Washington, amending section 4 of Ordinance No. 1317 of the City of Auburn, said Ordinance No. 1317 providing for the policing and regulation E of parking of vehicles on off-/strest parking lots under lease to ~ the City of Auburn, and prescribing penalties for violations thereof, be 3ntroduced and adopted with the following roll call vote being recorded: Aab,v, yes; Petersen, yes; Kammeyer, yes; Fitzsimmons, yes; Towner, yes; Prescott, yes; j ORDTNANCE #1347 It was moved by Kammeyer and 2nd by Aaby that Ordinance #1347, entitled, An Ordinance of the City of Auburn, Washington, relating to and providing for the vacating of a portion of a certain alley in the City of Auburn and reserving an easement thereon to tne City for utilities, be introduced and adopted w3.th the following roll call vote being recorded: Aaby, yes; Petersen, yes; Karnmeyer, yes; Fitzsimmons, yes; Towner, yes; Prescott, yes; RESOLUTION #54 Tt was raoved by Kammeyer and 2nd by Prescott that Resolution, #54, sntitled, A Resolution of the City of Auburn, King County, Washington, relating to the transfer of funds in the Water Depart- ment so as to provide a transfer of $4,000.00 from the Well Furid to the Meter Furid and the balance of the Weal Fund in the sum of $$,050.91 to be transfered to the Pipe and Fittings Fund, be introduced and adopted witfi the following roll call vote being recorded: Aaby, yes; Petersen, yes; Kammeyer, yes; Fitzsimmons, yes; Towner, yes; Prescott, yes; ORDTNANCE #13 k$ It was moved by Fitzsimmons and 2nd by Prescott that Ordinance 134$, entitled, An Ordinance of the City of Auburn, Washington, ,roviding for the licensing and regulation of Public Dances in the ity of Auburn, and providing for penalties for the violation hereof, and repealing Ordinance No. 95$, be introduced and adopted ith the following rol:l~call vote being recorded: Aaby, yes; etersen, yes; Kammeyer, yes; Fitzsimmons, yes; Towner, yes; rescott, yes; QRDINANCE #1349 It was moved by Kammeyer and 2nd by Fitzsimmons that Ordinance 1349, entitled, An Ordinance of the Gity of Auburn declaring a ublic Emergency to exist and requiring the transfer of $4,000.00 rom the Parking Meter Fund to the Current Expense Fund to meet he monthly payment of #600.00 payable to Duncan Meter Company for ayment of parking meters. MOTION GARRIED WATER SUPT. REPOFcT The Water Supt. requested the Gity Council t4 call for bids n Pipe and Fittings. It was moved bp Kammeyer and 2nd by Aaby that the Gity Council all for bids on pipe and fittings, bids to be opened on October , 1959. MOTION CARRIED PAGE 22 53 AUBURN. WASHINGTQN TUE3DAY SEPTEMBER 15. 1 STREET SUPT. REPORT The construction on L.I.D. #136 has been completed and the northend storm sewer has been completed. ENGINEER'3 REPORT No report OLD BUSINESS Councilman Kammeyer asked about the radiator shop in the residential area. The Eigineer stated that the operator was given 30 days in which to move it to a commercial location. NEW BUSINESS The contractor, Mr. Schermerhorn, that is removing the houses at the Terrace has applied to the Housing Authority for a time extention. The Housing Authority will not grant an extention unless they receive approval from the City Council. It is request- ed that the City Council pass a motion stating that they have no objection to the granting of this extention. It was moved by Prescott and 2nd by Aaby that a letter be written to the Housing Authority granting an extention not to exceed 60 days, also that the Fire hydrants and wtter meters are not to be disturbed. MOTION GARRIED CORR.ESPONDENCE There was no Correspondence. AUDIENCE Mr. Ed Draq requested a legal opinion from the City Council regarding the taking away of trees blown down by the wind. The City has no ordinance regarding trees. It was moved by Towner and 2nd by Prescott that the Street Dept. be instructed to clean off the tree from the property and cut the stump down. MOTION CARRIED It was moved by Towner and 2nd by Prescott that the City Attorney be instructed to change the present ordinance to include trees and shrubbery. MOTION QRRRIED CLAIMS It was moved by Prescott and 2nd by Fitzsimmons that the following claims against the City, all having previously been passed and signed by the Finance Committee, be approved and the City Clerk be authorized to draw warrants in payment.
