The meeting was called to order by Mayor Denise. il Councilmen Present: Aaby, Petersen, Kammeyer, Stalder, Fitzsimmons, Tawner, Prescott. Councilmen Absent: None The Mayor explained that the meeting was called to discuss some financial problems and also the garbage problem. The Mayor then turned the meeting over to the City Attorney. The City Attorney explained that last March when the water dispute had caused the City Council to revoke the water ordinance, they failed to revoke the sewer ordinance at the same time. This means that the City hasn't been charging sewer at the rate of $2.00 as Ordinance #1286 states. There is an estimated loss of $101000.00 resulting from this misunderstanding. It was moved by Kammeyer and 2nd by Petersen that the Mayor instr+act the City Attorney to look into the legality for a retro- active ordinance, with a repott to be given at the next regular council meeting; also, if it is legal, to have an ordinance ready for introduction. MOTION CARRIED The City Attorney explained that upon investigating the complaint of Mrs. Bothell, he found that no charge was being made to the North Auburn Area, which was in violation of City ordinance The City Council instructed the City Attorney to write the City Treasurer instructing him to start billing the residences in North Auburn. ' The City Attorney wxplained that an opinion from the Attorney General states that a City of third class mLs t have annual bids for garbage service. This being the case, Auburn will have to call for bids on an annual basis or go into the garbage business ' for itself. The City Attorney stated that he was going to appear in court Wednesday regarding the show-cause order. There being no further business to come before the City Council, the meeting was adjourned at 9:40 P.M., subject to the call of the Mayor. .
