SLOPE EASEMENT FAC06-0013 Grantor/Borrower: Todd Duty / I f fl V r~ Grantee/Assignee/Beneficiary: City of Auburn Legal Description/STR: SW %ofSW V ofS32-T21N-ROSE Assessor's Tax Parcel ID#: 3221059011,3221059030,3221059037 The Grantor, Todd Duty, for and in valuable consideration in hand paid, does hereby grant and convey to the Grantee, City of Auburn, a Washington municipal corporation, and its agents or assigns a permanent, non-exclusive slope easement over, under, upon and across the real property described in Exhibit "A" attached hereto and incorporated by this reference, together with the rights of ingress and egress, for the purpose of constructing and maintaining the slope improvements to be constructed by the Grantee, including grading, stock piling, excavating and restoring the real property and/or the slope improvements. The slope easement is described in Exhibit "B" attached hereto and incorporated by these references. Upon completion of construction of the slope improvements, Grantee shall restore the easement area to a condition as close as reasonably possible to its pre-construction condition while maintaining the integrity of the slope improvements, or to such other state of restoration as mutually agreed upon by the parties. i .,d wn.„ Slope Easement S Page 1 of 7 Easement Area includes a connection ditch reserved for the purpose of providing for storm water runoff draining from adjacent property to the ditch along Evergreen Way SE until a permanent alternative connection is constructed and approved by Grantee for conveyance of storm water from Grantor's proposed subdivision and the adjacent property to the East. Upon demonstration that the area shown in Exhibit "C" is no longer needed and final acceptance of the permanent conveyance of the storm water runoff from the adjacent property, the Grantor may request the relinquishment of that portion of this Easement, as shown on Exhibit "C" attached hereto and incorporated by these references. Grantor shall not perform any activities that may damage improvements built or constructed within the easement areas, including the planting of vegetation with damaging root structures or performing any excavation that would have the effect of weakening the support of said improvements. This Easement shall be a covenant running with the land and shall be binding on the successors, heirs and assigns of all parties hereto.
