Administrative Recommendation: Recommend adoption of Resolution No. 4633 authorizing execution
of grant agreement with the King Conservation District and acceptance of grant funds for the design,
permitting, and construction of the second phase of the Fenster Levee Setback project.
Background Summary:
The City of Auburn and Water Resource Inventory Area 9 (WRIA 9) first identified the Fenster Levee
setback project on the Green River in Auburn as a priority salmon habitat project when developing the WRIA 9 Salmon Habitat Plan in 2000. The City of Auburn applied for and received
Salmon Recovery
Funding funds through the Washington State Recreation and Conservation Office to complete Phase
I of the Fenster Levee setback project in 2006. The City of Auburn completed Phase I of the project in
2008 which involved approximately 700 feet of levee improvement, the placement of large woody
debris and rock armoring, and the planting of native riparian trees and shrubs. The City of Auburn
applied for King Conservation District grant funds in 2010 in order to complete Phase II of the Fenster
Levee setback project which will setback an additional segment of levee immediately adjacent to the north of the first phase of the project near River Mile 32 on the Green River. Project
components
include approximately 880 feet of levee setback, re-attachment of a large forested swale to the river
for off-channel habitat and fish refuge, increased area for floodwater quieting and storage, removal of
invasive plans, native plant revegetation, and the installation of large woody debris at the toe of the
new levee. This project will allow for greater movement of the Green River during the winter high flow
period and increased flood storage, providing both greater protection of downstream property, and
also refugia for threatened salmon and steelhead on the Green River. The site for this phase of the project is adjacent to the downstream end of an intact two-mile long riparian corridor
along the Green
River within the Fenster Nature Park (Auburn) and the Auburn Narrows Natural Area (King County).
The City's Fenster Levee Setback &Floodplain Restoration II project was approved for the full
funding request of $200,000 by the King Conservation District on July 12, 2010. A grant agreement
from the King Conservation District was received by the City on July 27, 2010. The grant does not
have a formal match requirement. The City previously received a $304,103 Salmon Recovery
Funding Board grant (approved by City Council on April 5, 2010) and authorized $35,000 in City
Storm Funds for the project. The King Conservation District grant will fulfill the fifteen percent
matching requirement on the Salmon Recovery Funding Board grant.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF AUBURN, WASHINGTON, AUTHORIZING
THE MAYOR TO EXECUTE A GRANT AGREEMENT
BETWEEN THE CITY OF AUBURN AND THE KING
CONSERVATION DISTRICT FOR THE FENSTER
LEVEE SETBACK & FLOODPLAIN RESTORATION,
PHASE II PROJECT
WHEREAS, the Fenster Levee Setback is a project identified in the
Green/Duwamish and Central Puget Sound Watershed, Water Resource
Inventory Area 9, Salmon Habitat Plan, Making our Watershed Fit for a King,
dated August 2005 and ratified by the City Council of the City of Auburn ("City")
by adoption of Resolution No. 3922 on October 17, 2005; and
WHEREAS, the City and King County Water and Land Resources
Division (WLRD) entered into an interlocal agreement for the performance of
work for the Phase I of the Fenster Levee Setback project as authorized by the
Auburn City Council by adoption of Resolution No. 4054 on July 17, 2006; and
WHEREAS, the City and King County WLRD have completed the
construction of setback levee improvements and habitat restoration as part of
Phase I of the Fenster Levee Setback project; and
WHEREAS, on November 17, 2008 the City Council adopted Resolution No.
4415 authorizing the City's acceptance of a $130,000 grant from the King
Conservation District for the acquisition of the Smith Property which was identified

as a critical segment of the Fenster Levee Setback project, and did subsequently
purchase the property, thereby completing City ownership of the proposed project
site; and
WHEREAS, on April 5, 2010 the City Council adopted Resolution No. 4584
authorizing the City's acceptance of a $304,103 grant from the Salmon Recovery
Funding Board for the Fenster Levee Setback, Phase II Project; and
WHEREAS, the King Conservation District is a local agency responsible for
the administration of WRIA Forum Grants for salmon recovery projects; and
WHEREAS, the City has been awarded a King Conservation District grant in
the amount of $200,000 for the design, permitting, and construction of the Fenster
Levee Setback, Phase II Project.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, HEREBY RESOLVES as follows:
Section 1. The Mayor is hereby authorized to execute a Grant Agreement
between the City and King Conservation District in the total amount of $200,000, or
such amount as may be awarded to the City under the Grant Agreement, in
substantial conformity with the agreement attached hereto, marked as Exhibit "A"
and incorporated herein by this reference.

Section 2. The Mayor is hereby authorized to implement such
administrative procedures as may be necessary to carry out the directions of this
legislation.
Section 3. That this Resolution shall take effect and be in full force upon

Far the Fenster Phase II levee Setback project, the City plans to continue to work with Icing County
as was lane as the Fenster levee Phase 11 setback praject to make the praject mare cast effectiveF
King County developed expertise designing and constructing levee setback projects in this reach of
the green River while working on the Pautzke and Fenster l levee setback projects, immediately - adjacent to the Fenster Phase II levee Setback 1Norkin with ding bounty to construct
the Fenster
levee Setback Phase II praject will require less detailed piano and less construction oversight due to
their familiarity with similar levee setback projects in this reach of the green River. To date, l~Cing
bounty has helped the City identify cast saving measures for the Phase 11 Levee Setback praject such
as reusing cut soils an-site rather than paying to haul them aff~site for ~ispasal.
Following construction of the levee setback, the site will be replanted and monitored. The Clty intends
to partner with the Veteran's Conservation Corps in order to carry out the replanting and monitoring work. ll~aintenance activities will continue for at least three years fallowing praject
car~pletian to
achieve a 9D~Io plant survival rate. As a part of the praject, ~4 by 3~ inch educational signs will be
installed at the two entrances to the project site to describe the purpose and benefits Qf the project
and to acknowledge the project sponsors.

This project is closely associated with the "Direct Improvement of hfatural Resource anditions"
natural resource improvement action. As a result of the project, S~0 feet of levee will beset back to
open up instream, riparian and flaadplain habitat. This addltianal habitat will serve as aff~channel
habitat far juvenile salr~onids, including SSA-listed Chinook and steelhead that are incubating or
rearing in the green RiverF Fish populations found in the river include Cabo juveniles and adults, Chinook juveniles fall stages}, cutthroat, bull trout, steelhead, sockeye, pink and
chum.
This site is a critical location within the Green River system, located at the break between the
. functions of the louver and riddle Green River. with the minimal amount of habitat and refuge
available downstream, this praject will be one of the first refuge sites for adult salmon in their
upstream migration, and one of the fast refuge sites for juvenile salmon during their outmigratian to Puget Sound. This praject will allow j~rvenile salmanid access to a previously cut-off
forested bench
and side channel, and provide refuge during critical migration periods The project will meet the-
follawingobjectives: improve water quality, improve riparian habitat and access, provide increased
area for flood storage ar~d flood velocity attenuation, and provide high quality off~channel habitat

The City of Auburn completed Phase l of the Fenster Levee Setback project using Salmon Recovery
Funding Board funds In ~g08. Phase I of the setback is located adjacent to the proposed Phase I1
setback location and has similarities to the Phase I I project. The City of Auburn worked with King
County in artier to complete Phase I of the project and intends to work with King County again to
complete Phase II of the project. King County has experience setting back other levees in the
irn~nediate vicinity of this project ~e,g~ Paut~ke Levee Setback completed in ~4Dg},The past successes that the City of Auburn and Ding County have completed setting back levees in this
section
of the green River will help to ensure the success of Phase ll of the Fenster Levee Setback. The City

Both King County and the City of Auburn have conducted levee setback projects in the past slang this
section of the green Riven From this past experience, efficiencies have been developed. Initial
engineering cast estimates for Phase II of the project have been reduced significantly by finding ways
to make use of the excavated fill on-site rather than having to dispose of it off sits, Constructing this levee setback will complete a two~mile corridor of restored habitat in Auburn
and Icing County. The
adjacent projects have been designed to fit together seamlessly to maximl~e the benefits of the
overall restored corridor Phase ll of the Fenster Levee Setback has received a $~a4, ~ 0 grant tram
the State alrnar~ Recovery Funding Board that would be leveraged with the King Conservation
District Funds.
In order to increase the efficiency of the project, the City of Auburn is proposing to contract with King
County to complete the design and construction of the levee setback project. King County worked on
the design and cnr~struction of both of the adjacent upstream levee setback projectst Phase I Fenster
Levee Setback and the Pautzke Levee Setback, With these past projects, Icing County has became
familiar with the design and construction techniques used for levee setback projects an this reach of the green River, This familiarity with the levee setback projects in the area should
translate into lower

savings since full specifications and a bid package are not rewired under this approach this is similar

would require the completion of full plans and bid specifications which would raise the project casts by
up to percent and would require the City to identify a source of additional funding to complete the
