It arr►ended Section ,2~,2~~ of the Auburn City Code adopting Chapter and future
amendments by reference and specifying the requirement to have a Kind County taxicab Ilcense to
opera#e in the City of Auburn ordinance nv. aiso granted the Mayor and City Clerk the
authority to execute an agreement vuith ding County for the enforcement of taxicab regulations in
conformance ~vith the executed interlacal agreement.

As a reminder, a I'Cing County taxicab far for-hire vehicle license is required of any taxicab or for-hire

International Airport, and the city limits of Auburn, Bellevue# Burien, Enumcla~r, Federal V~ay, l~enmore$

refrzed to as the "City", under authority of Chapter ~~.~4 Revlscd Code of wasl~ington.
wl~~l~AS, the Cou~~ty and the City have jurisdiction to regulate the busi~e~s of
operating taxicabs and fo~•-hire vehicles and their drivers within their respective
bo►~~~daries; and
w~E~AS, the business of operating taxicabs and for~hire vehicles presents
peculia~~ licensing and law enfareerr~ent prablen~s of a multijurisdictianal nature; and r
w~~RAS, it desirable in order to a~lequateiy protest tl~e interests ofthe
Cou~~ty and the City and the citi~errs thereof, to provide for a uniform Countywide system
of licensing taxicabs and for~hire vehicles and tie drivers thereof'; and
~~R~A, the County and its ernployees, and more particularly the Licensing
Services Section, Records, l~lections and Licensing Services ~ivisioz~, ~epartm.ent of
l~xecutive Services, are ellMqua~if~ed and able in rnatters relating to the licensing and
er~force~~ent of lags relati~~g to the conduct of the taxicab and far-hire vehicle business;
w~l~l~AS, the ~ desires to obtain the assistance ofthe County in matters relating to the licensing and enforcement of laws re~atitag to the conduct of the taxicab
and ~'or~~.ire vehicle business; and
w~IAS, the County i ready willing and able to assist the City in mutters
relating to the licensing and enforcement of laws relating to regulation of taxicabs and
for~l•-lire vehicles and the drivers thereof;

notices ofviolation and. court citations for alleged violations of pity

pursuant to this agreement do not include legal services, which shall be
provided by the City at its own expense,

I, GENERAL PI~~VIIC~N
6~84~005 Purpose. The purpose of this chapter i to further for the public the safety,
reliability} and economic viability and stability of privately operated taxicab transportation
services within Ding County These matters are matters of public concern, and accordingly, this chapter is intended to protect the public a a whole and shall not be
construed to create a duty toward any particular individual or groups of individuals. Ord,

8~64~~87 scope of authority. Unless otherwise specifically stated, binding provisions shall apply to all licensees operating in the unincorporated areas of ding County and other
jurisdictions or public agencies authorized to contract for services with ring County under
the authorities provided in the interlocal Agreement Act, RCw 89.4, as mended;
provided, that should provisions herein conflict with thane contained in any such interlocal
agreerner~t, the interlvcal agreer~ent shall supersede in all cases. ~~rd. ~ x498 4, ~ 99},

.G4.0~ ~ ~efinltions. 1=or the purposes of this chapter and unless the context plainly
requires otherwise, the fallowing definitions apply;
A. "Affiliated representative" means the individual within the service organization who has the authority to file special rated and contract agreement rates and charges far a
group of affiliated taxicabs, and who is designated as the individual responsible for the
receipt of any correspondence ar notices pertaining to the service organization or the
taxicabs ar for~hire vehicles operating within the service argani~ation,
B "Affiliated taxicab" means a taxicab associated with a service organisation, "Alcohol" means a mixture containing na less than eighty-foe percent r~ethanvl~
ethanol or other alcohols in any combination, by volume.
D "A~ternative fuels' means a means for propulsion by other than gasoline or diesel
fuel and shall include

Ftuman powered, E. "Approved mechanic facility" means a garage ar repair facility who employs

who have been awarded certificates in Evidence of competence satisfactory to the
director, and who are Authorized Err~issian specialists certified by the v~lashington Department of Ecology, and none of whom are the owner, lessee, or driver of a ta~cicab, or
farhire vehicle or the employee of a taxicab or for hire vehicle cor~pany, and none of
whom have a financial interest in a taxicab or for-hire vehicle ar taxicab ar for hire vehicle
corupany,
"nntract agreement rate" means the rate specified in a written agreement signed by both parties in advance of the dispatch of a taxicab or for~hire vehicle for the
services identified in the contract,
. "Director" means the director of the Ding bounty department of executive
services and his or her duly appointed representatives.
k~, "Dual energy" means capable of being operated using an alternative fuel and gasoline or diesel fuel.
"Engage in the business of operating a taxicab or vehicle far hire" means the
pickup and tranpo~#ation of any fare paying passenger from a point within the
geographical confines of unincorporated l~Cing bounty, whether ar not the vehfcie is
dispatched from a taxicab stand ar office within any other municipal corporation, and whether or not the ultimate destination or route of travel is within the confines of
unincorporated l~Cing bounty; provided, that nothing In this chapter shall be construed to
apply to taxicabs ar forhire vehicles licensed by any other rnunlcipal corporation and
transporting passengers fror~ a point within the licensing rnunlcipality to a destination
outside thereof, whether or not the ultimate destination or route traveled is witl~ln unincorporated Ding bounty,
J. "i=or~hire drive' means any person in control of, operating or driving a taxicab or
farAhire vehicle and includes a lease driver, ownerloperator, ordriver of taxicabs orforMhire
vehicles as an employee.
I~, "F'ar-hire vehic#e" means and includes every motor vehicle used far the transportation of passengers for hire, and not operated exciusiveiy over a fixed and
definite route, except:

P. '"Lesser" means an owner of a taxicab ~r for-hire vehicle who leases, by
contract or other form of agreement, to a lease driver as defined in this section.
Q "Licensee" rnear~ all applicants, including forMhire drivers, vehicle owners, and
service orani~atians including the affiliated representative required tv license under the
previsions of this chapter. R, "i~atar vehicle" means every n~atarized vehicle by or upon which any person
may be transported ar carried upon a public street, highway ar alley; provided, that
vehicles used exclusively upon stationary rail tracks or propelled by use of overhead
electric wins shall not come under the provisions of this chapter. "ervite organization" means a group of taxicabs awned or operated by the
same or various owners and using the same color scheme, trade name, dispatch services, .
and having an afflicted representative,
T. "special rate" means discounted rates for senior citizens and disabled,
"Taxicab'} means every mater vehicle used for the transportation of passengers
for hire, where the route traveled or destination is controlled by a customer and the fare is based on an amount retarded and indicated on a taximeter, or on a special fare rate ar
contracted agreement as permitted by this chapter.
V, "Taxicab vehicle owner" means the registered awr~er of the vehicle as defined
. by Raw 4.Q4,~4~Q a now ar hereafter amended. "Taximeter" means any instrument Or device by v~rhich the charge far hire of a
passenger carrying vehicle is measured or calculated either for the distance traveled by
such vehicle orfarwaitingtime, vrfor bath, and upon which such calculated charges shall

consalidating far-hire driverf taxicab and for-hire vehicle licensing, administration and
enforcement, reducing duplication of licensing functions, and a sharing of license fees as
agreed to by the city and county, The agreet~ent may authorize the city to accept and
investigate applications for and issue taxicab and for-hire vehicle licenses and license renewals on behalf of the county, provided that the city uses the requirements of this
chapter far taxicab and for~hire vehicle licenses. The agreement may authorize the county
to accept and investigate applications far and issue for~hire driver licenses and license
renewals andlor taxicab vehicle licenses and license renewals on behalf of the city,
provided that the city agrees to the requirements of this chapter for driver licenses cndfar ta~lcab licenses,

The public need for adequate taxi service at the lowest level of charges
consisten# with the provisionr maintenance and continuation of such service;

provided pursuant to a written contract which establishes a fare at a different rate for pecitied transportation and has been previously €iled with the directorF provided, that no

otherwise, the faClowing definitions apply;
A. "Affiliated representative"' means the individual wi#hin the service organisation who has the
authority to file special rates and contact agreement rates and charges far a group of affiliated taxicabs, and who is designated as the individual responsible for the receipt of any
carrespandence ar notices pertaCning to
the service argani~ation ar the taxicabs or for~hire vehicles operating within the service argani~ation.
ii l3, Af~l~ated taxicab means a taxicab assac~ated with a service argan~zat~an,
~ "Alcohol'" means a mixture containing no less than eighty~five percent methanol, ethanol or other
alcohols, in any combination, by volume, - D. "Alternative fuel" means a means far propulsion by other than gasoline or diesel fuel, '}Alternative
fuel includes:

4. None of whom are the owner, lessee ordriver of ataxicab arfor-hire vehicle or the employee of
a taxicab or for4hire vehicle company; and None of wham have a financial interest in a taxicab or for~hire vehicle or taxicab or for~hire .

F~ "Contract agreement rate" means the rate specified in a written agreement signed by both parties
in advance of the dispatch of a #axicab or far~hire vehicle for the services identified in the contract.
. "Director" means the director of the King County department of executive services and his or her duly appointed representatives, ~ '
H. "Dual energy'" means capable of being operated using an alternative fuel and gasoline ar diesel
fuel, .
1. "'engage in the business of operating a taxicab or vehicle far hire" means the pickup and
transportation of any fare paying passenger from a paint wi#hin the geographical canines of unincorporated Ching County, whe#her or not the vehicle is dispatched from a taxicab stand
ar office within any other
municipal corporation, and whether or not the ultimate destination or route of travel is within the confines of
unincorporated i'iing County, However, nothing in this chapter shall be construed to apply to taxicabs or forR
hire vehicles licensed by any other municipal corporation and transporting passengers from a point within the
licensing municipality to a destination outside thereof, whether or not the ultimate destination or route traveled is within unincorporated King County. -
J. "Foryhire driver" means any person in control of, operating or driving a taxicab or for~hire vehicle

. "service organization" means a group of taxicabs owned or operated by the same or various owners and using the same color scheme, trade name and dispatch services} and having an affiliated
representative.
T. "peciai rate" means discounted rates for senior citizens and disabled.
U. "Taxicab" means every motor ~rehicle used for the transportation of passengers far hire, where the route traveled or destination is controlled by a customer and the fare is based

and indicated on a taximeter or on a special fare rate or contracted agreement as permitted by this chapter,
V. "Taxicab vehicle owned' means the regis#ered owner of the vehicle a defined in RCVU 4~o~.4~0,

VII. "Taximeter" means any instrument or device by which the charge far hire of a passenger- carrying vehicle is measured or calculated either for the distance traveled by the vehicle
or far waiting time, or

~~11lheeichair accessible taxicab means a taxicab designed or modified to transport passergers
in wheelchairs or other mobility devices and conforming to the requirements of the Americans with Disabilities

eatfle for the purposes of coordinating and consolidating for-hire driver, taxicab and forRhire vehicle licensing, administration and enforcement, reducing dup[icatian of licensing fk~nctions,
and a sharing of
license fees as agreed to by the city and county. The agreerrkent nay authorize the city fo accept and
investigate applications far and issue taxicab and for~hlre vehicle licenses and license renewals on behalf of
the county, provided that the city uses the requirements of Phis chapter far taxicab and foryhire vehicle
licenses. The agreement may authorize the county to accept and investigate applications far and issue for
hire driver licenses and license renewals andlor taxicab vehicle licenses and license renewals on behalf of the city, provided that the city agrees to the requirements of this chapter

A~ The applicant shall provide an insurance policy declaration or insurance binder proving
. compliance with chapter 46,72 R111J, as now ar hereafter amended, for each taxicab or for~hire vehicle to be licensed. The policy declaration or insurance binder shall also provide
that the insurer notify the director of
any cancellation, in writing, at least thirty days before cancellation of the policy;
B, The policy shall be issued by an admitted carrier in the state of ~Illashingtan with at least an AR
~nanclal rating by A.Ni, Best, but the director may temporarily suspend either ar bath of these requirements if

shall be operated without having passed inspection within the last six months. The inspection required by this section and the vehicle opera#ing standards shall include the following:

A. Upon receiving a written complaint involving the conduct of the far~hire driver, the route of
