AUBURN. WASHINGTON MONDAY DECEMBER 15. 1980
The regular meeting of the City of Auburn Council convened at 8:00 p.m. in the City of
Auburn Council Chambers.
ROLL CALL
COUNCILMEMBERS: Councilmembers Roegner, Craig, Larson, Hitchcock, Flechsig
and Lea present. Kitchell excused.
APPROVAL OF MINUTES
It was moved by Flechsig, seconded by Hitchcock, to approve the minutes of the December 1,
1980, Council meeting with the correction to Item No. on page 8, which should read
Change Order No. 6 instead of Change Order No. 5.

PUBLIC HEARINGS
AUBURN PROPERTIES INC. - VACATION - 49TH - APPL. V-7-80 - Mayor Kersey declared the
public hearing open on the request of Auburn Properties Inc. d/b/a Sandy Blvd. Drive -In
Theatres Inc. for vacation of '49th St. N.E. between "D" and "G" Streets N.E.

Ron Thompson, attorney representing the applicant, noted two minor changes which needed
to be made to the petition. First, the legal description should be north instead of
south. Second, the name should be changed to Auburn Properties Inc. He said they were
Qdoing business as Sandy Boulevard Drive -In Theaters, Inc., however, the correct name
was Auburn Properties, Inc. He added the adjoining property owner, Mr. Stiene, and
Q the applicant had come an agreement which would resolve the problems over the vacation.
Ronald Stiene, 15425 6th S.W., Seattle, confirmed an agreement had been signed and
stated he was now supporting the vacation.
It was moved by Lea, seconded by Hitchcock, to close the public hearing.
MOTION CARRIED
tLea reported the Street Committee had reviewed this request and they had no objections
to it. Pat Nevins added the easements had been taken care of.
Jack Bereiter asked for clarification of where the City fit in with the agreement between
Auburn Properties and Mr. Stiene. Lea stated the City wasn't a part of it. Bereiter
stated the point he wanted to make was the City was not a participant in the agreement.
It was moved by Lea, seconded by Hitchcock, to approve the request of Auburn Properties,
Inc. d/b/a/ Sandy Boulevard Drive -In Theatres Inc. for vacation of 49th St. N.E. between
"D" and "G" Streets N.E., Application V-7-80, and instruct the City Attorney be instruc-
ted to draw up the necessary ordinance with resevation of easements.
ROLL CALL VOTE: Councilmembers Lea, Roegner, Craig, Hitchcock and Flechsig
voted YES. Councilmember Larson voted NO.

AUDIENCE PARTICIPATION
James C. Bassett, Tacoma, spoke regarding his assessment for White River -Tracts No. 8 &
9 on Local Improvement District No. 318. lie asked that the Council delay creation of
the LID until after January 1, 1981. By doing so he would be eligible to apply for the
open space program which would exempt from the burden of the LID assessment.
Mayor Kersey asked if he understood Mr. Bassett that he had no thoughts of delaying the
L.I.D. other than just to allow him to apply for the open space program.
Craig stated he didn't see any objection and if this was Mr. Bassett's intent, the L.I.D.
ordinance could just be introduced. He added the City wasn't under any particular dead-
line. He asked Mr. Bereiter if there would be any problems.
Bereiter said he could see no legal problems and asked what dollar amount was being
talked about. Nevins said it involved about 500 acres and around $12,000.00.

Craig asked if Mr. Bassett's property was left out, would the assessment have to be
divided among the others. Bereiter added if the property were classified as open
space there was one twist in that if it ever reverted hack the assessments would be
retroactive.
Hitchcock asked if the other property owners were aware this could cost them more
money? Nevins said it had not been brought out in the meeting.
Craig said Mr. Bassett had this right under the law no matter when he did it.
Hitchcock said it was unfortunate it didn't come yp before.
Lea asked if it was delayed would it be appropriate to inform the other participants.
Craig asked what the total amount of the LID would be? Nevins replied it was approxi-
mately $600,000. Craig said they were talking about a large LID and not too much
to each participant.
Roegner asked if there would be any cost in delaying. Bereiter said he had been hit
with a situation he'd never been confronted with before. He stated��hat he heard was
happening was the City would be giving a citizen an opportunity to file according-s-p
law that he has a right to take advantage of. He suggested the matter be tabled to
study further.
Craig stated there's was not a time limit. Flechsig concurred since it would give
the Council some time to review the situation.
Nevins added he agreed with the action but wanted to note the estimate is old and
gets higher and higher as time passes.
ORDINANCE NO. 3587 - LID 318 CREATION - It was moved by Craig, seconded by Larson,
that Ordinance No. 3587, entitled, "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON,
PROVIDING FOR THE CONSTRUCTION AND INSTALLATION OF SANITARY SEWERS IN THE AREA OF 37TH
STREET N.E. AND N.W., BETWEEN "C" STREET N.E. AND THE WEST LINE OF THE PUGET POWER '
RIGHT OF WAY LYING WEST OF THE CHICAGO MILWAUKEE RAILROAD RIGHT OF WAY, WITHIN THE
CITY OF AUBURN, WASHINGTON; CREATING AND ESTABLISHING LOCAL IMPROVEMENT DISTRICT NO
318; PROVIDING THE METHOD OF ASSESSMENT IN SAID DISTRICT AND THE MODE OF PAYMENT
THEREOF, AND CREATING A LOCAL IMPROVEMENT FUND THEREFOR," be introduced only.

REZONE-MERRILL MORRIS-APPLICATION 32-80
Don Rippy, 1810 2nd S.E., spoke for the 76 property owners petitioning to have the
rezone of Merrill Morris denied. He said they did not wish to prevent Mr. Morris
from selling his property, however, they did wish to keep the adverse affect on the
neighbor to a minimum. They were against cluttering up the neighbor with more duplexes.
He stated they felt the solution to the problem was to have the City Council and the
Planning Department maintain the R-2 zoning and request Mr. Morris develop a new
access road into his property from "R" St. He added they believed if Mr. Morris lived
in the area, he would feel the same way. Rippy summarized his comments by saying
the traffic problems on "T" Street and down -grading of the area by adding more multi-
family units were why they felt single family residents were best for this area.
Walt Holiday, 1907 - 2nd S.E., noted there was only one person, sir. Morris, who was in
favor of the request. He said 76 residents had signed a petition against the rezone.
Holiday stated if Mr. Morris lived in the area he would probably feel the same. lie
reported that on August 10, 1978, the King County Department of Planning and Community
Development denied a similar zoning at 304 "T" S.E. because of access problem and_
the proposed rezone would not carry out the goals and objectives of the King County
Comprehensive Plan and growth of King County. He also reported on November 4, 1980,
the Auburn Planning Commission voted unanimously to maintain the zoning as R-2 for
this property. He said if a second access road could be provided from "R" St. this
might alleviate the problems.

Doug Hanson, stated he also did not want to see the area go to R-3 or R-4.
Tom Butanco, 230 "D" St. said he bought the property because it was in a single family
residential area. He expressed concern about the traffic especially because of
children in the area.
Fred Delvecchio, 14 "T" St. S.E., thought "T" Street was just not adequate to handle
any increased traffic of any kind.
Corliss Strand, 125 "T" St. S.E., said the area directly behind his house and adjacent
to Mr. Morris's property on the north is zoned R-3 and filled with duplexes. He wanted
to point out this R-3 zoning is not justification to rezone Mr. Morris' property because
the two situations are different. He noted the duplex area has its own access road
comingfrom "R" Street and does not involve "T" Street. He pointed out Mr. Morris doesn't
live in the area and would not be affected by the problems created by the development.
Eric Davidson, 109 "T" St. S.E., asked the Council to consider the personal aspect
too. He felt apartments would take away the lifestyle he had wanted when he bought
his property.
Marie Wood, 108 "T" St. S.E., thought the area was not very good for apartments and
that there was enough problems with traffic. She added Renton and Bellevue were a
mess and didn't want to see Auburn be the same.
Dave Bjork, 2130 2nd St. S.E., concurred with his neighbors and asked the Council to
reject the rezone request.

Bids were opened at 11:00 a.m., December 9, 1980, for the legal publication costs for

It was moved by Flechsig, seconded by Lea, to award the bid for legal publications for
1981 to Fournier Newspapers.

CONSENT AGENDA
It was moved by Roegner, seconded by Craig, to approve the consent agenda as outlined:
1. Conditional Use Permit request from Frank L. Miles from R-1 (Single Family) to
R-2/CUP for development of condominium units. (Application 39-80)
2. Request from Frank L. Miles, Don Mar Inc., Mrs. Clarence Pautske to rezone from
R-1 (Single Family) to R-TP(Mobile Home Park) and R-4 (Multi -Family), property
located south of Highway 18 and Northeasterly of White Lake and east of "R" St.
S.E. to be extended between 12th and 17th St. S.E. (Application 40-80)
3. Request of Frank L. Miles, Don Mar Inc., Mrs. Clarence Pautzke and Olga Meade
for a Special Property Use Permit for Gravel Removal on property presently zoned
R-1 (Single Family) located south of Highway 18 to 17th S.E. and from "R" S.E.

RECOMMENDATIONS
Public Works:
1. It was moved by Lea, seconded by Roegner, to authorize Change Order No. 7 to St.
Imp. 165, "A" St. S.E. construction, increase in the amount of $4,460.20 covering
several miscellaneous items of work on this project regarding storm drain line at
Cool's Mobile Home Park, manhole lid and frame, fire signal at 7th & "A" and
and electrical supports and service panels for signals on the street lights.

2. It was moved by Craig, seconded by Larson, to authorize the purchase of a new com-
pactor to replace Water Division's old one from Equipment Reserve Fund 109•

3. It was moved by Craig, seconded by Larson, to authorize the purchase of a new
portable pump for the Sewer Division from Equipment Reserve Fund 109.

4. It was moved by Craig, seconded by Larson, to authorize Change Order No. One to
Contract 80-06, L.I.D. 300, Western Street Sanitary Sewer, increase in the amount
of $1,418.06 removal of storm sewer line conflicting with new sanitary sewer line
construction.

5. It was moved by Craig, seconded by Larson, to authorize a utility credit to Account
No. 235-1920, 2024-2026 "F" St. S.E. in an amount of $42.94 to sanitary sewer
bill due to water leak.

6. It was moved by Craig, seconded by Larson, to allow Lenes Rasmussen six months
51 to pay for large water/sewer bill for service to 107 "N" Street S.E.

PROCLAMATIONS, APPOINTMENTS AND ANNOUNCEMENTS
Mayor Kersey announced the new maximums for elibility for the Senior Citizens and
Handicapped persons for reduced utility rates.

Roegner reminded everyone of the legislative workshop scheduled for tomorrow night.
Planning & Community Development Committee - Vice -Chairman Ron Craig
It was moved by Craig, seconded by Roegner, to authorize the circulation of a 75%
petition for annexation of a fifteen acre parcel of land on the west side of the
West Valley Highway abutting our north City Limits line.
MOTION CARRIED
It was moved by Craig, seconded by Roegner, to authorize the circulation of a 10%
petition for annexation of a 120 acre parcel of land lying north of 368th St. S.E.
abutting the east City Limits line.

It was moved Flechsig, seconded by Lea, to approve claim checks #8485 through 8847
in the amount of $482,523.67 and payroll checks #14359 to 14642 in the amount of
$193,456.15.

Hitchcock asked if. Morris would have to put in the street before he could develop
the property. Schuler said he would berequired to improve his half of the street.
Lea asked what the Planning Commission recommendation was. Schuler responded denial.
Lea asked Schuler what his recommendation was. Schuler said he recommended denial
until an additional access had been provided.
Bereiter asked Craig if the intent of his motion was to deny the request based on
the Planning Commission recommendation. Craig said yes.
