The regular meeting of the City of Auburn Council convened at 8:00 p.m. in the City
of Auburn Council Chambers.
ROLL CALL
COUNCILMEMBERS: Councilmembers Roegner, Kitchell, Craig, Larson, Hitchcock,
and Flechsig present. Councilmember Lea excused.
APPROVAL OF MINUTES
It was moved by Flechsig, seconded by Hitchcock, to approve the Council minutes of
the May 18, 1981, meeting with the following, correction to Page 1, Audience Participa-
tion, Paragraph 5, second sentence, "He noted the reason the staff recommended denial..."
which should read, "He noted the reason the Committee made no recommendation..."

PUBLIC HEARINGS
1. ROBERT LLOYD - REZONE FROM UNCLASSIFIED TO C-3, R-2 & R-2 WITH CUP - APPL. 24-80
00 Mayor Kersey declared the public hearing open on the request of Robert Lloyd to
rezone from Unclassified with a Special Property Use Permit to C-3 (Heavy Commercial)
and R-2 (Single Family) with a Conditional Use Permit for cluster type housing
0 on a parcel of land approximately 80 acres in size located 1300 feet west of the
Q West Valley Highway and south of 15th St. N.W. (Application 24-80) The Planning
Q Commission recommends approval of this request with the following conditions pro-
vided that No. 3 be changed to read as follows: (1) That the approximately 5.4
acres located in the southwest corner of the site be zoned R-1 for single family
detached dwellings. (2) That a 5.5 acre site at the northeast corner of the site
be 7oned.C-3 (Commercial), (3) That the balance of the site be zoned R-2 with a
Conditional Use Permit for cluster type single family dwellings as shown on the
attached overall site plan and that the density not exceed dwelling units per
acre or a total of 440 units, (4) That consideration be given to any requirements
of the Public Works and Fire Departments.
' Tom Barghausen, Cavness Engineers, representing Mr. Lloyd, gave the history of the
15 years of development of the property. He noted in September, 1980 the Council
approved a Master Grading Plan and issued a Grading Permit for five years. He
said what was before the Council tonight was the final step in the preliminary
development process. This request was originally submitted in August, 1980, and
was continued until completion of an Environmental Impact Statement. Barghausen
stated the statement had been completed in accordance with City requirements and
regulations and under the guidance of the City Planning Department. He pointed
out major aspects of the plan using an illustrated site plan. They included a
major street connecting the City of Auburn and Federal Way, a comprehensive storm
water management system, building pads will be separated both horizontally and
vertically from each other and from neighboring property owners, on -site recrea-
tional facilities, office/restaurant building also separated from the residential
area and other industrial developments in the Valley, total of 67% of site area
wouldremain as vegetation and greenbelt area, significant buffer areas against
all neighboring residential areas particularly Aaby Addition, the road was in a
cut which would prevent any visibility from Ashy Addition and a noise buffer,
affordable housing with a particularly good view, good location of development
to work centers, shopping area and public services, lower servicing cost due to
cluster type housing giving lower cost to public and reduced impact on Auburn
public service personnel, and, finally the gravel pit scars would be removed and
useable land will be made available to help ease inflationary pressures on land
values. He added they concurred with the recommendations of the Planning Department
with the exception that they feel the restriction of 6 dwelling units per gross
acre should he applied uniformilyto the subject site. He stated that the public
hearing on the Environmental Impact Statement brought no adverse comments. He
urged the Council to approve the request and to modify the recommendations of the
Planning Commission to allow Mr. Lloyd to develop at a density of 6 units per
gross acre for the entire site based on 78 acres total area less the 5 acres of
commercial or 73 acres net area at R-2 zoning.
It was moved by Flechsig, seconded by Hitchcock, to close the public hearing.

Hitchcock asked Barghausen if he was asking for a total of 440 units. Barghausen
said what he was having trouble with was recommendation No. 3 which said, "That
the balance of the site...". He stated a total of 440 units couldn't be achieved
without taking the entire site area less the commercial.
Hitchcock asked Mr. Schuler for his comments on this request. Schuler replied
their recommendations to the Planning Commission precluded the area in the south-
west corner. He said the reason for this was because they felt they wanted more
control over the corner which would act as a buffer to the single family residential
area next to the development. He stated he felt this could he accomplished by
making this an R-1 zoning. Hitchcock asked Barghausen if what he wanted was R-2
in the southwest corner. Barghausen explained the difference in the R-1 and R-2
is in the density of the remaining portion of the site.
Larson asked if both Schuler and Barghausen were looking at 440 units. Schuler
responded that was what the Planning Commission recommended buthis recommendation
was a little less than that because of the R-1 classification recommended for the
southwest corner. He said he would have no problems in making it all R-2 and spec-
ifying in the Conditional Use Permit that the approximate 5.5 acres in the southwest
corner of the site be plotted with lots not less than 8,000 sq. ft. per lot area.
Craig asked if the cluster housing would be more like condominiums rather than
single family detached housing. Barghausen agreed. Craig said his concern was
that while he agreed with the 6 dwellings per acre someone had taken the roadway
out in the calculations. He stated he agreed with this because if you didn't
exclude some of the area you would be forcing the remaining area to be squeezed
together. He thought it should be decided how many units per acre should be nut
in the development then exclude some of those areas in figuring, the acreage, such
as the commercial area and the area in the southwest corner and even the roadway.
He asked Schuler if that was what his recommendation had been. Schuler said yes
that was his reasoning. Craig added the reason he felt this way was because of
the pecularities of this particular site. Barghausen added to comments saying
the reason for this development being proposed in this manner was because of
the tremendous off -site costs because of the steep elevation, storm drainage
system, roadway, etc. and unless they can have the number of units they're request
it becomes an economic consideration. He said the lesser amount of units put in
the more the unit cost would become and it would be of major concern to them so
they could build affordable housing.
Jim Richardson, Cavness Engineers, stated he had prepared the Environmental Impact
Statement and said it had been done based on 440 units. He noted if thev made
all the exclusions the staff was recommending they still would come out with more
than the 6,000 sq. ft. per dwelling that the R-2 zoning requires. lie said it
would actually come out to about 7,400.
Craig clarified there was no controversy about exclusion of the commercial area.
The R-1 area, however, could be R-2 with a restriction to density in this area by
a CUP. Barghausen said they were requesting an R-2 with a CUP which would incor-
porate the layout in the illustration before the Council. Craig wondered if
there would be a formal plat. Barghausen said very likely their would be a need
for one to dedicate the public roads and plat lots off and possibly to segregate
the rest of the parcel so that portions could be developed individually. He
added if their were condominiums the lots were platted many times after the fact.
Barghausen said the construction plans, improvement plans and building plans which
would have to conform with minor variances to the site plan before the Council.
The single family area in the southwest corner would have to be platted and come
again before the Council.
Craig asked Schuler for further comments on his thoughts. Schuler said in doing
some rough calculations he came up with around 400 units if the southwest corner
was R-2.
It was moved by Hitchcock, seconded by Flechsig, to approve the request of Robert
Lloyd to rezone from Unclassified with a SPU to C-3 and R-2 with a CUP for cluster
housing, Application 24-80, and to instruct the City Attorney to draw up the
necessary ordinance to include the recommendations of the Planning Commission
with the modification of Item No. 1 to R-2 zoning with a restriction of one dwelling
unit per 8,000 sq. feet, and, further, the Conditional Use Permit to expire at
the same time as the Gravel Removal Permit.

Planning Commission recommendation No. 3 to read, (3) That the density on R-2
zoning not exceed six dwelling units per acre.

2. ROBERT LLOYD - REZONE FROM UNCLASSIFIED TO C-3 - APPLICATION 45-80
Mayor Kersey declared the public hearing open on the request of Robert R. Lloyd
to rezone from Unclassified to C-3 (Heavy Commercial) a parcel of land approximately
2 acres in size lying on the north side of Auburn Black Diamond Road AKA 10526
Auburn -Black Diamond Road. The Planning Commission recommends approval of this
request because it is an existing business and will conform to our Comprehensive
Land Use Plan. The owner should be advised that there is no water mains or
sanitary sewers available to serve this property and any further development
of the site will be subject to the requirements of the Public Works and Fire
Departments.

Attorney be instructed to draw up the necessary ordinance to include the recom-
mendations of the Public Works and Fire Departments.

3. D-L ENTERPRISES - REZONE FROM R-2 TO R-3 - "M" STREET N.E. - APPLICATION 8-81
Mayor Kersey declared the public hearing open on the request of D-L Enterprises
to rezone from R-2 (Single Family) to R-3 (Duplex) a parcel of land 1.47 acres
in size lying on the east side of "M" St. S.E. in the 3300 block. The Planning
Commission recommends approval of rezoning from R-2 to R-3 the south 1/2 of this
property which is located on the south side of 33rd St. S.E. as designated on
Alternate Plan "B" for the extension of 33rd St. S.E. through the middle of the
property. Consideration should be given to any other requirements of the Public
Works Department.
Jack Ewing, 622 S. Central., Kent, representing D-L Enterprises, was in the audience
to answer any questions. No on else spoke for or against the request.
It was moved by Larson, seconded by Flechsig, to close the public hearing.

4. G. VUKICH EXECUTOR OF ESTATE OF GEORGE HOLT - REZONE FROM M-1 & R-2 TO R-4 - APPL

Mayor Kersey declared the public hearing open on the request of G. Vukich Executor
of the Estate of George Holt to rezone from M-1 (heavy Industrial) and R-2 (Single
Family) to R-4 (Multi -Family) a parcel of land 8.35 acres in size lying between
17th and 21st St. S.E. in the 400 block. The Planning Commission recommends approval
of this request because it will bring the area into conformance with our Compre-
hensive Land Use Plan and will not be detrimental to the surrounding planned or

existing non-residential uses. Consideration should be given to any requirements
of the Public Works Department.
Gwen Vukich, 15626 S.E. 352nd, was in the audience to answer any questions. No
one else spoke for or against the request.
It was moved by Hitchcock, seconded by Larson, to close the public hearing.

Craig wondered about the manner in which access to 17th and 21st St. should be
provided. He wanted to let the applicant know they would have to deal with it.
Ms. Vukich stated that portion of the land would not be sold.
It was moved by Craig, seconded by Larson, to approve the request of G. Vukich
Executor of the Estate of George Holt to rezone from M-1 and R-2 to R-4, Applica-
tion 11-81, and that the City Attorney be instructed to draw up the necessary
ordinance to include the recommendations of the Planning Commission and Public
Works Department.

5. DONALD H. MYERS - REZONE FROM R-2 to R-3 - 22ND & "M" N.E. - APPLICATION 12-81
Mayor Kersey declared the public hearing open on the request of Donald H. Myers
to rezone from R-2 (Single Family) to R-3 (Duplex) a parcel of land 9,618 sq. ft.
in size located at the southwest corner of 22nd St. N.E. and "M" St. N.E. The
Planning Commission recommends approval of this request because it conforms to
the intent of our Comprehensive Plan and because it is located at the corner of
two major collector streets. It also would act as a buffer and not be detrimental
to adjoining single family uses. Consideration should be given to any requirements
of the Public Works Department.
Tom C. Ralph Fleming, realtor, 43025 196th S.E., Enumclaw, representing Mrs. Myers,
stated Mrs. Myers was in the audience and that they concurred with the Planning I
Commission recommendations. No one else spoke for or against the request.
It was moved by Hitchcock, seconded by Larson, that the public hearing be closed.
MOTION CARRIED.
It was moved by Hitchcock, seconded by Kitchell, to approve the request of Donald
H. Myers to rezone from R-2 to R-3, Application 3.2-81, and the City Attorney be
instructed to draw up the necessary ordinance to include the recommendations of
the Planning Commission.

6. DAVID ENGLISH - REZONE FROM R-4 TO C-1 - 11 3RD ST N.E. - APPLICATION 13-81
Mayor Kersey declared the public hearing open on the request of David English, M.D.
to rezone from R-4 (Multi -Family) to C-1 (Light Commercial) a parcel of land
5,000 sq. ft. in size located at the northwest corner of 3rd and "A" St. N.E.
AKA 11 3rd St. N.E. The Planning Commission recommends approval of this request
because it does conform to our Comprehensive Land Use Plan and will be compatible
with other existing and planned service facilities in the area. Consideration
should be given to any requirements of the Public Works Department.
No one in the audience spoke for or against the request. It was moved by Larson,
seconded by Flechsig, to close the public hearing,.

It was moved by Larson, seconded by Roegner, that the request of David English
to rezone from R-4 to C-1, Application 13-81, be approved and the City Attorney
be instructed to draw up the necessary ordinance to include the recommendations
of the Planning Commission.

7. G. L. HONEYSETT - REZONE FROM R-4 to R-M - 4TH ST. N.E. - APPLICATION 14-81
Mayor Kersey declared the public hearing open on the request of G. L. Honeysett
to rezone from R-4 (Multi -Family) to R-M (Multi -Family Higher Density) for a.
parcel of land 9660 sq. ft. in size lying on the north side of 4th St. N.E.
in the 500 block. The Planning Commission recommends approval of this request
for an R-M (Multi Family Higher Density) zoning classification because it is
adjacent to commercial and transportation modes and conforms to the elements
of both our Comprehensive Plan and the Comprehensive Land Use Plan. Considera-
tion should also be given to any requirements of the Public Works Department
and the Fire Department.
C. L. Honeysett, 11715 S. E. 320th, Auburn, was in the audience to answer any
questions. No one else spoke for or against the request.
It was moved by Larson, seconded by Hitchcock, to close the public hearing.

Craig expressed concern about going from a high to a higher density. He wondered
about the parking. Schuler explained they would have to provide off-street

8. N.A.N. PARTNERS - CUP FOR CLUSTER HOUSING - 29TH ST. S.E. - APPLICATION 15-81 &
P-6-81
' Mayor Kersey declared the public hearing open on the request of N.A.N. Partners
for a Conditional Use Permit for a cluster type housing development on property
zoned R-4 (Multi -Family) and for the approval of a preliminary plat to be known
as the Skylark Addition on a parcel of land 12.4 acres in size located on the
south side of 29th St. S.E. in the 600-700 blocks. The Planning Commission
recommends apppoval of this request provided the applicant meets with the Public
Works and the Planning Departments to work out the street requirements prior to
its submittal to the City Council. Consideration should be given to the require-
ments of the Public Works Department.
No one in the audience spoke for or against the request. It was moved by Hitchcock,
seconded by Larson, to close the public hearing.
It was moved by Roegner, seconded by Larson, to refer the request to the Street
Committee for their review and recommendations to the Council at its June 15, 1981,
meeting.

9. TRANS-CANADA ENTERPRISES - CEDAR DOWNS SOUTH PRELIMINARY PLAT - APPLICATION P-7-81
Mayor Kersey declared the public hearing open on the request of Trans -Canada
Enterprises, Ltd, for approval of a preliminary plat to be known as Cedar Downs
South on a parcel of land 69 acres in size zoned R-T (Residential Mobile Home
Subdivision) located on the south side of Stuck River Drive approximately one-
half mile east of "R" St. S.E. The Planning Commission recommends approval of
the preliminary plat subject to the following conditions: (1) The minimum lot
size shall be 6,000 sq. ft. in area with a 60 foot width on the front building
line. On those lots on curves and cul-de-sacs with less than 60 feet width on
the street property line, the front building line shall be shown on the final plat
where a 60 foot width can be established, (2) The right of way on Road "E",
"F" and "G" shall be not less than 50 feet unless a variance is obtained from
the Street Committee and that cul-de-sacs shall be installed at the end of each
street, (3) A typical roadway cross-section shall be shown, (4) A release or
other document shall be obtained showing what uses will be allowed within the
power line easements, (5) Consideration shall be given to any requirements of

the Public Works Department, (6) This approval shall be for a two year period.
Dave Millard, Land Planning & Management, 22627 152nd S.E., Kent, representing
Trans -Canada Enterpries, Ltd., noted the items completed to date on this project
were: Boundary survey, topo survey, rezone approved, EIS circulated, Substantial
Development Permit application filed with Shoreline Management, Flood Control
Zone Permit application .filed, Stuck River improvements plans completed, Sewer
Comprehensive Plan complete, Water Comprehensive Plan complete, sewer L.I.D.
in formation, dry well at Lakeland Hills is scheduled .for delivery in a week,
water L.I.D. is in formation, test well to be drilled sometime in the near future
He said they have also provided a substantial amount of open space as part of
the Cedar Downs rezone.
Richard Reich, 39015 172nd Ave. S.E.,attdrneyfor the Muckleshoot Indian Tribe,
stated they opposed the approval of the plat. He submitted a copy of the Planning
Commission meeting minutes of May 5, 1981, of the hearing with a few minor changes
in the transcript to reflect more correctly his comments at that time. IIe said
his comments remain the same and asked the Council to consider those remarks.
Reich said in the Council making its decision tonight it should consider four
questions: (1) Does the preliminary plat comply with the requirements of the
City's zoning ordinance and Subdivision ordinance, (2) Does the plat and accompanying
materials comply with RCW 58.17 the State Subdivision I.aw, (3) Does the plat
make appropriate provisions for public health, safety, general welfare including,
provisions for open space, drainage ways, streets, alleys and other public ways,
water supplies, sanitary wastes, parks, playgrounds and school sites, (4) Is
public use and interest served by the proposed subdivision. His comments on
these questions were: (1) The proposed plat does not comply with the requirements
of the City zoning or subdivision ordinance, for example numerous lots do not
contain the required minimum 6,000 sq. foot area. He disagreed with Mr. Schuler's com-
ments that this and other discrepancies can be worked out at some future date before
approval of the final plat. He referred the Council to Loveless va Yantis cited by
the Washington Supreme Court in 1973 and quotedmaterial. therein. He added the
discrepancies in the preliminary plat should be cleared up now and not left to
the City Planning Department as the Council would not have a chance to review
what the preliminary plat was. He felt at the time it gets to the final plat stag
determining if public use and interest was met was extremely limited, (2) The plat
and the accompanying materials do not comply with RC117 58.17.120 or 58.17.150.
RCW 58.17.120 provides no plat shall be approved covering any land situated in
a flood control zone without the prior written approval from the Department of
Ecology, State'of Washington. He noted the permit had been applied for but it
had not been issued and there wasno prior written approval of record from the
Department of Ecology. He added 58.17.150 provides each preliminary plat submitted
for final approval shall be accompanied by the following agencies recommendations
for approval or disapproval; local health department, local planning agency or
commission and city engineer. He said there was a written recommendation from
the Planning Commission but there wasnone•for the local health agency or the ctiy
engineer. He noted the City Engineer had given some comments on whether utilities
were available or not but there wasno written recommendation on approval or dis-
approval, (3) & (4) The Council wascharged under RCW 58.17.110 in determining
whether the plat makes adequate provision for roads, utilities and other elements
necessary for responsible, well -planned development. Reich submitted to the
Council that the preliminary plat before the Council did not have adequate infor-
mation for a determination whether or not there was adequate provisionsfor public
utilities, public ways, public schools and other requirements. He felt the Council
should not leave these determinations up to staff;that it was a legislative deter-
mination.
It was moved by Craig, seconded by Larson, to close the public hearing.

It was moved by Craig, seconded, by Roegner, that the request of Trans -Canada
Enterprises, Ltd. for the preliminary plat of Cedar Downs South be approved with
the recommendations of the Planning Commission and Public Works Department and
further that the time limit on this plat be limited to two years.
ROLL CALL VOTE: Councilmembers Craig, Larson, Hitchcock, Roegner and
Kitchell voted YES. Councilmember Flechsig voted NO.

It was moved by Roegner, seconded by Hitchcock, to approve the request of D. M. Young
Contructions Co., Inc., for approval of a preliminary plat known as Riverpark Addition,
Application P-4-81, to include the stipulation of 32 foot on loop road and 30 feet on
