Flag Salute The regular meeting of the City of Auburn Council was called to order by Mayor Bob Roegner at 8:00 p.m. in the City of Auburn Council Chambers. Mayor Roegner led those in atten- dance in the pledge of allegiance. B. Roll Call Those in attendance included Mayor Bob Roegner; Council - members Colburn, Craig, Hitchcock, Kurle, Larson, Lea and Wisner; and staff members Jack Bereiter, City Attorney; Len Chapman, Parks & Recreation Director; Dan Clements, Finance Director; Pat Dugan, Planning Director; Jim Gibson, Police Chief; Bob Johnson, Fire Chief; Coralee McConnehey, City Clerk; Pat Nevins, Public Works Director. Also in atten- dance was staff member Steve Lancaster. C. Mayor's Announcements and Appointments Mt. Rainier Vista Rezone Veto Mayor Roegner asked if the Council had no objections in discussing the Mt. Rainier Vista Rezone at this time of the meeting. None of the Council obiected. Mayor Roegner noted in his veto letter he explained his reasons for the veto. Wisner suggested the matter be referred back to the Planning Commission. Craig wondered if the six month waiting period could be waived. Bereiter indicated the Council could do SO. Hitchcock suggested the Council waive the six months and refer it back to the planning staff. Bereiter indicated this could possibly create a conflict in the appearance of fairness doctrine. He suggested the appropriate way was as Mrs. Wisner suggested, to override the veto or no action. MOTION by Wisner, SECOND by Hitchcock, to refer the Mt. Rainier Vista rezone back to the Planning Commission for consideration of alternatives and that the City waive the six month waiting period. MOTION CARRIED UNANIMOUSLY. D. Agenda Modifications - Modifications included agenda bill for public hearing on Final Assessment Roll for L.I.D. 308 and four Consent Agenda items. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE II. A. Public Hearings Final Assessment Roll of L.I.D. 308, construction of curb and gutter, asphalt paving, storm drainage, street lighting and sanitary sewer on "E" Street N.E. between 16th and 18th Street N.E. -1- 1 1 J AUBURN COUNCIL MINUTES PAGE TWO AUGUST 15, 1983 II. A. Public Hearings - L.I.D. 308 Final Assessment Roll (Cont.) No one spoke for or against the final roll. Mayor Roegner noted the hearing had been properly advertised and property owners were notified of the hearing by certified mail. MOTION by Larson, SECOND by Hitchcock, to close public hearing. MOTION CARRIED UNANIMOUSLY. MOTION by Craig, SECOND by Larson, to accept the Final Assessment Roll for L.I.D. 308 and instruct the City Attorney to draw up the necessary ordinance. MOTION CARRIED UNANIMOUSLY. B. Audience Participation Mt. Rainier Vista Rezone - Marion Glasser, 1611. 22nd Street S.E., expressed her opposition to the rezone. She felt if she lived out in the area she wouldn't want apartments. Sue Peters, 3190 53rd Street S.E., wondered if the elected officials were supporting the citizens or developers. C. CONSENT AGENDA (CONT.) D. Call for Public Hearin (Cont.) cent to the Auburn Municipal Airport consisting of approximately 96 acres. Also a rezone from M-2 to M-1 on a portion of the project site. (35-81) E. Bid Award on Sanitary Sewer Imp. #55 to Frank Coluccio Const. Co. on their low bid of $211,990.01 including sales tax on Basic Bid plus Schedule "A". F. Bid Award on Street Improvement 252 and 254, various street improvements and overlays to M. A. Segale, Inc. on their low bid of $109,279.26. G. Change Order No. 3 - Contruction of. Lea Hill Reservoir, Water Improvement No. 140, no cost change order to extend contract time from August 14, 1983, to September 7, 1983, for Pacific Tank and Construction Corporation. H. Utility Adjustments 1. Account No. 349-0630, Maple Lanes Apts., 126 R Street S.E. in the amount of. $259.62 due to bad water leak. 2. Account No. 323-1.60, Auburn Court Apts., 100 Auburn Way South in the amount of $2,522.26 due to a very back leak between meter and apartment buildings. MOTION by Craig, SECOND by Larson, to approve Consent Agenda Items A through H. MOTION CARRIED UNANIMOUSLY. OLD BUSINESS V. A. Ordinance 3892 - Adopts State DWI Statute by Reference. MOTION by Hitchcock, SECOND by Colburn, to introduce and adopt Ordinance 3892. MOTION CARRIED UNANIMOUSLY. B. L.I.D. 325 - Final Assessment Roll - Bereiter indicated the property owner who had questioned the assessment was working with the title company. MOTION by Craig, SECOND by Larson, to approve the Final. Assessment Roll for L.I.D. 325 and instruct the City Attorney to draw up the necessary ordi- nance. MOTION CARRIED UNANIMOUSLY. NEW BUSINESS VI. A. Revise Zoning Action Procedures. MOTION by Wisner, SECOND by Craig, to direct staff to schedule all rezone and con- ditional use permit applications for public hearing at the next regular Council meeting following the Planning Commission meeting at which the recommendation of the Planning Commission is approved for the application. MOTION CARRIED UNANIMOUSLY. B. Ordinances and Resolutions 1. Ordinance 3896 - Irene Woodroffe Rezone from R-2 to C-1 at 912 Harvey Road. MOTION by Wisner, SECOND by Craig, to introduce and adopt Ordinance 3896. MOTION CARRIED UNANIMOUSLY. 2. Ordinance 3897 - Bible Baptist Church Rezone with Conditional Use Permit on Auburn Way South in the 1.400 block. MOTION by Wisner, SECOND by Craig, to introduce and adopt Ordinance 3897. MOTION CARRIED UNANIMOUSLY. 3. Ordinance 3898 - Approves and Confirms Local. Improvement District 330. MOTION by Craig, SECOND by Larson, to introduce and adopt Ordinance 3898. MOTION CARRIED UNANIMOUSLY. 4. Ordinance 3899 - Adds new section on Increases and Decreases on Arterials. MOTION by Lea, SECOND by Hitchcock, to introduce and adopt Ordinance 3899. The Mayor noted he had sent his recommendations on Fireworks to the Public Safety Committee for their review. EXECUTIVE SESSION & ADJOURNMENT VIII. EXECUTIVE SESSION & ADJOURNMENT - The meeting was adjourned to an executive session to discuss matters of personnel and possible litigation at 8:51 p.m. -4- C Coralee McConnehey, City Clerk
