CITY COUNCIL MEETING MINUTES
May 15, 1989 7:30 p.m.
� I. CALL TO ORDER
The regular meeting of the City of Auburn Council was called to order by Mayor
Bob Roegner at 730 p.m. in the City of Auburn Council Chambers.
A. Flae Salute
Mayor Roegner led those in attendance in the piedge of allegiance.
B. Roll II
Those in attendance include Mayor Bob Roegner and Councilmembers
Whittall, Walt�rs, Burns, Larson, Roland, Brothers, and Kurle. Staff
members in attendance include Police Chief Jake Evans, Police Captain Bill
Pitzl, Fire Chief Bob Johnson, Fire Marshal Wayne Senter, Personnel
Director Gretel Sloan, Parks & Recreation Director Len Chapman, Finance
Direcror Pat Dugan, Public Works Director Frank Currie, Building Official
Alice Conrad, Planning Director Mary McCumber, Senior Planner Lynn
Rued, Planner Greg Fewins, City Attorney Marguerite Schellentrager, and
City Clerk Robin Wohlhueter.
C. Announcements and Aonointments
Announcements
Certificate of Commendation
' On behalf of the City of Auburn, Police Chief Jake Evans honored
citizen Johnnie K. Anderson by describing his heroic actions on
February 25, 1989 in stopping a runaway vehicle with a tliree year old
boy inside. Chief Evans stated the child, alone in the car, mistakenly
nudged the automatic shift into gear. The car rolled towards a parked
vehicle and [he gas pumps at Tony's gas station. Mr. Anderson
successfully stopped the rolling car preventing considerable property
damage, and saving the young boy's life.
Mayor Roegner presented a Certificate of Commendation to Johnnie
K. Anderson, and along with the Council extended praise to him for
his heroic action.
Proclamations
Mayor Roegner presented Personnel Analyst Ruth Moore with a
proclamation proclaiming May 19, 1989 as "Employee Fitness Day."

Motion by Counciimember Larson, second by Councilmember Kurle ro
confirm the appointments of Mayor Roegner, Councilmember Larson,
Counciimember Whittall, and alternate Councilmember Walters as
voting delegates for the Association of Washington Cities convention
being held in Spokane on June i2th through June 17, 1989.
MOTION CARRIED UNANIMOUSLY. 7-0.

III. COUNCIL COMMITTEE REPORT�S
A. Municioai Services
Chairman Whittall reported the Municipal Services Committee has not met
since the fast Council meeting. The next Municipal Services Committee
meeting will be May 25, 1989 at 5:30 p.m.
B. PlanninR & Communitv Develoument
Chairman Burns stated the Planning & Community Development Committee
met on May 9, 1989 and the minutes are of public record. The next meeting
will be May 23, 1989 at 7:30 p.m.
C. Public Works
Chairman Kurle reported the Public Works Committee met prior to the
Council meeting this evening at 530 p.m. The minutes of the May l, 1989
meeting are of public record. The next meeting of the Public Works
Committee is scheduled for June 5, 1989, at 5:30 p.m.
D. Finan
Vice-Chairman Whittall stated the Finance Committee met prior to the
Council meeting tonight. The next Finance Committee meeting will be prior
to the regular Council meeting on June 5, 1989 at 7:00 p.m.

Recommend Council approval of bid award on Contract 88-21 to RT

V. OLD BUSINESS - None.
A. Ao�lication No. 56A-89
An amendment to the Auburn Zoning Code which addresses the recreational
vehides being used as living units in the RMHP (Residential Manufacrored
Home Park District).
Mayor Roegner announced that copies of the May l, 1989 regular Council
meeting tapes are currently available. The Councilmembers who were not in
attendance at the May 1, 1989 were provided with a tape recording of the
regular Council meeting to assist them in their deliberations.
Prior to Council deliberations Mayor Roegner requested a brief update Prom
Public Works Director Frank Currie.
Frank Currie commented on the issues raised during the public hearing
process which centered around whether or not R.V.'s are constructed for
permanent living units. Discussion centered around standards for
construction of stick built homes, mobile homes, and recreation vehicles.
State of Washington determines the certification requirements for mobile
homes and recreation vehides. Mc Currie stated R.V.'s are not certified

the State of Washington as living units, but are considered temporary m
namre, and certified for seasonal use. Mr. Currie noted recreational vehicles
are not required to have a bathroom, kitchen, and insulation.
Senior Planner Lynn Rued directed the Council's attention to an aerial photo
dated February 17, 1959 illustrating Skylark Mobile home park with twenty-
five mobile homes on the original site. Briefty, Lynn Rued explained that in
1958 Skylark Mobile Home Park was annexed into the City of Auburn, and
further explained the arrangement of mobile homes at that time taking into
consideration the concern ot' grandfathering status. In regards to
grandfathering or existing recreational vehicles being allowed in the mobile
home park, they are a non-conforming use, and have been for at least
fifteen years. They do not conform to the standards of the City's zoning
ordinance. Non-conforming uses are not meant to be perpetual uses. In
looking at the photo there appears to be about five mobile homes that exceed
the length of fifty feet, approximatety seven between forry and fifty feet,

ten between thirty and forty feet, and three (ess than thirty feet. Lynn
Rued concluded that Skylark Mobile Home Park apparently started out as
mobile home park rather than a recreational vehicle park.
Lynn Rued pointed out that when recreational vehicles have to leave the
park, they will be repiaced by manufactured homes which can be a
minimum size of 400 square feet and meet HUD's, the State's & City's
standards for mobile homes. Directing his comments around development
' standards required by the City, Lynn Rued discussed current sizes of mobile
homes, and minimum reqairements for placement of mobile homes within
the park.
in concluding his comments, Mr. Rued reiterated that with adoption of
Ordinance No. 4350 current residents residing in recreational vehicles do not
have ro leave. There are amortization regulations included in the ordinance.
The Council centered their discussion around enforcement of the proposed
ordinance and its regulations, liability exposures the City could face, whether
or not recreational vehicles are safe to live in, and meeting consistency with
the zoning code.
Marguerite Schellentrager responded to concerns raised by the Council. Ms.
Schellentrager emphasized that the main problem in allowing recreational
vehicles to stay in Skylark Mobile Home Park is that it is inconsistent with
the zoning code. Ms. Schellentrager pointed outif the City did not adopt
Ordinance No. 4350, the City would enforce the current codes and
recreational vehicle residents could be subject to eviction from Skylark
Mobile Home Park. By adopting Ordinance No. 4350, Ms. Schellentrager
stated, the City is allowing for a gradual phase out of the non-conforming
use, and current recreational vehicle residents can remain at the park for as
long as they like. This amortization is a reasonable solution to the non-
conforming use.
, Councilmember Burns summarized the proceeding with regard to the public
hearings that have been held on this issue, and recommended the City not
continue to allow Skylark Mobile Home Park continued benefit from an
illegal use.
Motion by Councilmember Burns, second by Councilmember Walters to
amend the Zoning Ordinance to allow existing recreation vehicles within
mobile home parks and to adopt the ordinance as prepared by the City
Attorney.
MOTION CARRIED. 6-1 with Councilmember Kurle voting no.
Ordinance No. 4350
An Ordinance of the City of Auburn, Washington, amending certain sections
of the Auburn City Zoning Ordinance No. 4229, codified as Title 18 and
providing an amortization of recreational vehicles as a non-conforming use
in mobile home parks.

introduce and adopt Ordinance No. 4350.

VI. NEW BUSINESS
A. Av�lication No. PLT0033-87
The request of Wili Palmer for final plat approval for a 12 lot single family '
piat to be known as "Dos Rio" subdivision located between 28th and 29th
Streets S.E. in the 800 block.
Motion by Councilmember Burns, second by Councilmember Walters to
approve the final plat of the "Dos Rio" subdivision and to instruct the City
Attorney to prepare the necessary ordinance.
MO'rION CARRIED. 6-I with Councilmember Kurle voting no.
B. Avnlication No 58A-89
Council consideration on the proposed Environmental Review Procedures,
Environmental Policy Ordinance, and Comprehensive Plan amendments.
Motion by Councilmember Burns, second by Councilmember Walters to
approve the Environmental Review Procedures and Environmental Policy
Ordinance and Comprehensive Plan amendments, and instruct the City
Attorney to prepare the necessary Ordinance and Resolution for adoption.
MOTION CARRIED UNANIMOUSLY. 7-0.
VII. ORDINANCfiS AND RESOLUTIONS

An Ordinance of the City of Auburn, Washington, approving a
recreation fee schedule and rental charges for programs and facilities
provided by the Auburn Parks and Recreation.
Motion by Councilmember Burns, second by Counciimember Walters ro
introduce and adopt Ordinance No. 4348.
MOTION CARRIED UNANIMOUSLY. 7-0.
2. Ordinance No. 4349
An Ordinance of the City of Auburn, Washington, providing for a
Conditional Use Permit to atlow for a daycare center located on the
northwest corner of 37th and "M" Streets S.E., within the City of
Auburn.
Motion by Councilmember Burns, second by Councilmember Walters ro
introduce and adopt Ordinance No. 4349.

taken on Ordinance No. 4350.
Resolutions

A Resolution of the City Council of the City of Auburn, Washington,
authorizing the Mayor to execute a memorandum of understanding
between King County Retired Senior Volunteer Program and the City
of Auburn, for the purpose of volunteer recruitment at the Auburn
Senior Center.
Motion by Councilmember Burns, second by Councilmember Kurle to
adopt Resolution No. 1963 authorizing the Mayor to execute a
Memorandum of Understanding between King County Retired Senior
Volunteer Program and the City of Auburn.
MOTION CARRIED UNANIMOUSLY. 7-0.
2. Resolution No. 1966
A Resolution of the City Council of the City of Auburn, Washington,
authorizing the Mayor and City Clerk to execute Addendum I to the
lease agreement between the City of Auburn and Valley Cities Mental
Health Center for the purpose of of extending the originallease term
' and to extend the lien on the property in favor of the City of Auburn.
Motion by Councilmember Burns, second by Councilmember Walters to
approve Resolution No. 1966 authorizing the Mayor and City Clerk to
sign the addendum to the lease agreement with Valley Cities Mental
Health Center dated September 5, 1985, for the property located at 602
West Main in the amount of $18,500.
MOTION CARRIED UNANIMOUSLY. 7-0.
3. Resolution No. 1967
A Resolution of the City Council of the Ciry of Auburn, Washingron,
authorizing the Mayor to execute Addendum I to lease agreement
between the City of Auburn and Children's Home Society for the
purpose of extending the original lease term and to extend the Iien on
the property in favor of the City of Auburn.
Motion by Councilmember Burns, second by Councilmember Kur(e to
approve Resolution No. 1967 authorizing the Mayor and City Clerk to

Society dated May I, 1986 for the property located at 4338 Auburn
Way North in the amount of $18,720. .

4. Resolution No. 1968
A Resolution of the Ciry Council of the City of Auburn, Washington,
authorizing the Mayor and City Clerk to execute an agreement for
artwork between the City and Tom Teitge for the purpose of designing
and creating a mural in commemoration of the I989 Washington State
Centennial in Auburn.
Motion by Councilmember Burns, second by Councilmember Walters to
adopt Resolution No. 1968.
MOTION CARRIED UNANIMOUSLY. 7-0.
5. Resolution No. 1971
A Resolution of the City Council of the City of Auburn, Washington,
approving the preliminary plat of Marycon Division No. 1 located on
the south side of 12th Street S.E.in the 500 block, within the City of
Auburn, Washington.\
Motion by Councilmember Burns, second by Councilmember Kurle to
adopt Resolution No. 1971.
MOTION CARRIED UNANIMOUSLY. 7-0.
