CITY COUNCIL MEETING MINUTES
August 7, 1989 730 p.m.
' I. CALL TO ORDER
The regular meeting of the City of Auburn Council was called to order by Mayor
Bob Roegner at 730 p.m. in the City of Auburn Council Chambers.
A. Flaa Salute
Mayor Roegner led those in attendance in the pledge of allegiance.
B. Roll 11
Those in attendance include Mayor Bob Roegner and Councilmembers
Walters, Burns, Larson, Roland, Brothers, and Kurle. Councilmember
Whittali is excused. Staff inembers in attendance include Police Chief Jake
Evans, Fire Chief Bob Johnson, Personnel Director Gre[el Sloan, Parks &
Recreation Director Len Chapman, Finance Director Pat Dugan, Public
Works Director Frank Currie, Planning Director Mary McCumber, Senior
Planner Lynn Rued, Ciry Attorney Marguerite Schellentrager, Deputy City
Clerk Gayle Butcher, and City Clerk Robin Wohlhueter.

Confirmation of Linley Burnsworth to a vacant seat whose term
expires l2/31/90.

Confirmation of Iva DuBey to a vacant seat whose term expires
12/31/90.
Motion by Councilmember Larson, second by Councilmember Kurle to
confirm the appointments of Linley Burnsworth to the Planning
Commission, and Iva DuBey to the Human Resources Committee for
terms to expire on December 31, 1990.
MOTION CARRIED UNANIMOUSLY. 6-0.

A. Public Hearinas
I. REZ0004-89
7'he request of Simon Development Co., Inc. to rezone from R-MHP
ro R-4 together wi[h a Comprehensive Plan Map amendment from
moderate to high density residential on property located on the
northeasterly side of Auburn Way South in the 3900 block containing
approximately 6 acres.
Prior opening the public hearing, Councilmember Roland reported that
Simon Development Company has made an offer on property she
owns, and therefore, would abstain in receiving testimony or acting
upon Application No. REZ0004-89. Councilmember Itoland left the
Councit Chambers.
Mary McCumber addressed the Council on the issues of Application
No. REZ0004-89 as it relates to the procedures. Mary McCumber
stated the action before the Council is an application for a proposed
rezone and a Comprehensive plan Map Amendment on approximately
six acres at 3900 Auburn Way South. Staf£ and Planning Commission
are recommending denial based on the City's plans and policies. The
SEPA process is not complete. Ms. McCumber noted that if the
Council wants to consider R-3 zoning then Application No. REZ0004-
89 would be held over a"Old Business and the SEPA process
completed. Application No. REZ0004-89 would be held over as "Old
Business".
Mayor Roegner opened the public hearing.
Roeer Blavlock l0717 NE 4th Street, Suite 9, Bellevue, WA 98004
Roger Blaylock, Land Use Consultant, prepared the application to the
City of Auburn for the proposed rezone. Mr. Blaylock briefly
described his background in local land use government issues. Mr.
Blaylock presented a slide presentation [o give the Council a view of
the style of developing an apartment complex.
Steve Demarest - 818 South Yakima, Tacoma, WA 98404
Steve Demarest, Attorney representing Dan Simon and John Lewis,
addressed specific comprehensive plan and land use issues. Beginning
his comments with a diagram for the Council of the rezone application
process showing the non-SEPA issues, SEPA issue, slope protection,
and outlined options available for the Council.
Mr. Demarest directed the Council's attention to three display boards.

board illustrates adjoining land uses and zoning; and the third display
board denotes the the overall site of the proposed rezone area.
Mr. Demarest presented arguments, and emphasized the need for the
R-4 zone. As an alternative to the proposed R-4 zone, Mr. Demarest
suggested the Council consider a R-3 zone which could allow multiple
family, and with a Conditional Use Permit would permit six to ten
' units per acre. The R-3 zone implements the moderate density
residential map designation.
Mr. Demarest concluded his comments by stating the proposed
development is within the plan and policies of the City, and handed
the Council a proposed motion to consider.
Motion by Councilmember Burns, second by Councilmember Walters to
close the public hearing.
MOTION CARRIED UNANIMOUSLY. 5-0.
Mayor Roegner asked for questions from the members of the Council.
Some of the Council expressed concern regarding density requirements
in developing the proposed rezone property as it reiates to the
consistency of the Comprehensive Plan and policies. The Council
questioned the staff in calculating the number of units on the proposed
rezone property, and whether or not the undevelopable steep slope
portion of the property was included.
Staff responded that the Comprehensive Plan is silent on the issue of
whether or not the City can include an undevelopable area in
calculating density requirements for development.
' Mary McCumber indicated scaff would be looking at the issue of
actual lot size development within a development in determining
density requirements for environmentally sensitive lands as part of the
Urban Design Plan.
Staff also indicated that a rezone to R-3 may be possible in that it
would implement the moderate density designation of the
Comprehensive Plan.
Motion by Councilmember Burns, second by Councilmember Walters to
not approve the Comprehensive Plan Map Amendment and the rezone
based upon the Findings of Fact and Conclusions as ouUined, and to
instruct the City Attorney to prepare the necessary Ordinance.
MOTION CARRIED UNANIMOUSLY. 5-0.
Councilmember Roland returned to the Council Chambers.

❑1. COUNCIL COMMITTEE REPORT'S
A. Municioal Services
Vice-Chairman Brothers reported the Municipal Services Committee met
July 27, 1989 and the minutes are public record. At its meeting, the
Municipal Services discussed Resolution 1991, Police vehicte replacement,
and out-of-state travel. Vice-Chairman Brothers noted that OCficer Quimby
is recovering. The next Municipal Services Committee meeting will be
August 17, 1989 at 5:30 p.m. A tour of Valley Communications facility is
scheduled.
B. Plannina & Communitv Develooment
Chairman Burns stated the Planning & Community Development Committee
met on July 25, 1989 and the minutes are of public record. The meeting of
the Planning & Community Development Committee is scheduled for
Tuesday, August I5, 1989 at 7:30 p.m
C. Public Works
Chairman Kurle reported the Public Works Committee met prior to the
Council meeting this evening at 530 p.m. The minutes of the August 7,
1989 mee[ing will be of public record upon publication. The Committee
recommends approval of items appearing on tonighYs Agenda. The next
meeting of the Public Works Committee is scheduled for Monday, August
21, 1989 at 530 p.m.
D. Finance
Chairman Walters stated the Finance Committee met prior to the Council
mee[ing tonight. The next Finance Committee meeting will be prior to the
next Council meeting of August 21, 1989 at 7:00 p.m.

City Council to consider the request of Richard T. Wooding for a
preliminary plat of an 8-lot single-family subdivision to be known as
"Smalkamish Rim Estates" zoned RR (Rural Residential) to be tocated on the
north end of Foster Ave. S.E.
Motion by Councilmember Burns, second by Councilmember Walters to call
for a public hearing on Appiication No. PLT003-88 for August 21, 1989
regular schedule Council meeting.

Ciry Council to consider the request of John H. Yorke for a preliminary plat
oP an 8-lot single-family division to be known as Yorke Division No. I" to

Motion by Councilmember Burns, second by Councilmember Walters to
approve [he preliminary plat based upon the Hearing Examiner's Findings of

Vll. ORDINANCES AND RESOLUTIONS
A. Ordinances
Ordinance 4355
An Ordinance of the City of Auburn, Washington, authorizing the
Mayor to accept Schedule "A" which relates ro the Ciry of Auburn
1989 Budget reallocation of funds in various accounts in several funds
pursuant to RCW 35A.33.120.
Motion by Councilmember Walters, second by Councilmember Roland
to introduce and adopt Ordinance No. 4355.

2. Ordinance 4359
An Ordinance of the City of Auburn, Washington, amending Chapter
13.04 of the Auburn City Code entitled "Water Service-General
Regulations" by deleting the present subp�ragraph A. of Section
13.04.280 entitled "Service Charges-P�yment Dates," and adding a new
Subparagraph A to provide a specific due date on utility bill payments,
and amending Subparagraph A of Section 13.04.300 entitled "Service
Charges-Payment Delinquency," to conPorm [o the new language in
Section 13.04280 Subparagraph A.

Motion by Couniclmember Walters, second by Councilmember Roland
to introduce and adopt Ordinance 4359 which extends billing dua date
from 10 to 15 days.
MOTION CARRIED UNANIMOUSLY. 6-0.
3. Ordinance 4360
An Ordinance of the City Council of the City of Auburn, Washington,
amending Auburn City Ordinance No. 3711 which enacted Auburn
City Code Section l0.40.035 entitied "Auburn City Employee Parking
Established," in order to change the designation of employee parking to
conform to the actuat parking spaces available.
Motion by Councilmember Kurle, second by Councilmember Burns to
introduce and adopt Ordinance No. 4360.
MOTION CARRIED UNANIMOUSLY. 6-0.
4. Ordinance 4362
An Ordinance of the City Council of the City of Auburn, Washington,
approving an appropriation of Grant Funds in the amount of Five
Hundred Thirty-Three Thousand Three Hundred Seventy-Two Dollars,
($533,372), and authorizing the Mayor to accept the grant from the
Federal Aviation Administretion for Improvements to the Auburn
Municipal Airport.
Motion by Councilmember Kurle, second by Councilmember 8urns to
introduce and adopt Ordinance No. 4362.
MOTION CARRIED UNANIMOUSLY. 6-0.
H. Resolutions ' . , ,
1. Besolution No. 1990 � :
A Resolution of the City Council of the City of Auburn authorizing
the Mayor to execute an egreement between the City of Auburn and
Makers to provide consuttant services for the Downtown Design Master
Plan.
Motion by Councilmember Burns, second by Councilmember Welters to
approve Resolution No. 1990.
MOTION CARRIED UNANIMOUSLY. 6-0.
2. Resolution No. 1991
Resolution of the City Council of the City of Auburn, Washington,
authorizing the Mayor and City Clerk to execute an egreement with
Auburn Youth Resources for support services for youth and femilies in
the Auburn Community.

to serve as travel agent for the Senior Center Fall Foiiage trip.
Motion by Councilmember Burns, second by Councilmember Walters to
