The regular meeting of the City of Auburn Council was called to order by Mayor Bob Roegner at 7:30 p.m. in the City of Aubum Council Chambers. A. Flas Salute . 1Vlayor Roegner led those in attendance in the pledge of allegiance. B. Roll Call Tliose in attendance included Mayor Bob Roegner and Councilmembers Whittall, Wagner, Burns, Barber, and Brothers. Councilmember Larson and Councilmember Kurle were excused. Staff inembers in attendance included Fire Chief Bob Johnson, Parks 8t Recreation Director Len Chapman, Personnel Director Gretel Sloan, Police Captain Bill Pitzl, Finance Director Pat Dugan, Public Works Director Frank Currie, Planning Director Steve Lancaster, City Attorney Stephen Shelton. Other staff in attendance included Senior Planner Lynn Rued, Fire Marshal Wayne Senter, and Deputy City Clerk Gayle Butcher. C. Announcements and Annointments 1. Announcements a. Presentation A1.9 Mayor Roegner presented to Mary Caldwell the Washington Recreation & Parks Association legislative Citation of Merit award for 1991 and expressed his appreciation of her community accomplishments. b. Proclamations ' A1.8 Mayor Roegner read and presented a proclamation to Bill Pitzl proclaming the week of May 24, 1991 through May 31, 1991 as "Law Enforcement Torch Run Week". c. Stuck River Bridpe Oper 4.9.1 Mayor Roegner announced that the Stuck River Bridge had been dedicated Monday, May 13, 1991. Mayor Roegner conveyed his thanks and appreciation for this joint cities project to City of Pacific Mayor Jorgensen and his staff, and to City of Auburn Public Works Director Frank Currie. d. _ Chamber of Coinmerce Recosnitions A5.3.4 CITY OF AUBURN COUNCIL MEETING May 20, 1991 Mayor Roegner announced that Administrative Assistant Jan Hubbard and Public Works Director Frank Currie liad been recognized at today's . Chamber of Commerce meeting for their city beautification efforts; Jan Hubbard for her litter program and Frank Currie for the flower logo planting area at Highway 18 and Aubum Way $outh. ' 2. Public Hearin¢s - None B. Audience Particination 1. n Ei , Presiding Judge of King County Aukeen District Court, King County Court House,. Seattle, WA A1:4.1 • The Honora.ble Judge Eide expressed his concerns on Resolution No. 2202 on this evening's agenda. Judge Eide noted he,was present to answer any questions Councilmembers may have, and he expressed cooperadon by the staff of Aukeen Court should the Council adopt Resolution No. 2202 which authorizes the Mayor of the City of Auburn to terminate the. interlocal agreement with King County for the provision of court services and to prepare an implementation plan for the establishment of the Auburn Municipal CourL Mayor Roegner indicated the Council may present questions under Agenda Item VII.B.2, and thanked Judge Eide for being available to address possible questions from Councilmembers. 2. James Limric, 524 Aaby Drive, Aubum 03.5 PLT0002-89R Mr. Limric addressed this evening's Agenda Item VI.C, the request of Gertrude A. Jones and SunCrest Homes preliminary plat AppGcation No. PLT0002-89R. Mr. Limerick presented Council with conespondence regarding this application and requested Council to hold a public hearing on the preliminary plat June 3,1991 alsa 3. Maris Nickson, 523 Aaby Drive, Auburn 03.5PLT0002-89R Ms. Nickson expressed her concerns regarding the request of Gertrude A. Jones and SunCrest Homes preliminary plat Application No. PLT0002-89R. Corresnondence 03.SPLT0002-89R, A3.23.1, CAP0002-091 Mayor Roegner noted receipt of conespondence,from the Auburn Residents Association dated May. 20, 1991, and received 'from Mr. Limerick this evening under audience participation, regarding Application No. PLT0002-89R and CAP0002-91. III. COUNCIL COMMIITEE REPORTS A3.7.6 A. Municinal Services Chairman Whittall reported the Municipal Services Committee met May 13, 1991 and noted the Municipal Services Committee had reviewed the municipal court study. Chairman Whittall indicated the. Committee was comfortable with and recommending approval of Resolution 2202. Chairman Whittall felt the city should proceed with the Aubum Municipal Court and that any concerns have been adequately addressed. Chairman Whittall requested .City Attorney Stephen Shelton to clazify the jurisdiction level of a municipal vs. district court system. City Attorney Shelton indicated "a municipal and district court were of the same legal level in that the courts had one-yeai amaximum penalty authorizations. Howeyer, felony cases involve longer maximum incarcerations and would remain under the jurisdiction of the county prosecutor. City Attomey Shelton indicated Aukeen Court would continue to conduct preliminary hearings on felony cases. B. Planning & Gommunitv. Develooment Chairman Bums reported the Planning & Community Development Committee met on May 13, 1991 and the minutes are of public record. Chairman Burns requested support of items considered at the last meeting that appear on tonight's agenda.. Chairman Burns, announced that due to the Memorial Day holiday, the next Planning and Community Development Committee will be Tuesday, May 28, 1991. C. Public Works Vice-Chairman Bums reported the Public Works Committee met prior to the Council meeting at 5:30 p.m. He noted Council Agenda Item VII.A.3, Ordinance 4497, will remain in Public Works Committee. The next meeting of the Public Works Committee is scheduled for June 3, 1991 at 5:30 p.m. D. Finance Chairman Brothers reported .the Finance Committee met prior to the Council meeting this evening at 7:00 p.m. to discuss claims and payroll. The next meeting of the Finance Committee is scheduled for 1vlonday, June 3, 1991 at 7:00 p.m. IV. CONSENT AGENDA A. Minutes A3.6.2 1. Minutes of the May 6, 1991 regular Council meeting. MOTION CARRIED UNANIMOLTSLY. 5-0. V. OLD BUSINESS - None. VI. NEW BUSINESS A: Anolication No. MIS0005-91 ZC 0.3.4.2:1.2 Council to consider approving the amendment to the Zoning Ordinance with regard to panhandle lots. Motion by Councilmember Burns, second by Councilmember Brothers, to approve the amendments to the Zoning Ordinance with regard to panhandle lots and to instruct the City Attorney to prepare the necessary ordinance. MOTION CARRIED UNANIMOUSLY. 5-0 B. Annlication Na MIS0006-91 ZC 03.4.2.1.2, 03.4.2.6, 06.9, A3.5.5.18, A3.5.5.17 Council to consider amending Chapter 18.72 of the Zoning Ordinance and Chapter 17.02 of the Land Division Ordinance which reflects the Civil Violation Ordinance and to recommend 'adopdon of the Oidinance as prepared by the City Attomey. Motion by Councilmember Burns, second by Councilmember Brothers, to amend Chapter 18.72 of the zoning Ordinance and Chapter 17.02 of the Land Division Ordinance which reflects the Civil Violation Ordinance and to adopt the ordinance as prepared by the City Attomey. MOTION CARRIED UNANIMOUSLY. 5-0 C. Annlication No. PLT000249R 03.5 PLT0002-89R Council considerafion on the request of Gertrude A. Jones and SunCrest Homes for approval of a 96 lot single family subdivision containing 38.26 acres located on the west side of the West Valley Highway North in the 1000-1100 blocks. Motion by Councilmember" Burns, second by Councilmember Barber, to schedule a Public Hearing on June 3, 1991. PAGE 5 . CTTY OF AUBURN COUNCIL MEETING May 20, 1991 Councilmember. Brothers expressed his conceras regarding recent conespondence sent to property owners in the area of the "Sunning Hills" development. Planning Director Lancaster indicated the correct public hearing date is June 3, 1991 and that follow-up notification should correct the transposed date enor. MOTION CARRIED UNANIMOUSLY. 5-0. VII. ORDINANCES AND RESOLUTIONS A. Ordinances Steve Shelton read the title to the ordinance out loud. 1. Ordinance No. 4460 06.9, A3.5:5.1 An Ordinance of the City of Auburn, Washington, adding a new Auburn City Code Chapter 1.25 entitled "Civil Penalties for Violadons" which provides procedures for a civil process and civil penalties for violations of specified city codes. Motion by Councilmember Burns, second by Councilmember Brothers to introduce and adopt Ordinance No. 4460. MOTION CARRIED UNANIMOUSLY. 5-0. 2. Ordinance No. 4494 A5.330, A3.4.1 An Ordinance of the City of Auburn, Washington, authorizing execution of an interlocal agreement for Puget Sound Regional Council. Motion by Councilmember Burns, second by Councilmember Brothers to introduce and adopt Ordinance No. 4494. MOTION CARRIED UNANIMOUSLY. 5-0. 3. Ordinance No. 4497 01.2, A3.5.5.10 An Ordina.nce of the City of Aubum, Washington, adding a new sub-section to Auburn, City Code Chapter 10.36 relating to stopping, staading and parking and repealing a one hour parking area. As noted under Agenda Item III.C, Council Committe Reports, Public Works, Ordinance 4497 remained in committee. 4. Ordinance No. 4498 03.11.1 An Ordinance of the City of Aubum, Washington, authorizing the Mayor and City Clerk to execute a lease agreement between the City of Aubum and Catholic Community Services pursuant to Ordinance No. 4333 Motion by Councilmember Burns, second by Councilmember Brothers to introduce and adopt Ordinance No. 4498. Qrdinance No. 4501 03.4.2.1, 03.4.2.6; 06.9, A3.5.5.18, A3.5;3,17 City Attorney Shelton noted that a typograpical enor appears in this Ordinance title. The published tide indicates Aubura City Code Chapter 1.24. The Auburn City Code Chapter is 1.25. City Attorney Shelton read the correct ordinance title. An Ordinance of the City of Aubum, Washington, amending Chapter 18.72 of the Zoning Ordinance and 17.02. of the Land Division Ordinance to institute the enforcement procedures and civil penalties contained Aubum City Code Chapter 1.25„ as established by Ordinance No. 4460. Motion by Councilmember Burns, second by Councilmember Brothers,. to introduce and adopt Ordinance No. 4501. MOTTON CARRIED UNANIMOUSLY. 5-0. 6. Ordinance No. 4502 A15.5.12,13,15 City Attorney Shelton noted that a typograpical enor appears in this Ordinance - title. The published title indicates Aubum City Code Chapter 1.24. The Auburn City Code Chapter is 1.25. City Attorney Shelton read the correct ordinance title. An Ordinance of the Gity of Auburn,. Washington, amending Auburn City Code Sections 12.08,040, 12.16.130, 12.20.060, 12.24.070, 12.32:050, 12.36.100, 12.40.010, 12.44.040, 13.04.490, 13.16.1'30, 13.30.530, 13.32.080, 13.48.470, 15.04.080, 15.10.050, 15.48.130, 15.48:170, 15.32.090, 15.36.090, 15.68.090, 15.74.060(F) to insdtute the enforcement procedures and civil penalties contained in Aubum City Code Chapter 1.25 as established by O;dinance No. 4460. Motion by Councilmember Burns, second by Councilmember Brothers, to introduce and adopt Ordinance No. 4502 Councilmember 'Whittall requested a clarification from City Attorney Shelton as to whether Oidinance No. 4502 will allow enforcement authority of city codes. City Attorney Shelton responded that Ordinance No. 4502 allows enforcement processes for areas such as streets, sidewalks, sewer, water, solid waste, building, zoning and subdivision and that enforcement authority for health and environmental issues will be presented to Council in the near future. MOTION CARRIED UNANIMOUSLY. 5=0. B. Resolutions ' City Attorney Stephen Shelton read the titles to each resolution out loud. 1. Resolution No. 2200 . 04.4.2 A Resolution of the City of Auburn, Washington, authorizing the Mayor and City Clerk of the City of Auburn, to execute an agreement between the City of Aubum PAGE 7 CITY OF AUBURN COUNCIL MEETING May 20, 1991 and Bonnie tours to serve as travel agent for the Senior Center New England Tour. Motion by Councilmember Burns, second by Councilmember Brothers to adopt Resolution No: 2200. MOTION CARRIED UNANIMOUSLY. 5-0. 2. Resolution No. 2202 A 1.4..1 . A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor of the City of Aubum to terminate the interlocal agreement with King County for the provision of court services and to prepare an implementation plan " for the establishment of the Auburn Municipal Court. Motion by Councilmember Whittall, second by Councilmember Wagner to adopt Resolution No. 2202. Councilmember Burns stated he had reviewed in detail the study supporting a municipal court for the city of Aubum. However, philosophically. he believes judicial decisions are more consistent in a district court system rather than a municipal system. ,Councilmember Bums expressed to his fellow councilaiembers that he could not support Resolution No. 2202 because of his philosophical position. MOTION CARRIED 4-1 with Councilmember Burns voting no. VIII. MAYOR'S..REP(DRT Executive Session - None. IX.
