CALL TO ORDER The regular meeting of the City of Auburn Council was called to order by Mayor Bob Roegner at 7:30 p.m. in the City of Auburn Council Chambers. A. Flaa Salute Mayor Roegner led those in attendance in the pledge of allegiance. B. R l01 Call Those in attendance included Mayor Bob Roegner and Councilmembers Whittall, Wagner, Burns, Larson, Barber, Brothers, and Kurle. Staff members in attendance. included Fire Chief Bob Johnson, Parks & Recreation Director Len Chapman, Personnel Director Gretel Sloan, Police Chief Jake Evans, Captain Ray Sherman, Finance Director Pat Dugan, Public Works Director Frank Currie, Planning Director Steve Lancaster, City Attorney Stephen Shelton, and City Clerk Robin Wohlhueter: Other staff in attendance included Senior Planner Lynn Rued, Fire Marshal Wayne Senter, and Deputy City Clerk Gayle Butcher. C. Announcements and Annointments 1. Announcements DARE Graduation Mayor Roegner mentioned DARE Graduation ceremonies are scheduled at various Auburn schools; and Councilmembers have been provided with a schedule. Mayor Roegner hoped Councilmembers would have an opportunity to attend. As Mayor Pro-Tem, Mayor Roegner thanked Councilmember Bud Larson for filling in for him at the Chinook SchooT DARE graduation. Librarv Ceremonv As part of the Library's long range plan, today the Library held a ribbon cutting ceremony attended by Mayor Roegner and Councilmembers Burns and Barber in recognition of the Library's first computerized cataloging and indexing system. Mayor Roegner thanked §taff inembers responsible for implementing the computer system and encouraged all citizens to utilize ttie system. - , a. Presentation Mayor Roegner presented an award given by the Washington Recreation and Parks Association to representatives from Aubum General Hospital for outstanding sponsorship of athletic programs. They have sponsored such programs as the Fun Run, volleyball CITY OF ALTBURN COUNCIL MEETING June 3, 1991 games, and a recent Arts Commission performance. Mayor _ Roegner noted the award is a. prestigious one in that it representes Recreation staffs state wide. Accepting on behalf of Auburn General Hospital are Mike Gherardini, Managing Director, Lee Singer, Auburn General Hospital Boardmember,'and Pat Bailey, Assistant Administrator. 2. Anoointments - None D. Aaenda Modifications - None. II. CITIZEN INPUT. PUBI.IC HEARINGS & CORRESPONDENCE A. Public Hearings Prior to opening the public hearing Mayor Roegner noted the differences in the two public hearings that are before the Council this evening. The first hearing is to determine whether the City's Hearing Examiner acted correctly in upholding the city staff Final Mitigated Determination of Non- Significance on the "Sunning Hills" preliminary plat. He stated under the provisions of the Auburn City Code the first hearing is based upon Robert Kline's appeal of the Hearing Examiner's decision. . The hearing will be conducted on the record established by the Hearing Examiner. The Council will consider the evidence as presented to the Hearing Examiner and will not solicit or accept any new evidence at this time. It is up to the appellant to identify error of fact, and Mr. Kline will have the opportunity to do that after a brief staff report. Mayor Roegner noted that if the Council does not uphold the Hearing Examiner's decision; there will be no need to conduct the second public hearing on the preliminary plat of "Sunning Hills°. Following a decision on the appeal of Robert C. Kline of the Hearing Examiner's final decision to uphold the Responsible Official's issuance of a Final Mitigated Determination of Non-Significance, the Council will conduct a second public hearing on the merits of the proposed preliminary plat to be kno.wn as "Sunning Hills" in order to determine whether the plat should be approved, modified or-rejected. 1. Annlication No._CAP0002-91 A3.23.1, 015 PLT0002-89R, The appeal of Robert C. Kline of the Hearing Examiner's final decision to uphold the Responsible Official's issuance of a Final Mitigated Determination of Non-Significance (SEP0029-89R) pursuant to the State Envi_ronmental Policy Act (SEPA) which would permit development of a ninety-six (96) lot single family sesidential subdivision known as "Sunning Hills" (Application No. PLT0002-89R) on the west side of the West Valley Highway North in the 1000-1100 blocks containing 38.26 acres. Mayor Roegner opened the public hearing. PAGE 2 CITY OF AUBURN COUNCIL MEETING June 3, 1991 Steve Lancaster stated the Planning Department issued its Final Mitigated Determination of Non=Significance for the "Sunning Hills" development on February 6, 1991. Under the environmental policy act, he said this determination represents -a decision by the Planning Director that the project can move through a public hearing process without the need to prepare a full environmental impact statement as long as certain conditions are met. The appeal filed by Mr. Kline is based on the alleged failure to address environmental issues and not require an EIS. The appellant argues issues of density, failure to provide proper access, traffic impacts, and impacts on wetlands, wildlife, and steep slopes. Mr. Lancaster explained a public hearing was held on March 19, 1991 before the Hearing Examiner who concluded the Planning Department's decision to not require an EIS, and that the conditions upon which the decision was based should be upheld. Steve Lancaster stated the Examiner found that the project is consistent with the Auburn Comprehensive Plan and the Auburn Zoning Gode, He assured the Council that access and traffic circulation issues have been analyzed by experts, and that adequate impact mitigation is required for wetlands, wildlife, and soils stability. Mr. Lancaster further stated water runoff issues have been studied and mitigation has been required. Mr. Lancaster reiterated Mr. Kline's appeal alleges errors in interpretation of the Comprehensive Plan, Zoning Code and SEPA Policies. Mr. Lancaster stressed the planning staff continues to believe the environmental review on "Sunning Hills" has been thorough, and the twenty-three conditions required are adequate to minimize adverse impacts to this proposal. Steve Lancaster :recommended Council uphold the issuance of the Final Mitigated Determination of Non- Significance on the "Sunning Hills" Preliminary Plat. Mr. Robert (Skin) Kline - 520 Aaby Drive, Auburn, WA 98001 Mr. Kline, facilitator for the Auburn Residents Association, pointed out they are fully aware the burden of proof is upon the appellant with regard to the appeal that was filed. He said due to the fact the administrative staff of the city has assured them there are no problems with wildlife or erosion, they are going to yield to the administrative arm of the city and formally withdraw their appeal. Mayor Roegner stated the public hearing will continue as scheduled, and requested further comments from the audience. Applicants and surrounding area residents in the audience of the proposed development declined to comment further with regard to the appeal on the Hearing Examiner's decision. Motion by Councilmember Burns to close the public hearing, to sustain the Hearing Examiner's decision to uphold the issuance of the Final Mitigated Determination of Non-Significance on the "Sunning Hills" preliminary plat. Annlication No. PLT0002-89R 03.5 PLT0002-89R, A3.23.1 CAP0002=91 The request of SunCrest Homes and Gertrude A. Jones for a preliminary plat to be known as "Sunning Hills" a ninety-six (96) lot single family subdivision containing 38.26 acres and located on the west side of the West Valley Highway North in the 1000-1100 blocks. Under City ordinance, this hearing is open to public comment by any interested person. Mayor Roegner opened the public hearing. Lynn Rued briefly highlighted key issues associated with the proposed application for a preliminary plat. Mr. Rued stated the city has been involved with the ninety-six lot development for the past two years where a number of studies were conducted. Studies on Geotechnical (soils), wetlands, traffic, wildlife, and a tree survey were conducted by recognized professionals. Directing attention to overhead projector where a map of the proposed plat was displayed Mr. Rued point out where the primary access is located on the preliminary plat from West valley Highway. He stated the primary access to the plat is a new street intersecting West Va11ey Highway. This intersection will provide for left turn lanes into the plat, and an acceleration lane on West Valley Highway. Lynn Rued further discussed traffic circulation and impacts, street construction anc4 standards, sidewalk construcfion, access to plat, the proposed park, and a new connecting street to existing neighborhood on Aaby Drive. He stated the neighboring property owners are requesting stamped concrete or cobblestone to be constructed on the connecting street between Aaby Drive and the "Sunning Hills" plat in , order to obtain a pedestrian type atmosphere. Mr. Rued further stated it is the, staff s. position construction of a connecting street with stamped concrete would cost more to maintain than asphalt, and due to the 12% grade of the connector street t_raffic is.more likely to use the northem primary access point serving the proposed development. Maris Nixon - 523 Aaby Drive, Auburn, WA 98001 Maris Nixon, neighboring property owner to the proposed development, directed attention to the overhead projector displaying the plat map, expressed concern of the proposed density from one subdivision to another, sidewalk widths,, sight distance problems when exiting the proposed development onto the West Valley Highway from the primary access tb the plat, and removal of trees. Mrs. Nixon felt due to sight distant problems exiting from the main access point onto West Valley Highway would result in traffic using Aaby Drive. She stated property owners did not want to give up deadend streets and cited a police incident that recently occuned. PAGE 4 CITY OF AUBURN COUNCIL MEETING June 3, 1991 James Limric - 524 Aaby Drive, Aubqrn, WA 98001 James Limric, neighboring property owner, expressed concern over development standards, quesdoned traffic impacts, and felt access from the proposed development will be utilized by property owners from the Knickerbocker entrance due to site distance problems rather than using the north access. Mr-. Limric wondered if coasideration had been given with regard to slide problems that cunently exist, and would there be more slides if the plat were developed. Robert C. Kline Jr. - 520 Aaby Drive, Aubum, WA 98001 Mr. Kline expressed appreciation to the developers, Auburn Residents Association, and city staff for their cooperation and assistance through this process. Referring to the Comprehensive Plan Mr. Kline read from Section 23.4 with regard to alternative streets. Mr. ICline briefly described the various phases of the process in developing the preliminary plat with regard to traffic circulation, street connector, and construction. Mr. Kline refened to and.submitted the following exhibits: Exhibit I showing local access and emergency through access; Exhibit II displaying the connector road; Exhibit III page one to a letter dated February 4, 1991 to Auburn Residents Association from Earl Miller, Project Manager for SnnCrest Homes, Inc:; Exhibit IV page two of February 4, 1991 letter to Aubum Residents Association from Earl Miller; Exhibit V drawing of stamped concrete connector road between the proposed preliminary plat and Aaby Drive; and Exhibit VI showing a plat map of the proposed preliminary plat, and neighboring Knickerbrocker Heights. Mr. Kline stated the Auburn Residents Association has come to an agreement with the developer to have a stamped concrete street connecting :Aaby Drive at the p1aYs south boundary. Mr. Kline finalized his comments by petitioning the Council to require a stamped concrete street for the entire length. He said the stamped concrete street would last longer than asphalt street. Enavat Aziz - PO Box 2758, Redmond; WA 98073 Enatyat Aziz, Aziz Engineering Northwest, Inc., assisted the petitioner in design and analysis of the proposed development, and concurs with the staff presentation and staff analysis. Mr. Aziz addressed concerns brought up by neighboring property owners regarding the number of lots along the south side of development, and access from Sunning Hills development.to the West Valley Highway.. He stated the plat provides for adequate sight distance at that location, and additionally there is an acceleratioa lane and turning lane planned at the main access to the plat. Regarding the number of lots along the south side of the development, Mr. Aziz stated they intentionally created the lengths of the lots greater than other to provide for additional buffer area between proposed plat of Sunning Hill and the existing neighboring subdivision. PAGE 5 CITY OF AUBURN COUNCIL_MEETING June 3, 1991 Mr. Aziz suggested stamped concrete be used on the connector street between Aaby Drive and the plat south boundary. A stamped concrete street creates a street with a pedestrian type setting. Mr. Aziz suggests a stamped concrete street. can become a maintenance problem as time goes on and eventually it has to be replaced. . Mr. Aziz finalized his comments by addressing the concern of slides occurring due to tlie development. Mr. Aziz resolved the concerns of slides and erosion problems by discussing the studies conducted with regard to soil conditions. Mr. Aziz expressed thanks to staff during this process. Carv Vlahovich - 1280 140th Place N.E., Bellevue, WA Cary Vlahovich, President of SunCrest Homes, Inc., recapped the primary issues facing them in the development of this property. Working with staff in meeting requirements according to code, and linking two neighborhoods, Mr. Vlahovich believes the proposal will not adversely affect the neighboring property owners. Mr. Vlahovich supported the stamped concrete street adjoining Aaby Drive and southem part of plat. Robert Kline - Mr. Kline stated the stamped concrete connector street could be placed and lengths of plain concrete in between stamped concrete. Mr. Kline urged council approval of the proposed plat. Mike Bocatch - T T 1 8th Street S.E., Auburn, WA Mr. Bocatch, resident of the City of Auburn, observed that the configuration of the proposed plat resembles a racetrack due to its circular design. Mr. Bocatch expressed concern of a speeding car within the development. Leon Stucki - 724 West Hi Crest, Auburn, WA Leon Stucki, neighboring resident to proposed development, wondered if consideration has been given with regard to a park location within the development. Mayor Roegner responded to Mr. Stucki by stating earlier testimony had been given with regard to a park being included as part of the development. . Motion by Councilmember Burns to close the public hearing. Second by Councilmember Brothers. MOTION CARRIED UNANIMOUSLY. 7-0. Council discussion centered around the following concems: stamped block concrete street and the Sunning Hills developer's interest in construction of the length of the street; clarification regarding the sta.tus of a sixty foot easement along the north boundary of the plat; what is being reserved for open space; sLreet lighting and glare affecting neighboring property owners; tree removal and vegetation; PAGE 6 CITY OF AUBURN COUNCIL MEETING June 3, 1991 elevation of proposed development; school bus pickup; and compliance with new panhandle lot code. Staff responded to concerns raised by the Council. The development will provide for adequate screening to block headlight glare at the intersection of Aaby Drive and the connecting street. The sixty foot private easement serves Lots 6, 7, 8 of the Aaby Drive neighborhood. Open space is reserved on the west boundary of the proposed development. A landscaping plan will idendfy which trees will remain, and clear communication with the developer and respective . property owner will assure code compliance. Some of the Councilmembers commented and congratulated the residents and developers for their coordinated efforts in resolving most of the issues surrounding the proposed development of "Sunning Hills" prior to the hearing before the CounciL Mofion by Councilmember Burns, second by Councilmember Brothers to approve the preliminary plat of "Sunning Hills" based upon the Hearing Examiner's Findings of Fact, Conclusions and Conditions and instruct the City Attorney to prepare the necessary resolution to include the street connecting Aaby Drive to the proposed development would be constructed with stamped concrete along its entire length. MOTION CARRIED UNANIMOUSLY. 7-0.. Mayor Roegner: announced there would be a two minute recess at 9:01. The meeting reconvened at 9:05. B. Audience Particination Viritinia Hauqen - 2503 R Street S.E., Aubum, WA 98002 Virginia Haugen, resident of the City of Aubu.rn, questioned code regulations with regard to fill dirt, and drainage systems. Mrs: Haugen also thanked the Council for their consideration and support in establishing a municipal court, and a health department within Auburn. C. Corresnondence F2.4.9 LID 344, 04.9.1 Street Imp. 292 1. Letter dated May 28, 1991 from Jack Rucinsky challenging the methd of determining the assessments for Local Improvement District 344 for the construction and improvement of East Main Street from Auburn Avenue to Aubum Way North. Mayor Roegner acknowledged receipt of Mr. Rucinsky's letter, and inquired of staff when Mr. Rucinsky's letter would be considered and if a public hearing is required. Frank Currie responded that the appeal period expires June 5, 1991. Refening to Mr: Rucinsky's letter, Frank Currie stated the letter is an objection to the method of distribution of the assessments, and not an objection to the formation of the district. He said a final hearing will PAGE 7 CITY OF AUBURN COUNCIL MEETING June 3, 1991 be held on the assessments, and at that time Mr. Rucinsky could make his objections. III. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municioal Services Chairman Whittall reported the Municipal Services Committee has not. met since the last Councilmeeting. The next meeting of the Municipal Services Committee is June 10, 1991 at 4:30 p.m. B. Planning & Communitv Develonment Chairman Burns reported the Planning & Community Development Committee met on May 28, 1991 and the minutes are of public record. Heath Services were considered, and a budget analysis has been prepared. Chairman Burns requested support of items considered at the last meeting that appear on tonight's agenda. The next meeting of the Planning & Community Development Committee is scheduled for June 10, 1991. C. Public Works Chairman Kurle reported the Public Works Committee met prior to the Council meeting at 5:30 p.m. Some of the items reviewed include a resolution, and a final pay estimate. Chairman Kurle congratulated staff on completion of the Stuck River Bridge project which required coordination with other agencies. The next meeting of the Public Works Committee is scheduled for June 17, `I991 at 5:30 p.m. D. Finance Chairman Brothers reported the Finance Committee met prior to the Council meeting this evening at-7:00 p.m. to discuss interfund loans, a resolution authorizing participation in the Voter Pamphlet, and claims and payroll. The next meeting of the Finance Committee is scheduled for Monday, June 17, 1991 at 7:00 p.m. IV. CONSENT AGENDA A. Minutes 1. Minutes of the May 20, 1991 regular Council meeting. B. Annlication No: CUP003748A 03.10.1 Council consideration on the request of North Auburn Baptist Church to amend Ordinance No. 4325 which would allow the church to use the existing temporary modular units until May, 1992 located at 1039 22nd Street N.E. Motion by Councilmember Burns to approve the amendment to Ordinance No. 4325 based upon the Hearing Examiner's Findings of Fact and Conclusions and to instruct the City Attomey to prepare the necessary ordinance. Second by Councilmember Brothers. MOTION CARRIED UNANIMOUSLY. 7-0. VII. ORDINANCES AND RESOLUTIONS A. Ordinances Steve Shelton read the title to the ordinance out loud. 1. Ordinance No. 4497 A3.5.5.10, 01.2 An Ordinance of the Gity of Auburn, Washington, amending Auburn City Code Chapter 10.36.340 and 10.36.380 relating to stopping, standing and parking. Motion by Councilmember Burns, second by Councilmember Brothers to introduce and adopt Ordinance No. 4503. MOTION CARRIED UNANIMOUSLY. 7-0. 3. Ordinance No. 4504 A3.5.5. An Ordinance of the City of Aubum, Washington amending Aubum City Code Sections 8.08.280, 8.16.240, 8.16370, 8.16.280, 8.20.010, 8.20.030, 8.20.040, 8.20.050, 16.08.030 and 16.08.210 and repealing • Auburn City Code Sections 8.16.250, 8.16360, and 8.20.060, and adding a new section 8.16.260 and 16.06.440 to institute the enforcement procedures and civil penalties contained in Auburn City Code Chapter 1.25 as established by Ordinance No. 4460. Resolutions City Attorney Stephen Shelton read the titles to each resolution out loud. 1. Resolution No. 2203 A3.10.1 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City of Aubum to enter into an agreement with King County to participate in the financing and disbursal of Local Voters' Painphlets as authorized by R.C.W. Chapter 29.81A of the laws of the State of Washington. Motion by Councilmember Kurle, second by Councilmember Whittall to adopt Resolution No. 2203. MOTION CARRIED UNANIMOUSLY. 7-0. 2. Resolution No. 2211 04.6.3 Sewei Improvement No. 85 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute a contract for services between .the City of Aubum and Gelco Services, Inc. relating to the 1991 Insituform Project. Motion by. Councilmember Kurle, second by Councilmember Wagner to adopt Resolution No. 2211. MOTION CARRIED UNANIMOUSLY. 7-0. VIII.
