CALL TO ORDER The regular meeting of the City of Auburn Council was called to order by Mayor Bob Roegner at 7:30 p.m. in the City of Auburn Council Chambers. A. Flae Salute 1Vlayor Roegner led those in attendance in the pledge of allegiance. B. Roll Call Those in attendance included Mayor Bob Roegner and Councilmembers Whittall, Wagner, Burns, Larson, and Kurle. Councilmembers Brothers and Barber were excused. Staff inembers in attendance included Fire Chief Bob Johnson, Parks & Recreation Director Len Chapman, Police Captain Bill Pitzl, Public Works Director Frank Currie, Planning Director Steve ' Lancaster, City Attorney Stephen Shelton, and City Clerk Robin Wo.hlhueter. Other staff in attendance included Senior Planner A1 Hicks. C. Announcements and Aqaointments 1. Announcements a. Election Dav A3.11A3.10.13 1991 Election Mayor Roegner nofed tomorrow is election day, and City Hall will - be open for those who would Tike to check on the results of the election. A public' number is available to call King;County Elections for e(ection results. b. Sexual PredaEor Seminar A1.12 . Mayor Roegner announced a free seminar will be held at the Auburn Performing Arts Center on Saturday, September 21, 1991 beginning at 9:00 a.m. regarding Sexual Predators. The seminar is co-sponsored by a citizens group CASP, the Auburn School District Administration, and City of Auburn. The Auburn Police Department will assist with the seminar. c. Bov Scout Troon 341 After the second public hearing, Mayor Roegner recognized Boy Scout Ryan Little in the audience this evening working on his Citizenship in the Community Badge: 2. Appointments a. 1991 Voters' Pamptilet ~ CITY OF AUBURN COUNCIL MEETING September 16, 1991 A3.10.4 City Council to appoint a citizen committee to write the Statement For or Statement Against Proposition No. 1 and Proposition No. 2. Motion by Councilmember Larson, second by Councilmembei Kurle to appoint Nancy Colson to the Committee to prepare arguments advocating voters' approval, of Proposition No. 1 and Proposition Na, and to appoint William Morchin to the Committee to prepare the arguments advocating voters' rejection of Proposition No. 1 and Proposition No. 2. . MOTION CARRIED UNANIMOUSLY. 5-0. D. Aaenda Modifications - None. A3.6.6 II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearinas 1. 1992 PreliminarV BudQet : F3.5 1992 Preliminary Budget Prior to the Mayor and City Council making a decision with regard to the 1992. Budget,: all persons interested are encouraged to participate in the public hearing by making comments, proposals, and suggestions or to voice an opinion for consideration on the preparation of the 1992 Budget. . Marv Jones - 1025 South 3rd Street, Kenf, WA Mary Jones stated she had been a resident of Auburn for many years. Ms. Jones represents YWCA Transitional Shelter Program. Located in Kent, YWCA ?ransitional Shelter serves all of South King County. She stated each year 10,000 domestic violence victims are turned away from King County shelters due to the growing need of transitional housing. Transifional housing supports domestic violence victims. Ms. Jones discussed the many services available through YWCA _ Transitional Shelter Program. She stated the capital project cost is $13 million with an annual program budget of $160,000. Citing stastics in Auburn and South King County, Ms. Jones urged the Council for their support of this program. Linda Rasmussen - 1024 South 3rd Street, Kent, WA Linda Rasmussen, Executive Director of Domestic Abuse Women's Network, stated her organization is excited abour:the YWCA's Transitional Housing Project. In coordination with YWCA, Ms. Rasmussen informed the Council that Domestic Abuse Women's , Network will be opening a shelter for victims in 1992 for continued service. The shelter will have fifteen beds serving women and children. Ms.. Rasmussen asked for Council support of shelter , operations in home programs. In 1990 the Safe Home Program provided assistance to 38 Auburn residents. She said victims will stay PAGE 2 . ~ CITY OF AUBURN COUNCIL MEETING September 16, 1991 in a home seventy-two hours at one time. She said it does not give women and children enough time to decide what to do when facing a crisis situation. Rita Haeen - 2915 East Madison Street, Suite 305, Seattle, WA Rita Hagen is representing Child Care Resources formerly known as Child & Family Resource & Referral. Ms. Hagen thanked the Council for their continued support during the last two years. Ms. Hagen reviewed the types of child care crisis parents face today. They are the availability of affordable day care, and the quality of care. Child Care Resources provides support to the public with computerized data base telephone information. It provides referrals to those seeking child care providers, technical assistance, and training workshops. Ms. Hagen said from January to August Child Care Resources has served 221. Auburn parents. They advocate for subsidy of child care rates. William Morchin - 1345 East Main Street, Auburn, WA William Morchin is a resident of the City of Auburn. Morchin raised the issue of the Downtown Design Plan. He pointed out three of the fourteen items scheduled to be done within two years in the downtown area are complete. He encouraged the Council to put emphasis on the downtown design plan when preparing the budget. Jack Robinson - Jack Robinson is the Director of Finance for Valley Cities Mental Health Center in Auburn. Mr. Robinson.stated Valley Cities Mental Health is requesting assistance from the City of Auburn to provide services for support therapy for victims of domestic violence and abuse. Mr. Robinson cited statistics in the Auburn area. He said Valley Cities Mental Health Center is additionally supported by United Way. Mr. Robinson, stated they are coordinating their efforts with other agencies. Don Kulman - 31608 Thomas Road S.E., Auburn, WA Don Kulman is on the Board of Trustees for King County Sexual Assault Resource Center. Mr. Kulman said the cycle of abuse has long term effects on society. Mr. Kulman noted King County Sexual Assault Resource Center has treated 76 residents of the City of Auburn under the age of 12 years old. Mr..ICulman stated they work with other agencies to coordinate educational efforts to allow us to . support the continuation of treating victims of sexual assault. Mr. Kulman asked for continued support support in providing services. Dick Bruner - 11244 S.E. 322nd Street, Auburn, WA 98002 Dick Brugger, Executive Director of Auburn Youth Resources, expressed appreciation of the messages of collaboration efforts of the various social agencies. Mr. Brugger thanked the Council for the support the city has given in the past. Mr. Brugger's comments centered around the need for a center for young people who do not fit into the mainstream programs such those programs offered by the Park & Recreation Department. Mr. Brugger applauded the Community Center ballot issue before the voters, this November, but expressed the need for a special youth center for youth at risk. Pep, Mason - . Peg Mason is representing Children's Home Society of Washington. The Children's Home Society of Washington is a primary prevention program and supports family services. So far this year 224 families have utilized the Auburn site at 4338 Aubuin Way North. Eighty-nine of these families are Auburn residents: Services provided inc.lude assistance witH basic needs, child care, in-home child development, health services, and parent support services. Ms. Mason noted other agencies are working closely together in providing continuum of care. Children's Home Society's program is based on the problems parents face in raising chilclren in the nineties. Ms. Mason finalized her comments by thanking the Council for their encouragement in obtaining funding through the budget process. Mayor Roegner pointed out the budget process allows for further written or oral public comments between now and final budget deliberations. Ivlotion by Councilmember Whittall, second by Councilmember Larson to close the public hearing. MOTION CARRIED UNANIMOUSLY. 5-0. 2. Annlication No. REZ0002-91 CP 03.8 REZ0002-91, 03.4.4 The request of the Doctor's Clinic Association to rezone from R-2 (Single Family Residential) to C-1 (Light .Commercial) along with consideration of an amendment to the City of Auburn Comprehensive Land Use Map from Single Family Residential to General Commercial on property located at 625 12th Street S.E. Mayor Roegner asked Planning Director Steve Lancaster to briefly update the council on the proposed rezone application prior to opening the hearing. Steve Lancaster briefly summarized the Planning Commission recommendations, and the staff recommendation with regard to Application No. REZ0002-91CP. Directing attention to the policies of the Comprehensive Plan adopted in 1986, Mr. Lancaster stated the proposed rezone is inconsistent with policies established for single , family neighborhoods. He said the Comprehensive Plan is a commitment to the preservation of single family neighborhoods: He said the Comprehensive Plan Map amendment would be required because the parcel is designated for single family uses and lies within a designated single family neighborhood. He stated the staff recommended the Planning Commission deny the proposed rezone. After the Planning Commission held a public hearing they PAGE 4 . . CITY OF AUBURN COUNCIL MEETING September 16, 1991 recommended approval of the rezone and amendment. Referring to the overhead projector illustrating an aerial photograph of the proposed area, Mr. Lancaster pointed out the area of the proposed rezone, and boundaries of commercial uses and single family uses as designated on the Comprehensive Plan. Despite the Planning Commission recommendation of approval, Mr. Lancaster stated the staff continues to recommend denial of this application due to it being inconsistent with the policies of the Comprehensive Plan, and approval would set a precedence in protecting oEher single family residences. Mayor Roegner opened the public hearing. Mike Bocatch - 111 H Street S.E., Auburn, WA Mike Bocatch is a resident of the city of Auburn. Mr. Bocatch's concern of the proposed rezone application is that it is not consistent with the policies of the Comprehensive Plan. Mr. Bocatch felt the proposed rezone gives the area a sprawl appearance, and recommended the applicants consider a two-story building. Cecila Raines - 601 12th Street S.E., Auburn Cecila Raines is a neighboring resident of the proposed rezone property. Mrs. Raines explained the reason they bought their house in this area was due. to the residential zoning, and over the years they have watched the property deteriorate giving away to infringing businesses. Mrs. Raines opposes the proposed rezone application. Allen Keimig - 216 A Street N.W., Auburn, WA Allen Keimig is the architect representing the Doctors Clinic. Directing attention to the overhead projector displaying a map of the proposed rezone property and surrounding area, Mr. Keimig pointed out the single family designated area. He stated the proposed rezone is to develop the, lot next door that is currently zoned single family residential to expand the Doctors Clinic. Mr. Keimig's noted future development of the shopping center is within the same area of the Doctors' Clinic. He stated it is not economical to build a second story on the current medical facility, and with approval of the rezone will allow expansion of the current.facility in order to service a growing community. Herman Ansinah- - 909 Sth Street N.E., Auburn, WA Herman Ansingh works at the Doctors Clinic. Mr. Ansingh pointed out the Doctors Clinic has been in existence for over thirty years, and at one time a change from residential to light commercial had been made. He sympathized with the process of the Comprehensive Plan, and urged the Council to consider approving the proposed rezone in order provide continued medical service to this area of the community instead of moving to a downtown location. Motion by Councilmember Burns, second by Councilmember Kurle to close the public hearing. PAGE 5 . • CITY OF AUBURN COUNCIL MEETING September 16, 1991 MOTION CARRIED UNANIMOUSLY. 5-0. Councilmember. Burns disclosed that he has retained the services of Mr. Keimig to do a remodeling job on his home. He said he does not believe there is any conflict or difficulty in deliberating on this proposed rezone. He also noted that he is paying Mr. Keimig for his services. Discussions center around line designations on the Comprehensive Plan Map, hours of operation, traffic thorough-fares, transitional type rezone designations, and other commercial businesses surrounding the proposed rezone property. Motion by,Councilmember Burns, second by Councilmember Whittall to approve the rezone and Comprehensive Plan Map amendment based upon the Planning Commissions Findings of Fact and Conclusions, and to instruct the City Attorney to prepare the necessary Ordinance with the addition of a findi-ng to the effect of limiting the hours of operation of the proposed clinic in accordance with the public testimony and documentation in the file. Under discussion, Councilmember Burns pointed out uses currently existing on 12th Street that are non-residential in nature, and that having a commercial designation to buffer the easement from 12th Street S.E. into the shopping center would be more appropriate than a single family residential buffer. MOTION CARRIED. 3-2 with Councilmembers Kurle and Wagner voting no. Mayor Roegner noted Councilmembers not in attendance this evening will be required to review all testimony, records, and anything that was submitted to the Council this evening prior to action on the Ordinance. He clarified passage of the Ordinance must pass by four votes according State law. B. Audience Particioation Mike Bocatch - 111 H Street S.E., Auburn, WA Mike Bocatch commented on the need for a Community Center for kids to go especially after listening to the requests of the social services agencies earlier this evening. C. Corresnondence 1. Annlication No. CAP0003-91 03.10.5 VAR0002-91, A3.23.1 CAP0003-91 . Transmits an Appeal of the Hearing Examiner's Decision issued on August 27, 1991. The appeal was filed on September 4; 1991 by John R. Parker on his request for a variance to allow a garage to be built PAGE 6 CITY OF AUBURN COUNCIL MEETING September 16, 1991 within 10 feet of the alley and for the lot coverage to be exceeded by 2°No at 307 R Street N.E. proposed under Application No. VAR0002-91. Mayor Roegner noted the correspondence received. III. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municinal Services Chairman Whittall reported that the Municipal Services Committee met on September 9, 1991 to review proposals for a Regional Justice Center, Auburn Municipal Court, and surplus property. The next meeting of the Municipal Services Committee is scheduled for Monday, September 30, 1991 at 4:30 p.m.: in Conference Room #1 located on the main floor of Auburn City Hall, B. Planninja & Communitv Develonment Chairman Burns reported the Planning & Community Development Committee met on. September 9, 1991 and the minutes are of public record. Chairman Burns requested Council support those items appearing on the agenda tonight. The next meeting of the Planning & Community Development Committee is scheduled for September 23, 1991. C. Public Works _ Chairman Kurle reported the Public Works Committee met prior to the ` Council meeting at 4:30 p.m. Chairman Kurle for review of 1992 budget proposals. Chairman Kurle reported the Public Works Committee will meet . on Wednesday, September 18, 1991, and Monday, September 30. The next regular meeting scheduled.for October 7th is cancelled. D. Finance . Vice-Chairman Whittall, reported that the Finance Committee met prior to the Council meeting.tonight for presentation of the Legal & Personnel Departments 1992 budget proposals, and review of claims and payroll. The next meeting of the Finance Committee is scheduled for Monday, October 7, 1991 at 7:00 p.m. IV. CONSENT AGENDA A. Minutes 1. Minutes of the September 3, 1991 regular Council meeting. B. . MOTION CARRIED UNANIMOUSLY. 5-0. V. OLD BUSINESS - None. VI. NEW BUSINESS - None. VII. ORDINANCES AND RESOLUTIONS A. Ordinances City Attorney Stephen Shelton read the titles to each ordinance. 1. Ordinance No. 4515 03.11.2 St. Vincent DePaul, A3.2 An Ordinance of the City Council of the City of Auburn, Washington, amending Ordinance No. 4491 which approved the appropriation of the sum of $263,000 1991-92 Community Development Block Grant Funds to delete Item No. 6 and add the amount designated under such item to Item No. 5. Motion by Councilmember Burns, second by Councilmember Kurle to introduce and adopt Ordinance No. 4515. MOTION CARRIED UNANIMOUSLY. 5-0 PAGE 8 . CITY OF AUBURN COUNCIL MEETING September 16, 1991 B. Resolutions 1. Resolution No. 2235 05.2 Lakeland Hills/White River Park A Resolution of the City Council of the City of Auburn, Washington authorizing the Mayor and City Clerk of the City of Auburn to amend the agreement for professional services between the city and Jongejan/Gerrard/McNeal, Inc. for the preparation of a master site plan, construction documents, bid phase and' construction phase of the White River/Lakeland Hills Park and, Trail System previously approved pu'rsuant to Resolution No. 2059 to provide basis for computing fees for each phase of the project. Motion by Councilmember Burns, second by Councilmember Kurle to adopt Resolution No. 2235. MOTION CARRIED UNANIMOUSLY. 5-0. 2. Resolution No. 2236 03.4.1.3 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Cterk to execute a professional service agreement between the City and JC Draggo & Associates for assistance in the development of a Park and Recreation Plan. Motion by Councilmember Burns, second by Councilmember Kurle to approve Resolution No. 2236. MOTION CARRIED UNANIMOUSLY. 5-0. VIII. MAYOR'S REPORT A. Executive Session - None. IX.
