CALL TO ORDER The regular meeting of the City of Auburn Council was called to order by Mayor Bob Roegner at 7:30 p.m. in the City of Auburn Council Chambers. A. F1aQ Salute Mayor Roegner led those in attendance in the pledge of allegiance. B. Roll Call Those in attendance included Mayor Bob Roegner and Councilmembers Whittall, Wagner, Burns, Larson, Brothers, and Barber. Councilmember Kurle was excused. Staff inembers in attendance included Fire Chief Bob Johnson, Parks & Recreation Director Len Chapman, Police Captain Ray Sherman, Public Works Director Frank Currie, Finance Director Pat Dugan, Planning Director Steve Lancaster, City Attorney Stephen Shelton, and City Clerk Robin -Wohlhueter. Other staff in attendance included Fire Department Public Education Officer Kim McDonald. C. Announcements and Appointments 1. Announcements Police Cantain Sherman A4.12 Mayor Roegner welcomed Police Captain Sherman back from the Federal Bureau of Investigations Academy. Recently, Captain Sherman successfully graduated from the FBI Academy in Washington DC. 1992 Budget Hearing F3.6 Mayor Roegner announced there would be a 1992 budget hearing on November 18, 1991. Vallev Dailv News Reporter Mayor Roegner introduced Valley Daily Ivews Reporter Jeff Bond. Mr. Bond will be covering City Hall news for the newspaper along with Bruce Rommell. Mr. Bond was not in the audience until later in the meeting. a. Proclamations A1.8 1. Auburn Kids-Count Join PTA Week- Mayor Roegner presented a proclamation to Ray Vefik, President of Auburn Council of PTAs, and Paulette Sebolboro, Membership CITY OF AUBURN COUNCIL MEETING October 7, 1991 Chair of PTAs proclaiming October 14 through October 18, 1991 as Auburn Kids Count, Join RTA Week. He introduced Vern O'Brien accepting a proclamation. 2. Fire Prevention Week • Mayor Roegner presented a proclamation to Public Education Officer . Kim McDonald representing the Aubuin, Fire Department proclaiming October 6 through October 12, 1991 as "Fire Prevention Week". 3. National Familv Sexualitv Education Month May.or Roegner presented a proclamation to Cyril VanSelus , „ proclaiming the month of October as "National Family Sexuality Education Month". 2. Appointments a. National LeaQUe of Cities Conference A5.3.9 Motion by Councilmember Larson, second by Councilmember Burns to appoint Councilmember Pete Whittall as the voting delegate and Councilmember Stacey Brothers and Councilmember: Jeanne Barber as the alternate voting .delegates at the Nafional" League of' Cities Conference, December 12-16, 1991. MOTION CARRIED UNANIMOUSLY.. 6-0. D. Aaenda Modifications A3.6.6 Agenda modifications are noted under agenda item II.A.1 Application No. CAP0003-91 which transmits the Findings and Decision of the Hearing Examiner for the City of Auburn rendered on August 27, 1991 with regard to VAR0002=91. Agenda item II.C.1 is a note to the Council hand written by Mr. Stobbart reque.sting the Council consider granting the variance on Application No. VAR0002-91. II. CITIZEN INPUT. PUBLIC HEARINGS & CORRESPONDENCE A. Public HearinQs 1. Annlication No. CAP0003-91 . 03.10.5 VAR0002-91, A3.23.1 CAP0003-91 Appeal of the Hearing Examiner's decision rendered on August 27, ' 1991 with rega_ rd to. VAR0002-91. VAR0002-91 is the request of Mi. and Mrs. John R. Parker for a variance to, allow a garage to be built within 10-feet of the alley and for the lot coverage to be exceeded by . 2% on. property located at 307 "R" Street N. E: Mayor Roegner opened the public hearing. Prior to receiving public comments with regard to the above referenced publie hearing; Mayor Roegner asked Planning Director PAGE 2 ~ . CITY OF AUBURN COUNCIL MEETING October 7, 1991 Steve Lancaster to briefly summarize the public hearing application before the Council this evening. Steve Lancaster explained Mr. John Parker has appealed to the City Council the decision of the Hearing Examiner to deny his request for a variance to build a detached residential garage within 10 feet of an alley. Mr. Lancaster stated the Zoning Code requires a 20 foot setback, and the mazimum building ¢overage would be exceeded by 2% which are the basis of the Hearing Examiner's denial. He finalized his comments by stating granting of the variance would be inconsistent witht he Zoning Code. John Parker - 307 R Street N.E., Auburn, WA Mr. Parker, applicant, requested the Council grant his appeal because it is not unreasonable in size. Mr Parker briefly commented on other residences in the surrounding area that have garages that do nof ineet today's standards. Motion by Councilmember Burns, second by Councilmember Brothers to close the public hearing. MOTION CARRIED UNANIMOUSLY. ` 6-0. Under,discussion some members of the Council questioned the size of the garage as proposed by Mr. Parker, and discussed safety concerns if the city allowed a garage to be built that does not meet with Zoning Code regulations. Motion by Councilmember Burns to affirm the Hearing Examiner's decision to deny the variance request. Second by Councilmember Brothers. MOTION CARRIED. 5-1 with Councilmember Larson voting no. B. Audience Particination . 1. The following individuals addressed the Council regarding proposed Ordinance No. 9519, Agenda ltem VII.A.4: " Mike Bocatch - 111 H Street S.E., Auburn, WA Mike Bocatch is a resident of the city of Auburn. Mr. Bocatch's concern of the proposed Doctors' Clinic rezone application is that it is not consistent with the policies of the Comprehensive Plan. Mr. Bocatch read a letter submitted to the Coun¢il under agenda item II.C.1. He added that the appearance of an expanding clinic conflicts with the policy of maintaining a residential appearance within a single family neighborhood. . Allen Keimig - 216 A Street N.W., Auburn, WA Allen Keimig is the architect representing the Doctors Clinic. Mr. Keimig stated Health Care Providers' Insurance Companies are moving PAGE 3 • t ` CITY OF AUBURN GOUNCIL MEETING October 7, 1991 in the direction of requiring longer hours of operation. Mr. Keimig suggested the Council consider providing hours consistent with the . shopping center or from 7 a.m. to 9 p.m. in order to facilitate the insurance companies, and provide medica} services in this area. Herman Ansingh - 909 Sth Streef N.E., Auburn, WA Herman Ansingh works at the Doctors Clinic. Mr. Ansingh clarified working hours as agreed upon with the Auburn Hospital in 1969. He stated the Doctors' Clinic promised that they would not operate as an emergency service. Mr. Ansingh finalized his comments by stating the . proposed rezone will blend in well with the neighborhood as it exists today. 2. Marlea Hanson =.3107 L Street N.E., Auburn, WA , Marlea Hanson is the President of the Homeowners Association at River Park Estates. She asked direction with regard to their inquiry of their street situation. Mayor Roegner stated Mr. Shelton will respond xo her comments at the conclusion of the meeting. C. Corresnondence 1. ADnlication No. REZ0002-91CP 03:8, 03.4.4 Letter from Michael R. Bocatch to Steve Lancaster regarding Application No. REZ0002-91CP which is the request of the Doctors' Clinic to rezone property located at 625 12th Street S.E. from R-2 (Single Family) to C-i (Light Commercial) to expand the Doctors' Clinic. 2. Application No. CAP0003-91 John Stobbart submitted a written notation on the Notice of Public Hearing for the above referenced application stating the variance should be granted. 'Mr. Stobbart lives at 301 R Street N.E. III. COUNCIL COMMITTEE REPORTS A3.7.6 , A. Municinal Services Chairman Whittall.reported that the Municipal Services Committee met on September 30, 1991. Referring to the minutes of-September 30th, Chairman Whittall noted the city. is doing well with the. recycling program, and noted the municipal court ordinanee will be reviewed and presented to the Council at the October meeting. The next meeting of the Municipal Services Committee is scheduled for Monday, October 14, 1991 at 4:30 p.m. in Conference Room #1 located on the main floor of Auburn City Hall. B. Planning & Communitv Develoament `Committee member Brothers reported the Planning & Community Development Committee met on September 30, 1991 and the minutes are of PAGE 4 ~ CITY OF AiJBURN COUNCIL MEETING October 7, 1991 public record. The next meeting of the Planning & Community. Development Committee is scheduled for October 14, 1991. C. Public Works Vice-Chairman Burns reported the Public Works Committee met on September 16, 1991 at 4:30 p.m. He stated the committee 'meeting consisted of budget presentations from the Public Works staff. The next regular meeting scheduled for October 21, 1991 at 5:30 p.m. D. Finance Chairman Brothers reported that the Finance Committee met prior to the Council meeting tonight to review two interfund loans, and claims and payroll. The next meefing of the Finance Committee is scheduled for ' Monday, October 21, 1991 ar 7:00 p.m. IV. CONSENT AGENDA A. Minutes l. Minutes of the September 16, 1991 regular Council meeting. B. Vouchers F4.9.2, F4.9:5 1. Claim numbers 66633 through 67015 in tHe amount of $655,490.07 and dated October 7, 1991. 2. Payroll numbers 171103 through 171582 in the amount of $594,037.29 covering the period October 7, 1991. C. Interfund Loan F4.7 1. Request interfund loan in the amount of $100,000.00 for Solid Waste (Fund #434 from the Water Fund #430) at the rate of 6% for the period 3-1-91 to 12-31-91. 2. Request interfund loan for LID #344 (Fund 344) (West Main Street) in the amount of $11,000.00 from the Arterial Street Fund (#102), a non- interest bearing loan for the period 8-30-91 to 8-30-92. D. Annlication No. CUP0002-91 03.10.1 CUP0002-91 The request of Puget Sound Power & Light Company for a Conditional Use Permit to allow eonstruction, of an electrical substation to be known as "Peasley Substation" to be situated on property located at 1500 Industry Drive . S.W. ~ 1Vlotion by Councilmember'Burns, second by Councilmember Wagner to approve the Conditional Use Permit for an electrical substation based upon ' the Hearing Examiner's Findings of Fact, Conclusions and Conditions and to instruct the City Attorney to prepare the necessary ordinance. MOTION CARRIED UNANIMOUSLY. 6-0. VII. ORDINANCES AND RESOLUTIONS A. Ordinances . City Attorney Stephen Shelton read the titles to each ordinance. I. Ordinance No: 4516 05.2.1 White River Park, F5.29 An Ordinance of the City Council of the City of Auburn, Washington, approving an appropriation of grant funds and authorizing.the Mayor to execute, an agreement for project granT between the City and the Washington State Interagency Committee for outdoor recreation for construction of White River Park. Motion by Councilmember Burns, second by Councilmember Brothers to introduce and adopt. Ordinance No. 4516. MOTION CARRIED UNANIMOUSLY. 6-0. 2. Ordinance No. 4517 03.1 Applieation No: ANX0001-91 03.8 Application No. REZ0001-91 " An Ordinance of the City of Auburn; Washington, providing for the rezoning of property loeated at 3108 "A" Street S.E. within the City of Auburn, Washington,.changing the zoning classification thereof from King County S=R (Heavy Commercial) to C-3 (Heavy Commercial). Ordinance No. .4518 03.1 Application 1Vo. ANX0001-91 03.8 Application No. REZ0001-91 An Ordinance of the City of Auburn, Washington, annexing to the City certain land contiguous thereto, a 23,535 square. foot parcel of land located at 3108 "A" Street S.E. (The Sanchez Mazzeo Annexation). Motion by Councilmember Burns, second by Councilmember Brothers to introduce and adopt Ordinance No. 4518. MOTION CARRIED UNANIMOUSLY. 6-0. 4. Ordinance No. 4519 03.8 Application No. REZ0002-91CP 03.4.4 Map Amendment An Ordinance of the City of Auburn, Washington, providing for the rezoning of property located at 625 12th Street S.E. within the City of Auburn, Washington, changing the zoning classification thereof from R-2 (Single Family Residential) to C-1 (Light Commercial) and amending the Comprehensive Plan Map from Single Fami(y Residential to General Commercial. Motion by Councilmember Burns to approve Ordinance No. 4519 with an amendment to the hours of operation of the medical clinic on the rezoned property shatl be 8 a.m. to 9 p.m. Second by Councilmember Larson. Under discussion, Councilmembers Barber and Brothers both announced they had reviewed the transcript and hearing of the proceedings of the September 19, 1991 public fiearing held on the proposed rezone. Both members of the Council were unable to attend the September 19th meeting. Some of the :Couneilmembers commented on the hours of operation, traffic impacts, single family neighborhood transition to commercial, other commercial designated properties surrounding the proposed rezone, and parKing. Councilmember Whittall stated he continues to support the rezone of the proposed property, but disagrees with the hours of operation of the medical clinic on the rezone property as proposed. MOTION CARRIED. 4-2 with Councilmembers Whittall and Brothers . voting no. 5. Ordinance No. 4520 PAGE 7 . . ~ CITY OF AUBURN COUNCIL MEE'TING October 7, 1991 F5.2.6, 03.4.1.16 An Ordinance of the City Council of the City of Auburn, Washington, , amending Ordinance No. 4512, which had approved an appropriation of grant funds, by authorizing the Mayor to execute Amendment "A" to the approved grant contract to increase the total funds to be . reimbursed to the City from the Washington State Department of Community Development by the amount of seven hundred thirty-two dollars ($732) for a total amount of two thousand six hundred four dollars ($2,604) for an emergency management program. Motion by Councilmember Whittall, second by Councilmember Wagner to introduce and adopt Ordinance No. 4520.: MOTION CARRIED UNANIMOUSLY. 6-0. B. Resolutions Stephen Shelton read the titles to each resolution. 1. Resolution No. 2234 A3.13.4, 04.9::1 Street Improvement No. 246 A Resolution of the City Council of the Cify of Auburn; Washington, declaring surplus certain real property located to the South of 14th Street NE between "i" Street NE and Harvey Road and conveying said real property to Michael T. Reidy pursuant to King County Superior Court Cause No. 89-2-19087-7. Motion by Councilmember Burns, second by Councilmember Wagner to approve Resolution No. 2234. MOTION CARRIED. 5-1 with Councilmember Larson voting no. 2. Resolution No. 2237 02.8, F4.6 , A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to approve an interlocal agreement between tfie City of Auburn and the Cities of Kent, Renton and Tukwila for the joint purchase arid use of Ground Ladder Testing Equipment. Motion by Councilmember Whittall, second by Councilmember Barber to approve Resolution No. 2237. MOTION CARRIED UNANIMOUSLY. 6-0. 3. Resolution No. 2238 03.11, 03.11.2 " A Resolution of the City Council of the. City of Auburn, Washington, authorizing the Mayor and City Clerk of the City of Auburn, to execute a contract between the City of Auburn and Domestic A6use Women's Network (DAWN) relating to funds received from a porfion PAGE 8 . . „ CITY OF AUBURN COUNCIL MEETING October 7, 1991 of the King County Proposition No. 2 sales tax money to provide Domestic Violence Community Advocacy Services. Motion by Councilmember Burns, second by Councilmember Brothers to approve Resolution No. 2238. MOTION CARRIED UNANIMOUSLY. 6-0. 4. Resolution No. 2239 05:2 White River Trail System, A3.13 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to accept a Deed of Dedication from Puget Sound Power and Light Company conveying certain property to be used for recreational purposes. Motion by Councilmember Burns, second by Councilmember Brothers to approve Resolution No. 2239. MOTION CARRIED UNANIMOUSLY. 6-0. 5. Resolution No. 2240 05.2 White River Trail System, A3.13. A Resolution of the City Council of the City of Auburn, Washington, authorizing the 1Vlayor and City Clerk to execute an easement conveying certain property to Puget Sound Power and Light Company for a perpetual easement to be used to provide the right to construct and maintain electric transmission and/or distribution systems over and/or under the easement area. Motion by Councilmember Burns, second by Councilmember Brothers to approve Resolution No. 2240. MOTION CARRIED UNANIMOUSLY. 6-0. VIII. MAYOR'.S REPORT A. Executive Session - None. IX.
