CALL TO ORDER The regulai meeting of the City of Auburn Council was called to order by Mayor Bob Roegner at 7:30 p.m. in the City of Au6urn Council Chambers. A. Fla¢ Salute Mayor Roegner led those in attendance in the pledge of allegiance. B. Roll Call Those in attendance included Mayor Bob Roegnei and Councilmembers : Whittall, Wagner, Burns,. Larson, Brothers, Barber, and Kurle. Staff members in attendance included Fire Chief Bob Johnson, Parks & Recreation Director Len Chapman, Police Chief Jake Evans, Police Captain Ray Sherman, Public Works Director Frank Currie, Finance Director Pat Dugan, Planning Director Steve Lancaster, Senior Planner Lynn Rued, City Attorney Stephen Shelton, and City Clerk. Robin Wohlhueter. C. Announcements and Anoointments - None. 1. Announcements November 5, 1991 Election A3.10.13 91 Election Tomorrow is election day. Mayor Roegner announced that City Hall will be open to the public on Tuesday, November 5, 1991 to obtain election results beginning at 7:30 p.m. 2. Appointments - None. • D. Agenda Modifications A3.6.6. Mayor Roegner stated the agenda modifications have been referred to the Council from the Municipal Services Council Committee regarding Cable TV discounts for low-income senior citizens. Noted as additions to the Council, agenda are VII.A.1 Ordinanee No. 4524, VII.A:2 Ordinance No. 4525, and VII.B.3.a Resolution No. 2248. II. CITIZEN INPUT. PUBLIC HEARINGS &"CORRESPONDENCE A. Public Hearinas 1. Annlication No. COM0002-91* (Burns/Lancaster) 03.4.2.1 CITY OF AUBURN COUNCIL MEETING November 4, 1991 Amendments to the City of Auburn Comprehensive Plan text and map, as well as amendments to the City of Auburn Zoning Code and Zoning Map, regarding the adoption and implementation of the Auburn Adventist Academy Plan. Prior to opening the public hearing Mayor RoegneT suggested Senior Planner Lynn Rued make brief comments with regard to the development of the Auburn Adventist Academy Plan. Lynn Rued stated the establishment of the adoption of the 1986 Comprehensive Plan included six Special Planning Areas. Each of the Special Planning Areas would have a specific plan adopted that would be included within the Comprehensive Plan. Mr. Rued said the Auburn Adventist Academy Plan is designated as a Special Planning Area because of not oniy the academic and ehurch uses that exist, but because a number of other uses that are non-academic or non-church related. The uses include industrial uses, a small landing field for aircraft, agricultural, and residential. Mr. Rued stated the Auburn Adventist Academy Plan estalishes policies to guide future land uses that will occur within the Academy area. He said staff is recommending the primary use of the Academy be academic or church related. With adoption of this Plan the Academy Zoning will be "I", Institutional use, Policy considerations would be given with regard to future development of secondary uses such as industrial, residential, Academy Airport, and agricultural land uses. Mr. Rued discussed other non-academy uses, and utilities, traffic and streets related to the Auburn Adventist Academy Plan. Mr. Rued finalized his comments by explaining the public process used to develop the Auburn Adventist Academy Special Planning Area during.the last year. He also referred to a letter from the Academy requesting ctarification in the plan with regard to a maintenance facility on site. The Academy is asking that the maintenance facility not be considered industrial use as part of the ten acres devoted to industrial uses. Mayor Roegner acknowledged receipt of a letter noted under II.C. of these minutes. Mayor Roegner opened the public hearing. No one testified for 'or against Application No. COM0002-91. After three requests for public input, Mayor Roegner asked for a motion from the mem6ers of the Council. Motion by Councilmember Burns, second by Councilmember Brothers to close the public hearing. MOTION CARRIED UNANIMOUSLY. 7-0. PAGE 2 CITY OF AUBURN COUNCIL MEETING November 4, 1991 Mayor Roegner asked for questions from the members of the Council. . Discussion centered around the volume of aircraft and type of aircraft _ landing within the proposed plan, and clarification of the Academy Drive boundary that goes down into the valley. Motion by Councilmember Burns, second by. Councilmember Brothers to amend the Comprehensive Plan text and map, to include the proposed changes as indicated in the letter from Joyce Merry, to amend the Zoning Map and Chapter 18:44 of the Zoning Code for the purposes of adopting and implementing the Auburn Adventist Academy Plan and to instruct the City Attorney to prepare the necessary resolution and ordinance. MOTION CARRIED UNANIMOUSLY. 7-0. B. Audience Participation ' Raloh Darbv - 3607 Academy Drive, Auburn, WA 04.10.1, 04.9.6 Ralph Darby expressed concern with regard to speeding traffic on Academy Drive, street maintenance on the portion of Academy Drive that goes down the hill, and an,environmental concern of trash being dumped from Academy Drive down the hill towards the river. Mayor Roegner referred Mr. Darby to appropriate staff for action on his comments. Roar Fossum - 1404 lOth Street N.E., Auburn, WA 04.11.1 Water Improvement Na 167 & 188 04.6:3 Sewer Improvement No. 77 & 88 Contract No. 91-06 Roger Fossum comments centered around current eonstruction of new water and sewer mains. Mr. Fossum is a committee member who was appointed to work with the Mayor to consider financial options. Mr. Fossum expressed concern of the lack of notice, construction, and problems associated with claims being filed with regard to the construction project. C. Corresnondence 03.4.2.1.2 1. Letter to the Auburn City Council dated November 4, 1991 from Joyce Merry with regard to Application No. COM0002-91. III. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municipal Services Chairman Whittall reported that the Municipal Services Committee met on October 29, 1991 to discuss non-residential reeycling program, Ordinance No. 4524 and Ordinance No. 4525 with regard to rate discount to low- income senior citizens, and Ordinance No. 4521. which estabfishes the PAGE 3 CITY OF AUBURN COUNCIL MEETING ' November 4, 1991 Municipal Court. Finalizing his comments, Mr. Whittalf congratulated Chief Evans for being chosen to attend the FBI Academy Law Enforcement Executive Development Seminar (LEEDS) for two weeks in January, 1992. The next meeting of the Municipal Services Committee is scheduled for Tuesday, November 12, 1991 at 4:30 p.m. in Conference Room # 1 located on the main floor of Auburn City Hall. B. Planninp, & Communitv Development Chairman Burns reported the Planning & Community Development Committee has not met since the last Council meeting. The next meeting of the Planning & Community Development Committee is scheduled for Tuesday, November Tuesday, Noyember 12, 1991. C. Public Works Chairman Kurle reported the Public Works Committee met prior to the Council meeting this evening to discuss Resolution 1Vumbers 2251, 2250, 2198, and a street closure during the holiday season. The Committee recommends Resolution Numbers 2201 :and 2217 with regard traffic mitigation agreements be withdrawn from the agenda for further information. The next meeting of the Public Works Committee is scheduled for Monday, November 18, 1991. D. Finance Chairman Brothers reported, that the Finance Committee met prior to the Council meeting tonight to review claims and payroll. The next meeting of the Finance Committee is scheduled for 1Vlonday, November 18, 1991 at 7:00 p.m. : IV. CONSENT AGENDA A. Minutes 1. Minutes of the regular October 21, 1991 Council meeting minutes. B. Vouchers F4.9.2, F4.9.5 1. Claim numbers 67424 through 67764 in the amount of $369,461.68 dated November 4, 1991. 2. Payroll numbers 172085 through 172527 in the amount of $577,071.08 dated November 4, 1991. C. Utilitv Bill Adiustment. F4.5.2 l. Recommend approval of utility adjustment to account #143-0780 in the amount of $249,70, and account #231-1680 in the amount of $527.84. D. Liauor License A 5.6.1 City Council approval of a Class AC liquor license for Hoosier's Sports Cafe, Inc_ located at 2101 Auburn Way North. Anmlication No. CUP0003-91 03.10.1, Application No. CUP0003-91 The request of Jerry Barker for a Conditional Use Permit to allow the construction of a 20,861 square foot outdoor storage yard on property located on the south side of 15th Street N.W. in the 1400 block. Motion by Councilmember Burns, second by Councilmember Kurle to approve the Conditional Use Permit based upon the Hearing Examiner's Findings of Fact, Conclusions and Conditions and to instruct the City . Attorney to prepare the necessary ordinance. MOTION CARRIED. 6-1 with Councilmember Brothers voting na B. Aonlication_ No. CUP0004-91 03.10.1 CUP0004-91 The request of John F. Lindsay and Interstate Mobilephone Company for Conditional Use Permit to establish a cellular radio base station communications facility which includes a]00-foot talT tower on property zoned M-1 (Light Industrial) and located at 19 Clay Street N.W. Motion By Councilmember Burns, second by Councilmember Brothers to approve ihe Conditiona_l Use Permit based upon the Hearing Examiner's Findings of Fact, Conclusions and Conditions and to instruct the City Attorney to prepare the necessary ordinance. MOTION CARRIED UNANIMOUSLY. 7-0. C. Anplication No. PLT0001-91 03.5 PLT0001-91 . The request of Richard James for a Preliminary Plat to be known as "J. Rich" a seven lot single family subdivision consisting of 1.10 acres located on the east side of. M Street S.E. in the 3200-3300 blocks. Motion by Councilmember Burns, second by Councilmember Brothers to approve the Preliminary Plat based upon the Hearing Examiner's Findings of Fact, Conclusions ancl Conditions and to instruct the C_ ity Attorney to prepare the necessary resolution. Ordinances City Attorney Stephen Shelton read the titles to each ordinance. 1. Ordinance No. 4524 A3.5.5.13, F4.3, 04.1.5 An Ordinance of the City Council of the City of Auburn, Washington, amending Section 13.36.110 (Ordinance No. 3321) entitled,'CATV Systems" to allow a basic rate discount to low-income senior citizens. Motion by Councilmember Whittall, second by Councilmember Wagner to introduce and adopt Ordinance No. 4524. MOTION CARRIED UNANIMOUSLY. 7=0. 2. Ordinance No. 4525 F43, 04.1.5 An Ordinance of the City Council of the City of Auburn, Washington, amending Ordinance 'No. 3297 (passed July 21, 1978) amended by Ordi'nance No. 3325, passed October 16, 1978 and referred to in Resolution No. 1684, (passed May 19, 1986 and subsequent amendments) to amend the cable communications franchise to provide for a discount for basic cable service for low-income senior citizens. Motion by Councilmember Whittall, second by Councilmember Barber to introduce and adop.t Ordinance No. 4525. MOTION CARRIED UNANIMOUSLY. 7-0. B. Resolutions _ Stephen Shelton read the titles to each resolution. 1. Resolution No. 2198 04.8 . A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk of the City of Auburn to execute Storm Drainage Mitigation Agreement No. SEP0030-90 between the City of Auburn and B Street Associates. Motion by Councilmember Burns, second by Councilmember Kurle, second by Councilmember Burns to approve Resolution No. 2198. MOTION CARRIED UNANIMOUSLY. 7-0. 2. Resolution No. 2201 04.10 A Resolution of the City Council of the City of Auburn, Washingtbn, authorizing the Nlayor and City Clerk of the City of Auburn to execute Traffic Mitigation Agreement No. SEP0081-90 between the City of Auburn and Fiorito Brothers, Inc. Resolution Na 2217 04.10 A Resolution of the City Council of the City of Auburn, Washington, authorizing tHe Mayor and City Clerk of the City of Auburn to execute Traffic Mitigation Agreement No. SEP0030-90 between the City of Auburn and B Street Associates. This item was referred to the Public Works Committee for further review. a. Resolution No. 2248 A3.14 TCI, F4.3, 04.1.5 A Resolution of the City of Auburn, Washington, authorizing the Mayor and City Clerk of the City of Auburn. to execute an agreement with TCI Cablevision of Washington; Inc., to provide a retroactive rate discount for basic cable service to low income senior citizens. Motion by Councilmember Whittall, second by Councilmember Wagner to approve Resolution No. 2248. MOTION CARRIED UNANIMOUSLY. 7-0. 4. Resolution No. 2249 04.7.3 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk of the City of Auburn to enter inro an agreement with K ing County to provide county.funds to the City to implement a non-residential waste reduction/recycling program. Motion by Councilmember Whittall, second by Councilmember Wagner to adopt Resolution No. 2249. MOTION CARRIED UNANIMOUSLY. 7-0. 5. Resolution No. 2250 04.11 A Resolutiorr of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk of the City of Auburn to execute a water sales agreement between the City of Auburn and the City of Pacific. Motion by Couneilmem6er Kurle, second by Councilmember Burns to approve Resolution No. 2250. MOTION CARKIED UNANIMOUSLY. 7-0. 6. Resolution No. 2251 PAGE 7 CITY OF AUBURN COUNCIL MEETING November 4, 1991 03.4.1.2, 04.11 A Resolution of the.Ciry Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk of fhe City of Auburn to execute Addendum No, 2 to Water System Development and _ Acceptance Agreement between the City of Auburn P. Hendley & Associates, Inc., and Henderson Development, Inc. to provide for the expansion of the Lakeland Hills development and the water system (original agreement authorized by Resolution No. 1468 and Addendum No. 1 by Resolution No: 1922). Motion by Councilmember Kurle, second by Councilmember Burns to approve Resolution No. 2251. MOTION CARRIED UNANIMOUSLY. 7-0. VI11. MAYOR'S REPORT Councilmembers Reauest for Follow-up 04.9.6 04.11.1 Water Improyement No. 167 & 188 04.6.3 Sewer Improvement No. 77 & 88 Contracr No. 91-06 Councilmember Kurle requested a summary of the response to those questions and concerns raised with regard to Academy Drive under audience participation. Councilmember Brothers requested a status report of the Claim for Damages that are or will be filed with regard to construction of sewer and water improvements located in the area of lOth - 13th Street N.E. and M- O Street N.E. A. Executive Session Mayor Roegner recommended an Executive Session for approximately fifteen minutes with,regard to hospital litigation. Mayor Roegner stated no action will be required as a result of the Executive Session, and recommended adjournment. IX.
