CITY COUNGIL MEETING MINUTES
TEN „ i December 2, 1991 7:30 p.m. •
1. CALL TO ORDER
The regulax meeting of the City of Aubum Council was called to order by Mayor
Bob Roegner at 7:30 p.m. in the City of Aubum Council Chambers.
A. Flas Salute -
Mayor Roegner led those in attendance in the pledge of allegiance.
B. R l0 1 Call
Those in attendance included Mayor Bob Roegner and Councilmembers
Whittall, Wagner, Burns, Larson, Brothers, Barber, and Kurle. Staff
members in attendance, included Fire Chief Bob.Johnson, Pazks & Recreation
Director Len Chapman, Police Chief Jake Evans, Public Works Director
Frank Currie, Fina.nce Director Pat Dugan, Planning Director Steve
Lancaster, City Attorney Stephen Shelton, City Clerk Robin Wohlhueter,
Deputy City Clerk Gayle Butcher, Police Lieutenant Mark Wentworth, and
Personnel Analyst Ken Irons.
C. Announcements and Annointments
1. Announcements
a. Council Meeting
Mayor Roegner announced that the regularly scheduled December
16, 1991 Gity Council meeting will be rescheduled to meet on
Tuesday, December 17, 1991.
b. Christmas Tree
A1.12
Mayor Roegner announced the Christmas Tree, which is donated
annually by the City's elected officials, was placed in the lobby of
City Hall today. The tree is used for the Tree of Giving, and it
will be ready la.ter this week for those who wish to participate in
this season's giving to the needy. Mayor Roegner expressed his
thanks to the Council for contributing the Tree of Giving.
c. Proclamation

Mayor Roegner presented to the Aubum High School Girls
Volleyball team a proclamation honoring them for the second
place standing in the state finals. Mayor Roegner expressed his
pride in the team's accomplishment; and stated they were a credit
to the community. Team members include, Kristi Dray, Nancy
Konsmo, Karen Reimer, Dana Beard, Melissa Blaschke, Jennifer

Mayor Roegner announced that the agenda modifications appear under II.C
which transmits two letters as additions to this evenings agenda item VI.A,
the request of Myron and Madeleine Massey for a Conditional Use permit to
allow 40 mechanical amusement devices as part of a family oriented, sports
theme, entertainment facility to be known as "Auburn Family Sports Center"
to be located at 340 East Main Street.
II. CITIZEN INPUT. PUBLIC HEARINGS & CORRESPONDENCE
A. Public Hearinas
1. 1992 Preliminarv Budget
F3.6, 1992 Preliminary Budget
The 1992 Preliminary Budget and Budget Me"ssage are available for
public inspection and may be examined by any taxpayer. At this time,
the Mayor and Auburn City Council invite all citizens to provide the
Council with written and oral comments and to ask questions
concerning the City of Auburn's entire proposed 1992 Budget.
Mayor Roegner opened the public hearing.

Ms. Clyde indi-cated she had not attended any public hearings or
reviewed the 1992 Preliminary Budget, but wished to know if
- additional police officers were part of the 1992 Budget. Mayor
Roegner responded that rive additional police officers had been
approved during the 1991 Budget process, and that five additional fire
fighters are included in the 1992 Budget: Ms. Clyde quesdoned
whether the five additional fire fighter§ were currently at the fire -
fighters academy. Mayor Roegner explained the 1992 Budget begins
January lst, and that fire fighters must be on staff prior to being sent
to the academy.

Mr. Poe expressed his concem in not receiving a copy of the 1992
Preliminary Budget: prior to this evening's meeting and questioned

storm sewer revenues, operating expenses, and how much will be spent
on capital expenditures in 1992.
Mayor Roegner indicated Finance Director Pat Dugan had a copy of
the 1992 Preliminary Budget available this evening.
There were no further requests to speak for or against the 1992
Budget.
Motion by Councilmember Brothers, second by Councilmember Barber
_ to close the public hearing.
MOTION CARRIED UNANIMOUSLY. 7-0.
Finance Director Pat Dugan addressed Mr. Poe's questions with regazd
to anticipated revenue for the storm sewer ufility in 1992, and of that
amount, what portion will be spent on operating and capital
expenditures. He said in 1992 the city expects to receive $2 million in
revenue for the storm sewer utility. The city expects to expend $2.5
million on capital projects, and $1.1 million for operating expenses.
Mr. Dugan further noted the balance for capital expenses is
supplemented by anticipated bond sales.

Mr. Sprenger expressed his sentiments regarding economic conditions at both
the city; county,, state, and federal levels. He further questioned why, under
these economic dmes, mining operations at Miles Sand and Gravel Company
have stopped. Even though both positions present strong arguments over the
confinued mining activity, he encouraged the city officials to open
communication with Miles Sand and Gravel Company in order to work out
differences.
Jim Shack. 2808 A Street SE. Aubum. WA
Mr. Shack, President of Utility Vault Company, stated he has lived and
worked in this community since 1960. Utility Vault employs eighty-five
employees, and is located in Aubum. Mr. Shack expressed concern, as an
industrial manufacturer, with.the closure of the mining activity at Miles
Sand and Gravel Company because it effects ecomomically many businesses
within the community including Utility Vault Company. Mr. Shack asked
the Council to reconsider their decision to prevent mining activity at Miles
Sand and Gravel.

Mr. Shaughnessy expressed concern regard to recent newspaper articles
published with regard to Miles-Sand and Gravel Company. Mr. Shaughnessy
discussed the extension of R Street into Ar!Iile"s Sand and Gravel Company
property.

Mr. Lisko, President of Cascade Community Bank, requested the Council
consider the economic benefits of those entides such as Miles Sand and
Gravel Company, that go back into the community are substantial.
Mr. Van Selus - 20 Riverview Drive, Aubum, WA
Mr. Van Selus, resident and business owner, stated that Miles Sand and
Gravel Company has been in the community for a long time, and he urged
the city officials to give greater considera.tion to businesses, employees, and
citizens in Auburn. In a move to strengthen what is best for all of the
citizens of the community, he further urged city officials establish a
committee to reestablish the philosophy of service and to encourage
communication and redefine Aubum's direcdon. Mr. Van Selus asked the
citizens in the audience to stand if they supported this position.

Mr. Lloyd expressed sympathy for Miles Sand and Gravel Company working
relationship with the city. He indicated that he had a personal experience
with shut down notices on the west hill gravel pit, and the lenghtly permit
process that results in poor communications and misunderstandings.
Dave Elmore. resident of Renton. WA
Dave Elmore lives in Renton. He is attending the Council meeting after
reading the paper regarding Miles Sand and Gravel Company. Mr. Elmore
expressed concern with the action taken on Miles Sand and Gravel Company.
Virgina Haugen. 2508 R Street SE. Auburn. WA
Ms. Haugen expressed her thanks to Police Chief Evans for the high police
visibility in her neighboihod recently. She indicated many of her neighbors
were ticketed, herself included, but that she felt the dckets were warranted.
She stated she hoped the public safety departments would keep pace with
Auburn's growth.
Ms. Haugen also questioned if the city owned approximately 65 acres on the
West Valley Highway. Finance Director Pat Dugan responded that the
property she was referring to is an LID foreclosure that the city only has
temporary custody. The city will have to sell the property to pay the bond
holders, or pay the 6ond holders out of tax money.
Ms. Haugen also expressed her concern for the condidons at the Library.
She encouraged city staff to apply for grant monies that may be available to
modernize the Library.
Ms. Haugen also informed the Council she had recently received a letter
from.an Auburn High School student. Based upon this letter, Ms. Haugen is
requesting that condom machines be placed in the Auburn High School. Ms.
Haugen read a November 26, 1991 Seattle Parent Teachers Association
recommendation made to the Seattle School Board, and she felt'this
recommendation had merit for the youth of, Aubum.

Ms. Haugen also added her support of Miles Sand and Gravel remaining an
operation in Auburn.
There were no further requests from the audience to address the Council.
Mayor Roegner announced that. Miles Sand and' Gravel was not an agenda
issue before the Council this evening. He indicated there would be future
public hearing opportunities for citizens to express their concern either by
speaking at a public hearing or by submitting written conespondence. Those
interested in knowing when Miles Sand and Gravel will be scheduled
hearings should contact the Planning Department or the City Clerk's office.
Planning Director Steve Lancaster indicated ttie Hearing Examiner's meeting
would be later this month.

III. COUNCIL COMMITTEE REPORTS

A. Municinal Services
Chairman Whittall reported that the Municipal Services Committee has not
met since the November 12, 1991 meeting. The next Municipal Services
meeting is scheduled for December 9, 1991 at 4:30 p.m. in Conference Room
#1 located on the main floor of Auburn City Ha1L
B. Planning & Communitv Develonment
Chairman Burns reported the Planning & Community Development
Committee did not meet during the month of November. The next meeting
of the Planning & Community Development Committee is scheduled for
December 9, 1991 at 7:30 p.m.

Chairman Kurle reported the Public Works Committee met prior to the
Council meeting this evening to discuss those items appearing on tonight's '
agenda. The next meeting of the Public Works Committee will be
rescheduled for Tuesday, December 17, 1991 at 5:30 p.m.
D. Finance
Chairman Brothers reported that the Finance Committee met prior to the
Council meeting tonight to review those items on this evening's agenda,
including claims and payroll. Chauman Brothers also requested Finance
Director Pat Dugan respond to budgetary quesdons asked by Mr. Morchin
during the Finance Committee meeting. Tlie next meeting of the Finance
Committee will be rescheduled for Tuesda.y, December 17, 1991 at 7:00 p.m.

1. Minutes of the November 18, 1991 regular Council meeting.
2. Amendment to the July 1, 1991 July 15, 1991 regular Council
meeting minutes under Council Agenda Item IV.B.2 changing the
dollar amount approved for payroll vouchers in the amount of
$601,477.79.

VI. NEW BUSINESS

The request of Myron and Madeleine Massey for a Conditional Use Permit
to allow 40 mechanical amusement devices as part of a family oriented,
sports theme, entertainment facility to be known as "Auburn Family Sports
Center" to be located at 340 East Main Street.
Councilmembers noted the correspondence received under agenda
modifications this evening raised some issues of concem. After discussion,
it was noted that the skateboarding concern as indicated in Mr. Marchin's
conespondence does not require a modification to the Hearing Examiner's
findings since Aubum Family Sports Center to be located at 340 East Main Street is within the Central Business District, which is an azea already
covered by ordinance prohibiting skateboarding on public property.
However, city staff will consider the possibility of posting the area.
Councilmembers also expressed concern regarding enforcement needs.
Planning Director Lancaster explained there are civil penalties available
should zoning code violations occur. Planning Director Lancaster also
indicated that a Coaditional Use Permit transfers with new ownership.
: Police Chief Evans also indicated his department will patrol the area as
frequently as patrol time permits.
. Councilmembers Burns and Brothers expressed support of the application in
providing an entertainment center for the youth of the community.
Motion by Councilmember Burns, second by Councilmember Brothers, to
aprove the Conditional Use Permit based upon the Hearing Examiner's
Findings of Fact, Conclusions and Conditions and to instruct the City
Attorney to prepare the necessary Ordinance.
MOTION CARRIED UNANIMOUSLY. 7-0.
VII. ORDINANCES AND RESOLUTIONS
A. Ordinances .
City Attorney Stephen Shelton read the titles to each ordinance.

04.6.2, F4.3, A1.7, A3.5.5.13
An Ordinance of the City of Auburn, Washington, amending Aubum
City Code 13.20.440 -entitled fees and charges to incorporate an
increase in sewer rates to implement the Metro wholesale rate increase
and to offset inflation=related increases in operating expense which
have occurred since 1990.

An Ordinance of the City Council of the City of Auburn, Washington,
adopting the 1992 Budget for the City of Auburn, Washington.
Motion by Councilmember Brothers, second by Councilmember
Whittall to introduce and adopt Ordinance No. 4530.
MOTION CARRIED UNANIMOUSLY. 7-0.
3. Ordinance No.- 4532

An Ordinance of the City of Aubum, Washington, amending Codified
City Ordinance 13.04.360 pertaining to City of Auburn water rates.
Motion by Councilmember Kurle, second by Councilmember Burns to
introduce and adopt Ordinance No. 4532.
MOTION CARRIED UNANIMOUSLY. 7-0.

There were no resolutions to be considered.
