A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF AUBURN, WASHINGTON DECLARING
CERTAIN REAL PROPERTY AS NO LONGER
NEEDED FOR UTILITY PURPOSES, DECLARING A
PORTION OF THAT PROPERTY AS SURPLUS,
AND AUTHORIZING ITS DISPOSAL
WHEREAS, the City of Auburn owns a certain piece of real property
identified as King County Tax Parcel Number 0004000098 and commonly known
as 3460 1 Street NE, Auburn, Washington 98002 that was originally purchased
for use by the City's Stormwater Utility ("Storm Utility Property"), and
WHEREAS, City staff has notified the City Council that that a portion of
this property is no longer needed for stormwater purposes; and
WHEREAS, after additional study the City has amended its
Comprehensive Stormwater Drainage Plan in 2011, to recognize that the entirety
of the 31 5-acre Storm Utility Property is no longer needed for stormwater
management purposes, and
WHEREAS, as required by RCW 35 94 040, the City held a public hearing
on the matter of whether the Storm Utility Property is no longer required for utility
purposes; and
WHEREAS, in connection with the King County Flood Control District's
Reddington Levee Setback and Extension Project ("Levee Project"), a mobile
home park located north of the Storm Utility Property will lose approximately 16
mobile home spaces for its residents due to acquisition for the Levee Project
construction, and the owner of that mobile home park has approached the City

with a request to purchase an adjacent portion of the Storm Utility Property in
order to continue to provide housing options to the park's residents; and
WHEREAS, an additional portion of the Storm Utility Property not sold to
the mobile home park will be used to replace City park property that is also being
displaced by the Levee Project in order to meet the restrictions of the original
purchase of the city park property; and
WHEREAS, it would be appropriate to surplus the portions of the Storm
Utility Property no longer needed for utility purposes and dispose of those
portions by auction or other sale mechanism, or to dispose of those portions, in
whole or in part, through gift to another governmental agency or an appropriate
charitable non-profit entity, as deemed most expedient by the Mayor
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON HEREBY RESOLVES as follows.
Section 1. That the portions of the Storm Utility Property identified below
are declared to no longer be required for utility purposes. Additionally, those
portions of the Storm Utility Property are hereby declared to be surplus.
Section 2. The Mayor is authorized to dispose of all or a portion of the
Storm Utility Property described as.

Section 3. That the portion of the Storm Utility Property described in
Exhibit 1 that is to be sold to the mobile home park shall be sold for a price to be
negotiated through a purchase and sale agreement that shall be approved by
separate Resolution.
Section 4. That the portion of the Storm Utility Property described in
Exhibit 2 shall be transferred in the records of the City to the City's Parks, Arts
and Recreation Department. The City Council finds that the transfer of the
obligation to manage the property, along with the continued use of some of the
property for stormwater conveyance, treatment, and storage purposes is
adequate consideration to the City's Stormwater Utility for the transfer
Section 5. That the Mayor is authorized to implement such administrative
procedures as may be necessary to carry out the directives of this legislation.
Section 6. That this Resolution shall take effect and be in full force upon
passage and signatures hereon.
