MINUTES
I. CALL TO ORDER
A. Roll Call
Deputy Mayor Wagner called the Council Operations Committee
meeting to order at 4:03 p.m., in the Council Conference Room at
Auburn City Hall, 25 West Main Street in Auburn.
Members in attendance included Chair Rich Wagner, Vice Chair Bill
Peloza and Member Largo Wales. Also in attendance were Mayor
Nancy Backus, City Attorney Daniel B. Heid, Human Resources and
Risk Management Interim Director Rob Roscoe and Deputy City Clerk
Shawn Campbell.

II. CONSENT AGENDA

Vice Chair Peloza moved and Member Wales seconded to approve
the November 18, 2013 Special Meeting minutes, the December 2,
2013 minutes and the January 2, 2014 Special Meeting minutes.
MOTION CARRIED UNANIMOUSLY. 3-0
III. DISCUSSION ITEMS
A. Council Compensation
Chair Wagner provided the Committee with updated spreadsheets
regarding council compensation for neighboring jurisdictions, one with
and one without benefits. He believes a councils pay should be based

on a city's population. The City of Auburn is below average based on
the chart with benefits and average based on the chart without
benefits.
Member Wales stated she requested this information be brought
before the Finance Committee. There are two ways a Council can
change their pay. One is for the Council itself to set a new rate of pay.
The pay rate would not be effective until each councilmembers'
current term expires. The second is to create a Council Compensation
Commission. The Council would have no say in the Commissions
decision and it would become effective for all councilmembers once
the Commission makes a determination. The Commission may
increase or decrease the Councils rate of pay. If the City wants to
attract younger councilmembers the City will need to increase the pay.
The City needs to ensure they do not fall behind neighboring
jurisdictions in council compensation.
Vice Chair Peloza stated he does not want one councilmember to be
paid more than another. He would prefer the Compensation
Commission so everyone has the same rate of pay at the same time.
It is important to be fair for all councilmembers.
Committee members discussed how a Council Compensation
Commission would be selected. The Committee would prefer to have
the authority to confirm the members one by one.
City Attorney Heid confirmed the City Council would have no role in
accepting or rejecting the decision of the Commission. If the City
Council creates a Council Compensation Commission it would be a
standing committee and their decision would be final.
Chair Wagner requested a draft ordinance be added to the next
Council Operations Committee agenda for discussion.
B. Council Rules and Procedures
Chair Wagner inquired if Committee members would like to review
guidelines for council committee agenda items.
Member Wales stated she would like clarification on the workflow of
each agenda item as it goes through committee review.
The procedure will need to be flexible enough to allow for urgent
matters.
Chair Wagner stated a committee chair can add any item to their
agenda for discussion. The action committee is primarily set by the
roles and responsibilities of each committee.

City Attorney Heid confirmed an item is not required to go before two
committees.
Mayor Backus stated not all items go through two committees some
items do not even go through one. She recommended the Council
not create strict rules and regulations regarding how an item is
forwarded to full Council for consideration. The process changes with
the makeup of the committees and the Council.
The Committee requested the resolution establishing the time
and date for the Council Operations Committee me amended to hold
the meeting on the fourth Monday of each month at 2:30 p.m. The
Committee also discussed the primary roles and responsibilities of
each committee. The Committee requested the 2014 Council
Committee areas of influence chart be updated an returned at the next
meeting for additional discussion.
IV. ADJOURNMENT
There being no further business, the meeting adjourned at 4:57 p.m.

City Council adopt Resolution no. 5054.
Background Summary:
The City Council Operations Committee designates the formation and membership of
the standing committees of the City Council, subject to approval of the City Council.
On December 3, 2013, the City Council adopted Resolution No. 5017 establishing the
standing committees for 2014. At their meeting on March 24, 2014, the Council
Operations Committee approved changes to the meeting date and time for the Council
Operations Committee to the fourth Monday of the month at 2:30 p.m. to avoid conflicts
with meeting schedules.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
AUBURN, WASHINGTON, AMENDING RESOLUTION NO. 5017
OF THE CITY COUNGIL OF THE CITY OF AUBURN,
WASHINGTON, PASSED DECEMBER 3, 2013, RELATING TO
THE STANDING COMMITTEES OF THE CITY COUNCIL OF THE
CITY OF AUBURN
WHEREAS, the Auburn City Council Operations Committee designates the
formation and membership of the standing committees of the City Council, subject to
the approval of a majority of the City Council; and
WHEREAS, on December 3, 2013, the Aubum City Council passed
Resolution No. 5017 relating to the standing committees of the City Council of the
City of Aubum; and
WHEREAS, Resolution No. 5017 was amended by Resolution No. 5034 on
January 2, 2014; and
WHEREAS, the Council Operations Committee conducted a meeting on
March 24, 2014], at which time the Committee approved changes to the mee4ing
time for the Council Operations Committee and recommended the City CounciPs
adoption of the same.

Article II
Section 8 Compensation - Reimbursement:
(1) The Mayor’s and Judge’s compensation may be increased during a term of office by
ordinance.
(2) There is hereby created the Bremerton Citizen’s Commission on Council Salaries pursuant
to RCW 35.21.015 appointed as provided herein to set the salary of the Council members.
(a) The Commission shall consist of three (3) members who shall be registered voters and
residents of the City of Bremerton. No City officer, official, or employee or immediate family member of
any City officer, official or employee shall be eligible for membership on the Commission. As used in this
section, "immediate family member" means parents, spouse, siblings, children or dependent relative of
the officer, official or employee whether or not living in the household of the officer, official or
employee.
(b) Commission members shall be appointed by the Mayor, subject to approval of Council.
(c) Commission members shall be appointed for three year staggered terms of office.
Commission members may not be appointed to more than two terms.
(d) No member shall be removed during his or her term of office unless for cause of incapacity,
incompetence, neglect of duty or malfeasance in office or for a disqualifying change of residence.
(e) Upon a vacancy in any position on the Commission a successor shall be appointed to serve
the unexpired term. The appointment shall be made in the same manner as for original appointments.
(f) The members of the Commission shall receive no compensation for their services but shall
receive reasonable reimbursement for their expenses in accordance with state law and city ordinance.
Staff shall be assigned to the Commission to provide support for its work.
(3) The Commission authority and responsibility shall be as follows:
(a) The Commission shall study the relationship of salaries to the duties of the City Council
members and shall fix a salary for each such position by an affirmative vote of not less than a majority of
the commission.
(b) Except as approved in this section, the Commission shall be solely responsible for its own
organization, operation and action and shall enjoy the fullest cooperation of all City officers, officials,
departments and employees. The Commission shall have access to all City books, papers, documents
and accounts applying or in any way concerning the subject matter of this section.
(c) The members of the Commission shall elect a chairperson from among their number every
two years.
(d) The Commission shall file any change in its schedule of salaries for the positions of City
Council members with the City Clerk by July 1st of the applicable year so as to coincide with the City
budget cycle.
(e) Each schedule shall become effective thirty days after filing with the City Clerk. Salary
decreases established by the Commission shall become effective as to incumbent City Council members
at the commencement of their next subsequent terms of office. Such schedule shall be subject to
referendum in the same manner as provided by Section 34 of this Charter.
(f) Prior to the filing of any salary schedule the Commission shall hold no fewer than two public
hearings thereon within the four months immediately preceding the filing.
(g) Signature of the chairperson of the Commission shall be affixed on each schedule
submitted to the City Clerk.
(4) The Mayor, Municipal Judge and Council members shall receive reimbursement for their
necessary expenses incurred in the performance of the duties of their office as provided to City

There is hereby established a Federal Way independent salary commission hereinafter referred
to as the independent salary commission.(Ord. No. 03-439, § 3(i), 3-18-03. Code 2001 § 2-95.8.)
2.80.020 Purpose.
The purpose of the independent salary commission shall be to review and establish the salaries
of the mayor and the councilmembers. (Ord. No. 03-439, § 3(ii), 3-18-03. Code 2001 § 2-95.9.)
2.80.030 Membership.
(1) The independent salary commission shall consist of five members appointed by the mayor
and approved by the city council.
(2) The independent salary commission shall serve without compensation.
(3) Each member of the independent salary commission shall serve a term of four years, except
that the first five commission members shall be appointed for different terms, as follows: one member
to serve for a period of one year, one member to serve for a period of two years, one member to serve
for a period of three years, and two members to serve for a period of four years. The mayor, with the
approval of the city council, may appoint alternate independent salary commission members as the
need arises. The city council shall annually appoint new members in March to fill the expiring terms on
the independent salary commission.
(4) No member may be appointed to more than two terms on the independent salary
commission whether or not those terms are held consecutively.
(5) If, for any reason, a vacancy occurs during the term of an independent salary commission
member, the mayor shall appoint, with the approval of the city council, a new member to fill the
unexpired term of that member.
(6) The city council may remove an independent salary commission member at any time for
cause of incapacity, incompetence, neglect of duty, or malfeasance in office or for a disqualifying change
of residence.
(7) All members of the independent salary commission shall serve until their successors are duly
appointed by the mayor and approved by the city council. (Ord. No. 03-439, § 3(iii), 3-18-03. Code 2001
§ 2-95.10.)
2.80.040 Qualifications.

(1) No person shall be appointed to serve as a member or alternate member of the independent
salary commission unless that person is a citizen of the United States, a resident of the city for at least
one year immediately preceding such appointment, and an elector of the country in which the member
resides.
(2) No city officer, official, or employee of the city or any of their immediate family members
may serve on the commission. “Immediate family member,” as used in this section, means the parents,
spouse, siblings, children, or dependent relatives of the officer, official, or employee, whether or not
living in the household of the officer, official, or employee. (Ord. No. 03-439, § 3(iv), 3-18-03. Code 2001
§ 2-95.11.)
2.80.050 Operation.
(1) The independent salary commission shall elect a chair and vice chair from among its voting
members. Such officers shall hold office for two years. The independent salary commission may from
time to time establish and publish rules of procedure for the efficient and fair conduct of its business,
consistent with state law and city ordinance.
(2) The mayor shall appoint appropriate staff to assist the independent salary commission in
preparation of its reports and records as are necessary for the proper operation of the commission.
(3) The independent salary commission shall keep a written record of its proceedings, which
shall be a public record all in accordance with state law, and shall actively solicit public comment at all
meetings which shall be subject to the Open Public Meetings Act pursuant to Chapter 42.30 RCW.
(4) The independent salary commission shall meet at least once in 2003 and in each even year
thereafter to consider whether or not to review and/or adjust existing salaries. This meeting shall occur
no later than April 30th, in any given year, and the commission shall review and, if it so determines,
amend and file its schedule of salaries with the city clerk no later than May 31st. If necessary, the
commission will also meet upon any other call by the chair, the mayor or by the majority vote of the city
council.
(5) Three members shall constitute a quorum, and the votes of three members shall be
sufficient for the decision of all matters and the transaction of all business to be decided or transacted
by the independent salary commission. (Ord. No. 10-669, § 19, 9-21-10; Ord. No. 03-439, § 3(v), 3-18-03.

2.80.060 Responsibilities.
The independent salary commission shall have the following responsibilities:
(1) To study the relationship of salaries to the duties of the mayor and the city councilmembers
and to establish a salary by either increasing or decreasing the existing salary for each position by an
affirmative vote of not less than three members;
(2) To review and file its salary schedules not later than May 31, 2003, and every even year
thereafter;
(3) To submit each salary schedule to the city clerk, who will publish the complete schedule two
times, at least one week apart. The second publication date will be the official filing date. The schedule
will become effective 30 days after this date. (Ord. No. 03-439, § 3(vi), 3-18-03. Code 2001 § 2-95.13.)
2.80.070 Effective date – Salaries.
The commission’s established or amended salary schedule will become effective in the amounts,
at the times, and under the conditions established in the schedule. Once filed, the schedule shall be
incorporated into the city budget without further action of the city council or salary commission. Salary
increases established by the commission shall be effective as to the mayor and all city councilmembers
regardless of their terms of office. Salary decreases established by the commission shall become

effective as to incumbents at the commencement of their next subsequent terms of office. Existing
salaries for the mayor and councilmembers established by city ordinance and/or city budget shall
remain in effect unless and until changed in accordance with the provisions of this chapter. The terms
and conditions of the commission’s adopted salary schedule will remain in effect until amended under
the terms and conditions of a new salary schedule filed in accordance with this chapter. (Ord. No. 03-

2.80.080 Salary schedule subject to referendum petition.
(1) The commission’s adopted salary schedule shall be subject to referendum petition by the
people of the city in the same manner as a city ordinance upon filing of such petition with the city clerk
within 30 days after the official filing date of the salary schedule. In the event of the filing of a valid
referendum petition, the salary increase or decrease shall not go into effect until approved by vote of
the people.
(2) Referendum measures under this section shall be submitted to the voters of the city at the
next following general or municipal election occurring 30 days or more after the petition is filed and
shall be otherwise governed by the provisions of the State Constitution or other laws generally
applicable to referendum measures. (Ord. No. 03-439, § 3(viii), 3-18-03. Code 2001 § 2-95.15.)

There is hereby created a city of Puyallup council salary commission. The word “commission”
shall be deemed to mean the city of Puyallup council salary commission whenever used in this chapter.
(Ord. 3001 § 1, 2012).
2.05.020 Commission membership.
(1) The membership of the commission shall consist of five members.
(2) Each member shall be a resident of Puyallup.
(3) Each member shall be a registered voter.
(4) Members shall serve without compensation.
(5) Officers, officials, and employees of the city and their immediate family members shall not
be eligible to serve on the commission. For the purposes of this section, “immediate family member”
shall mean a parent, stepparent, in-law, spouse, sibling, stepsibling, child, stepchild, or dependent
relative of the officer, official, or employee, whether or not living in the household of the officer, official,
or employee. (Ord. 3001 § 1, 2012).
2.05.030 Appointment of members – Terms.
(1) Members of the commission shall be appointed by the mayor, subject to confirmation by the
council.
(2) Prior to consideration for appointment, each candidate shall complete the form entitled
“Biographical Information for Appointed Citizen Boards/Commissions/Committees,” or any similar form
as required by the council.
(3) Members shall serve a full two-year term, or the remainder of an unexpired term, as the case
may be.
(4) No person shall serve more than two two-year terms. Unexpired terms shall not count
toward this limitation, except when a membership position becomes vacant while the person holds the
position. The two two-year term limit shall not be construed to create an entitlement to a second term
of membership on the commission.
(5) Each term that is unexpired at the time of adoption of this chapter shall be extended to
expire at the end of the first Tuesday in March that follows the term’s currently scheduled expiration.
Thereafter, the two-year term of a member shall commence on the first Wednesday in March and shall
expire two years thereafter at the end of the first Tuesday in March.

(6) Terms shall be staggered in such a manner that three terms shall expire in one year, two
terms in the next year. (Ord. 3001 § 1, 2012).
2.05.040 Resignation, removal and vacancy.
(1) Pursuant to RCW 42.12.020, a member resignation shall be made to the city council. In
accordance with RCW 42.12.010(2), a member resignation shall be deemed to occur upon the effective
date of the resignation.
(2) Members may be removed prior to the expiration of their term by a majority vote of the city
council but only for cause of incapacity, incompetence, neglect of duty, malfeasance in office, or for a
disqualifying change in residence or voter status.
(3) A commission position shall become vacant for the same reasons applicable to elective
offices in Chapter 42.12 RCW and council positions in RCW 35A.12.060.
(4) Prior to a third consecutive absence, a member may request that the commission excuse one
or more absences. The commission shall determine the validity of the request, and approve or deny the
request.
(5) Vacant positions shall be filled by mayoral appointment, subject to confirmation of the
council. (Ord. 3001 § 1, 2012).
2.05.050 Meetings.
(1) The commission shall meet no less than three times each year: once during the months of
February or March; once during June or July; and at least once during the months of October or
November of each year. Additional meetings may be scheduled by the chair of the commission or by a
majority vote of the commission. At least one of the meetings shall include a public hearing to provide
an opportunity for the public, the mayor, deputy mayor, or city council members to address the
commission.
(2) Meetings of the commission shall be open and public pursuant to Chapter 42.30 RCW and
shall be held in the same location as that of regularly scheduled council meetings, unless the public
notice for any meeting specifies another location.
(3) A quorum for conducting business shall be a simple majority of the membership of the
commission.
(4) Robert’s Rules of Order shall govern commission meetings, and the commission may adopt
additional suitable rules of procedure.
(5) The public shall be notified of upcoming commission meetings and the preliminary agenda
for each meeting. Such notice may include, but is not limited to, written notification to the city’s official
newspaper, publication of a notice in the official newspaper, posting of upcoming meeting agendas, or
such other processes as the commission determines will satisfy the intent of this requirement. (Ord.
3001 § 1, 2012).
2.05.060 Officers.
(1) The commission shall elect from among its membership a chairperson and vice chairperson,
and such other officers as it deems necessary. The term of office shall be one year. Officers shall be
elected at the first meeting that occurs on or follows the first Wednesday in March.
(2) The chairperson shall preside at meetings and shall rule on all points of procedure.
(3) If the office of the chairperson becomes vacant, the vice chairperson shall assume the
responsibilities of said office and shall serve in said capacity until the commission elects officers during
the next term. In the event such a vacancy occurs, the commission shall elect a new vice chairperson
who shall serve until the commission elects officers during the next term. (Ord. 3001 § 1, 2012).

2.05.070 Powers and duties.
(1) The commission shall have the authority to raise and lower salaries of the council. A council
salary increase or decrease shall occur only if members, numbering a majority of the whole commission,
vote in favor of the increase or decrease.
(2) Prior to a commission vote to raise or lower salaries, residents of the city shall have an
opportunity to comment or submit comments in writing. An opportunity for comments shall be
conducted in a manner that is consistent with the procedure used at regularly scheduled meetings of
the council.
(3) Prior to a commission vote to raise or lower salaries, the commission may request additional
financial information and other relevant data, other than that information provided in subsection (4) of
this section, from the city manager, who shall be responsible for providing staff support to the
commission.
(4) The city manager shall provide the commission with, and the commission shall consider,
information regarding salaries paid to city council members from comparable cities. Such comparables
shall be comprised of cities with a council-manager form of government and have populations over
25,000 but less than 100,000 and be located in King, Kitsap, Pierce or Snohomish Counties. The
comparables shall include the following cities, provided such list may be modified and updated by
resolution of the city council on an annual basis to ensure that cities qualify as comparable cities
through application of the formula set forth in this subsection: Burien, Des Moines, Federal Way,
Kirkland, Lakewood, Puyallup, Sammamish, SeaTac, Shoreline and University Place. In addition, council
member salary data shall be collected from the cities of Auburn and Renton and included as part of the
comparable cities information.
(5) A decision by the commission to raise or lower the salary of the council shall be final, shall be
filed with the city clerk, and shall be incorporated into the city budget without further action of the
council or commission. Any change of salary by the commission shall supersede any ordinance or
resolution in effect at the time the salaries are changed but only to the extent of such conflict.
(6) Salary increases established by the commission shall immediately be applied to the salaries
of all members of the council, regardless of the remaining portion of their term of office.
(7) Salary decreases established by the commission shall not be applied to the salaries of
incumbent council members until the commencement of their next term of office. (Ord. 3001 § 1, 2012).
2.05.080 State law adopted.
To the extent that it is applicable to the provisions of this title, RCW 35.21.015 is adopted by
reference, and shall be in effect in the city of Puyallup. (Ord. 3001 § 1, 2012).

35.21.015 Salary commissions.
(1) Salaries for elected officials of towns and cities may be set by salary commissions established
in accordance with city charter or by ordinance and in conformity with this section.
(2) The members of such commissions shall be appointed in accordance with the provisions of a
city charter, or as specified in this subsection:
(a) Shall be appointed by the mayor with approval of the city council;
(b) May not be appointed to more than two terms;
(c) May only be removed during their terms of office for cause of incapacity, incompetence,
neglect of duty, or malfeasance in office or for a disqualifying change of residence; and
(d) May not include any officer, official, or employee of the city or town or any of their
immediate family members. "Immediate family member" as used in this subsection means the parents,
spouse, siblings, children, or dependent relatives of the officer, official, or employee, whether or not
living in the household of the officer, official, or employee.
(3) Any change in salary shall be filed by the commission with the city clerk and shall become
effective and incorporated into the city or town budget without further action of the city council or
salary commission.
(4) Salary increases established by the commission shall be effective as to all city or town
elected officials, regardless of their terms of office.
(5) Salary decreases established by the commission shall become effective as to incumbent
city or town elected officials at the commencement of their next subsequent terms of office.
(6) Salary increases and decreases shall be subject to referendum petition by the people of
the town or city in the same manner as a city ordinance upon filing of such petition with the city clerk
within thirty days after filing of the salary schedule. In the event of the filing of a valid referendum
petition, the salary increase or decrease shall not go into effect until approved by vote of the people.
(7) Referendum measures under this section shall be submitted to the voters of the city or town
at the next following general or municipal election occurring thirty days or more after the petition is
filed, and shall be otherwise governed by the provisions of the state Constitution, or city charter, or laws
generally applicable to referendum measures.
(8) The action fixing the salary by a commission established in conformity with this section shall
supersede any other provision of state statute or city or town ordinance related to municipal budgets or
to the fixing of salaries.
(9) Salaries for mayors and councilmembers established under an ordinance or charter provision
in existence on July 22, 2001, that substantially complies with this section shall remain in effect unless
and until changed in accordance with such charter provision or ordinance. [2001 c 73 § 4.]

COMPENSATION OF PUBLIC OFFICERS
SECTION 1 AUTHORIZING COMPENSATION INCREASE DURING TERM. The compensation of all elective and
appointive state, county, and municipal officers who do not fix their own compensation, including judges of courts
of record and the justice courts may be increased during their terms of office to the end that such officers and
judges shall each severally receive compensation for their services in accordance with the law in effect at the time
the services are being rendered.
