COVENANT REGARDING PARK SPACE FOR
FOUR LAKES APARTMENTS
RECITALS.
A. Declarant is the owner of the property legally described in Exhibit A attached
hereto (the "Property "); and
B. The Fourth Amendment to Lakeland Annexation and Utilities Agreement, as
described in recorded document number 200810090349 Pierce County Auditor's
Files requires that a minimum park space of 15,000 square feet be maintained by
the owner of the Property
COVENANT
NOW, THEREFORE, the undersigned hereby covenants, agrees, and declares
that the property will be held, sold, and conveyed subject to and burdened by the
following covenants, conditions. and restrictions for the benefit of the City of Auburn, the
owners of the property, and their heirs, successors, grantees, and assigns. All provisions
of this Declaration shall be binding upon all parties having or acquiring any right, title, or
interest in the Property or any part thereof, and are intended to be and shall in all respects
be regarded as covenants running with the land.
I A minimum park space of 15,000 square feet will be maintained in some
configuration on parcel no. 0520053065 as required by the Fourth
Amendment to Lakeland Annexation and Utilities Agreement.
