MONTEREY PARK BUILDERS, L.L.C. and TA 40, L.L.C.
RECITALS
A. On August 26, 2008, the City of Auburn, a Washington municipal corporation,
("City ") approved, and Tucci and Sons, Inc., a Washington corporation executed and
recorded the final plat of Auburn 40 P U.D The final plat is recorded at Volume 255
of Plats, pages 51 through g8, records of King County, Washington, recording no.
20(00826001442.
B. Monterey Park Builders, L.L.C. and TA 40, L.L.C.; Washington limited liability
companies ( "Developers"), is the successor in interest to Tucci and Sons, Inc.
C. The final plat of Auburn 40 P U.D included a note that "Lots 1 -10, 12, 13, 16 -28, 30-
35, and Lots 203 -216. 218 -236, 239 and all alley- loaded lots Will be semi- detached
homes (duplex).

D Based on significant changes in market and economic conditions, changes to
applicable City zoning code requirements, and boundary line adjustments within the
plat which make development of duplex homes infeasible, the City and the
Developers agree that the notation indicating that certain lots are to be used for semi-
detached (duplex) homes is no longer a restriction that is in the best interests of either
the City of Auburn or the Developers.
BASED ON THE FOREGOING, and in consideration of mutual benefits of the change set forth
herein, the adequacy of which is confirmed by both parties, the City of Auburn, Monterey Park
Builders, L.L.C. and TA 40, L.L.C. agree as follows:
1 The note regarding the use of certain lots for semi - attached (duplex) homes
contained on the second page of the recorded plat of Auburn 40 P U.D is hereby
modified to provide that Lots 1 through 4, Lots 16 through 24, 27, 28, 30 through
35, and 144 through 157 in Auburn 40 P U.D may be developed with detached
single family homes. The detached housing on these lots shall be of the same
design and quality as the surrounding single family detached homes in Auburn 40
P U.D
2. The note on the Plat is modified to read as follows:
Lots 5 -10, 12, 13, 25, 26 -35, 203 -216, 218 -236, 239 and alley - loaded Lots 65 —
108 will be semi - detached homes (duplex). All other lots shall be detached
homes.
Except as set forth above, all other provisions of the final plat of Auburn 40 P U.D shall remain
in full force and effect.
