HomeMy WebLinkAbout3223WHEREAS, said estimates are accompanied by a diagram of the proposed im- provements showing thereon the lots, tracts and parcels of land and other property which will be especially benefitted by the proposed improvements and the estimated amount of the cost and expense.thereof to be borne by each lot, tract and parcel of land or other property. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That 8th Street Southeast, between Auburn Way South and "B" Street Southeast, inside the corporate limits of the City of Auburn, be improved by the construction and installation of curb and gutter storm drainage, excavation ballasting, and asphalt concrete surfacing to a width of 44 feet, all in accordance with plans and specifications prepared by the,City Engineer and filed with the City Clerk. Section 2. That there is hereby created and established a Local Improvement District to be designated Local Improvement District No.. 291., which said district is described as follows: Hart's First Add - Volume 20-, Page 23, Block 7, Lots 1 through 14, Block 8, Lots'l through 15, situate in the City of Auburn,.County of King, State.of Washington. Section 3. That the estimated cost in carrying out the foregoing improve- ments is. hereby declared to be.as near as may be, the sum of $46,247.91. Section 4. Applicable costs and expenses of all engineering, legal, in- spection; advertising, publication and notices, and all other expenses incident thereto, shall be levied and assessed against all of the property legally and properly assessable therefor, as provided by the laws of the State of Washington and the Ordinances of the City of Auburn. Section 5. That said improvements shall be made by the City of Auburn under the supervision of the'City Council thereof or such committee or person as the City Council may designate. Section 6. Assessments or any portion thereof, may be paid at any time within thirty (30) days from the date of the first publication of the Notice of ------------------ Ordinance No. 3223 Page Two 11-17-77 Collection of suchassessments without penalty, interest or cost, a.nd thereafter the sum remaining unpaid, if any, may be paid in ten (10) equal annual install- ments, with interest on the whole unpaid sum at the rate of seven and one-half percent (7.5%) per annum. Commencing with the first year after.:the last day, such assessments, or any portion thereof, may be paid without penalty, interest or cost (thirty (30) days from the date of'the first publication of the Treasurer's Notice of Collection of Assessments) and each year thereafter -one of said in- stallments, together with the interest.due, shall be collected as provided by law and the.Ordinances of the City of Auburn; assessments or installments of assessments not paid when due shall be delinquent and there shall be added to the same a penalty of five percent (5%) of the amount of the overdue install- ments and interest, and such penalty shall become part of the lien upon the property assessed. Section 7. That there is hereby created in the Office of the Finance Director of the City of Auburn, a fund of the City to be known as "Local Improvement District No. 291 Fund". Warrants shall be drawn on said fund based on estimates made by the City Engineer and approved by the City Council in payment of the cost of construction and installation of said improvements. Section 8. That this Ordinance shall take effect and be in force .five (5) days from and after,its passage, approval and.publication, as provided by law.
