NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. That Auburn Way North between 40th and 49th Northeast, inside
the corporate li.mits.of the City of Auburn, be improved by the construction and
installation of water mains and fire hydrants, all in accordance with plans
and specifications prepared by the City Engineer and filed with the City Clerk.
Section 2. That there is hereby created and established a Local Improvement
District to be designated Local Improvement District No. 295, which said district
is described as follows:
White River Valley Home Tracts unrecorded No. 2 in Section
31, Township 22 North, Range 5 EWM:
The westerly 120 feet as measured at right angles to Auburn
Way N. of that portion of Tracts 3, 27, 28 and 29, lying
northeasterly of Auburn Way N. LESS street.
The easterly 120 feet as measured at right angles to Auburn
Way N. of Tract 30.
The Westerly 120 feet as measured at right angles to Auburn
Way N. of Tracts 36, together with vacated street adj.
Tracts 31, 32, 33, 34 and 35.
H.H. Jones Donation Claim No. 39 in Section 31, Township 22
North, Range 5 EWM and Section 6, Township 21 North, Range
5 EWM, described as follows:
The west 120 feet of the east 698.64 feet of the north
1105.08 feet and
The west 120 feet of the east 878.64 feet of the north
1120.0 feet.
King County, State of Washington.
Section 3. That the estimated cost in carrying out the foregoing improve-
ment is hereby declared to be as near as may be, the sum of $1205078.47.
Section 4. Applicable costs and expenses of all engineering, legal,
insepction, advertising, publication and notices, and all other expenses incident
thereto, shall be levied and assessed against all of the property legally and
properly assessable therefor, as provided by the laws of the State of Washington
and the Ordinances of the City of Auburn.

Section 5. That said improvements shall be made by the City of Auburn under
the supervision of the City Council thereof or such committee or person as the
City Council may designate.
Section 6. Assessments or any portion thereof, may be paid at any time
within thirty (30) days from the date of the first publication of the Notice of
Collection of such assessments without penalty, interest or cost, and thereafter
the sum remaining unpaid, if any, may be paid in ten (10) equal annual.install-
ments, with interest on the whole unpaid sum•at the rate of seven and.one-half
per cent (7.5%) per annum. Commencing with the first year after the last day,
such assessments, or any portion thereof, may be paid without penalty, interest
or cost (thirty (30) days from the date of the first publication of the Treasurer's
Notice of Collection.of Assessments) and each year thereafter one of said install-
ments, together with the interest due, shall be collected a's provided by law and
the Ordinances of the City of Auburn; assessments or installments of assessments
not paid when due shall be delinquent and there shall be added to the same a
penalty of five percent (5%) of the amount of the overdue installments and interest,
and such penalty shall become a part of the lien upon the property assessed.
Section 7. That there is hereby created in the office of the Finance
Director for the City of Auburn, a fund of the City to be known as "Local
Improvement District No. 295 Fund". Warrants shall be drawn on said fund based
on estimates made by the City Engineer and approved by the City Council in
payment of the cost of construction and installation of said improvements.
Section 8. That this Ordinance shall take effect and be in force five
(5) days from and after its passage, approval and publication, as provided by law.

the County of King, State of Washington, do hereby certify that the fore-
going is a full, true and correct copy of Ordinance No.3269 of the
ordinances of the City of Auburn, entitled "AN ORDINANCE OF THE CITY OF
AUBURN, WASHINGTON, PROVIDING FOR THE CONSTRUCTION AND INSTALLATIOd OF
WATER MAINS AND FIRE HYDRANTS ON AUBURN WAY NORTH BETWEEN 40TH AND 49TH
NORTHEAST, WITHIN THE CITY OF AUBURN; CREATING AND ESTABLISHING LOCAL
IMPROVEMENT DISTRICT NO. 295; PROVIDING THE METHOD OF ASSESSMENT IN SAID ._
DISTRICT AND THE MODE OF PAYMENT THEREOF, AND CREATING A LOCAL IMPROVEMENT

I further certify that said Ordinance No. 3269 was duly passed by
the Council and approved by the Mayor of the said City of Auburn and
published as provided by law in the Auburn Globe News, a weekly newspaper
published in the City of Auburn, and of general circulation therein, on
the 5th day of May , A.D., 19 78 .
