AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE REZONING OF
PROPERTY CONSISTING OF APPROXIMATELY 15 ACRES SITUATED SOUTHEASTERLY
OF THE STUCK RIVER ON THE NORTH SIDE OF STUCK RIVER ROAD, WITHIN
THE CITY OF AUBURN, WASHINGTON, CHANGING THE ZONING CLASSIFICATION
THEREOF FROM UNCLASSIFIED TO P-1.
WHEREAS, Application Number 2-88 has been submitted to the Council of
the City of Auburn, Washington, by the City of Auburn Parks Department,
requesting the rezoning of the real property hereinafter described in Section
l of this Ordinance, which application was dated January 28, 1988; and
WHEREAS, said request above referred to, was referred to the Planning
Commission by the Auburn City Council for study and public hearing thereon;
and
WHEREAS, the Planning Commission based upon staff review, held a public
hearing to consider said petition in the Council Chambers of the Auburn City
Hall, on March 8; 1988, at the conclusion of which the Planning Commission
recommended the approval of the rezoning of the said property based upon the
following findings of the Department of Planning and Community Development,
to -wit:
FINDINGS OF -FACT
1. Comprehensive Plan policies related to the proposed action:
A. Public Classification Purpose: To designate areas of significant
size needed to provide public and quasi -public services to the com-
munity. (pg. 64)
B. Public Classification Description: This category includes those
areas which are reserved for public or quasi -public uses of a deve-
loped character. It is intended to include those of a significant
extent, and not those smaller public uses which are consistent with
and may be included in another designation. (pg. 64)
C. Criteria for Designation of Public Classification: Designation of
these areas should be consistent with the character of adjacent uses.

D. Parks and Open Space Land Use Policies:
Goal 14.: To provide a comprehensive system of parks and open spaces
that responds to the recreational, cultural, environmental and aesthe-
tic needs and desires of the City's residents. (pg. 30)

Objective 14.1.1.: To provide a broad and comprehensive park system
that meets the recreational needs of all segments of the community.
(pg. 31)
E. Other Policies:
Policy 8.1.4.: The design of new development along the Green and
Stuck Rivers shall be sensitive to the unique character of each as a
visual resource of the entire community. (pg 21)
Policy 11.1.2.: The uses along the rivers are limited to residential,
agricultural, open space, recreational and quasi -public. Limited
commercial uses providing new public access to the shorelines will be
considered on a case -by -case basis.
2. The site is presently zoned Uncl. (Unclassified Use District) and
designated by the Comprehensive Plan Map as a Special Planning Area. An
application for rezone to P-1 (Public Use District) and request for a
Comprehensive Plan Map amendment to Public/Quasi-Public has been filed for
consideration.
3. The site is located adjacent to and provided access from Stuck River
Drive.
4. The site is located adjacent to the Stuck River on the north, Game Farm
Park properties to the west, and the Stuck River Road Special Planning
Area to the south and east.
5. The proposed rezone and Comprehensive Plan Map amendment would provide for
an easterly extension of an existing P-1 District and Public/Quasi-Public
land use classification.
6. The site is presently vacant, and is proposed to be developed as Phase II
of the Game Farm Park system. Phase II development proposes to include
day use recreational areas and group recreational vehicle camping facili-
ties.
7. Use of the site for active and passive recreational activities will be
consistent with Comprehensive Plan and Shoreline Management policies
regarding use of river environments.
8. The proposed rezone and Comprehensive Plan Map amendment to allow for
Public Zoning and Land Use classification is consistent with the City's
Comprehensive Plan, and existing and proposed land use activities located
within the surrounding area.
WHEREAS, the City Council of the City of Auburn, held a public hearing in
the Council Chambers of the Auburn City Hall, at 7:30 P.M. on March 21, 1988,
at which time the City Council concurred with the findings of the Department
of Planning and Community Development and Planning Commission as hereinabove
stated; and

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO
ORDAIN AS FOLLOWS THAT:
Section 1. The following legally described property consisting of
approximately 15 acres situated southeasterly of the Stuck River on the north
side of Stuck River Road, situate in the City of Auburn, County of King, State
of Washington, be and the same is hereby rezoned from Unclassified to P-1
(Public Use District), to -wit:
That portion of Government Lots 9 and 10 lying southerly of
the White (Stuck) River;
EXCEPT all coal and minerals and the right to explore for
and mine the same as excluded in deed recorded under
Recording No. 1023543;
TOGETHER WITH that part of the NE 1/4 of the SW 1/4 lying
northerly of the existing road, S.E. Stuck River Road
Extension;
TOGETHER WITH that part of the SE 1/4 lying northerly of
the existing road, S.E. Stuck River Road Extension;
ALL IN Section 29 Township 21 North, Range 5 East, W.M.;
situate in King County, Washington.
SUBJECT to an easement the City of Auburn to lay, construct,
maintain, keep in repair, and reconstruct a water main in,
over, under, through, and across the following described
tract of land:
A strip of land sixteen and one-half (16-1/2) feet, measured
at right angles, as near as may be, on each side of the
located centerline of the proposed water pipe line of the
City of Auburn, and lying wholly within the southwest
quarter of the northeast quarter (SW 1/4 of the NE 1/4),
the southeast quarter of the northwest quarter (SE 1/4 of
the NW 1/4), and the southwest quarter of the northwest
quarter (SW 1/4 of the NW 1/4), of Section 29, Township 21
North, Range 5 East, W.M.
Section 3. The amendment to the Comprehensive Zoning Map of the City of
Auburn, Washington, encompassing this Zoning use classification change, be and
the same is hereby approved.
Section 4. Upon the passage, approval and publication of this Ordinance
as provided by law, the Legal Department for the City of Auburn shall cause
this Ordinance to be recorded in the office of the King County Auditor.

Section 5. The Mayor is hereby authorized to implement such administra-
tive procedures as may be necessary to carry out the directions of this
legislation.
Section 6. This Ordinance shall take effect and be in force five (5) days
from and after its passage, approval and publication, as provided by law.
