OF THE AUBURN CITY CODE ENTITLED PENALTIES 3 FOR VIOLATIONS: TO PROVIDE FOR THE MAXIMUM PENALTY ALLOWED BY STATE LAW FOR CONVICTION OF AN ORDINANCE VIOLATION. 4 5 WHEREAS, the City is authorized by RCW 35A.11.O2O to impose penalties for 6 the violation of any City ordinances; and 7 WHEREAS, the current provisions of the Auburn City Code do not conform to 8 the maximum fine and maximum imprisonment allowed by State law; 9 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO 10 ORDAIN AS FOLLOWS: 11 Section 1. PURPOSE. The purpose of this ordinance is to amend the 12 Auburn City Code to increase the maximum amount of penalties and imprisonment 13 which the City may seek in enforcing violations of its ordinances in a crimi- 14 nal enforcement procedure. The criminal, penalty section applies to any crimi- 1 5 nal enforcement for the violation of any provision of the Auburn City Code. 16 Section 2. Section 1.24.010 of the Auburn City Code, as last amended by 17 Ordinance No. 3618, Section 1, passed by the City Council in 1981, is hereby 18 amended to comply with current State law and RCW 35A.11.O2O as follows: 19 1.24.010 GENERALLY 20 Notwithstanding any present city ordinance to the contrary, 21 and as authorized by RCW 35A.11.O2O of the Optional 22 Municipal Code of the laws of the state, for any conviction 23 of an ordinance violation in the Auburn City Code there 24 shall be imposed a maximum fine of up to five thousand 25 dollars ( (€l ve hr&F,('red dates)), or imprisonment for any 26 term up to and not exceeding one year ((& ,;;;'1 se-tc;f-c 27 c € up ninety or both such fine and imprisonment. 28 29 30 31 ------------------- Ordinance No. 4285 32 Page One 4/28/88 I 1 i I 1 Section 3. The Mayor is hereby authorized to implement such administra- 2 tive procedures as may be necessary to carry out the directions of this 3 legislation. 4 Section 4.
