USE PERMIT TO ALLOW A MINI STORAGE FACILITY FOR HOUSEHOLD GOODS
WITHIN THE VILLA SHOPPING CENTER LOCATED AT 22ND AND "M" STREET
N.E., WITHIN THE CITY OF AUBURN, WASHINGTON.
WHEREAS, Application Number 12-88, dated March 18, 1988, together
with site plans therefore, has been submitted to the City of Auburn,
Washington, by METROPOLITAN FEDERAL SAVINGS AND LOAN ASSOCIATION OF SEATTLE,
requesting a Conditional Use Permit to allow a mini storage facility for
household goods within the Villa Shopping Center on property located at 1345
22nd Street Northeast, within the City of Auburn, Washington, hereinafter
described in Section 2 of this Ordinance; and
WHEREAS, said request above referred to, was referred to the Hearing
Examiner for study and public hearing thereon; and
WHEREAS, the Hearing Examiner based upon staff review, held a public
hearing to consider said petition in the Council Chambers of the Auburn City
Hall, on April 19, 1988, at 7:30 P.M., at the conclusion of which the
Hearing Examiner recommended approval of the issuance of a Conditional Use
Permit to allow a mini storage facility for household goods based upon the
following Findings of Fact and Conclusions, to -wit:
FINDINGS OF FACT
1. The applicant Duane Steinle, for Metropolitan Savings and Loan Association
of Seattle requests a Conditional Use Permit. The proposal would allow
the storage of household goods in an existing commercial shopping center.
2. The subject site is known as the Villa Shopping Center and is located at
1345 22nd Street N.E. in Auburn. Currently the shopping center is zoned
C-1, Light Commercial District. Surrounding zoning and land uses in the
vicinity include R-4, Multi -Family, to the north; R-MHP, Mobile Home Park,
to the south; R-4, Multi -Family, to the east; and R-3, Multi -Family, to
the west.
3. Pursuant to Ordinance No. 4265 household goods storage is a use permitted
in the C-1 zone subject to a conditional use permit.

4. The evidence establishes that the proposed tenant space for household
goods is approximately 12,235 square feet in size and located in the
northeast corner of the shopping center in an area which was formerly a
grocery store. The space has very little exposure due to the con-
figuration of the shopping center.
5. The applicant proposes no external alterations and access to the storage
area will be from the northeast corner of the building. The evidence
establishes that the parking and traffic as a result of this proposal
would be substantially less than what other uses which are permitted in
the C-1 zone such as restaurant uses.
6. The staff report, with its recommendation that the conditional use permit
be approved, is incorporated herein by reference as though set forth in
full.
CONCLUSIONS OF LAW
1. The Auburn Zoning Ordinance sets forth a series of criteria which must be
established by the evidence prior to the time that a conditional use per-
mit can be granted. The first of these criteria of the proposed use will
have no more of an adverse effect on the health, safety, or comfort of
persons living or working in the area than would a use permitted outright
in the zone. This criteria is established by the evidence since no exter-
nal changes are being proposed and the impacts would be considerably less
than other C-1 uses.
2. Further, the applicant must establish that the proposal complies with the
goals and policies of the Comprehensive Plan. This criteria is
established by the evidence.
3. In addition, the applicant,must establish that the proposal complies with
all requirements of the Zoning Ordinance. This criteria is established by
the evidence since the facility is already built and existing in the C-1
zone and there are no changes planned which would alter the compliance
with the Zoning Ordinance.
4. Further, it must be established that the proposal can be constructed and
maintained so as to be harmonious and appropriate in design, character,
and appearance with the existing or intended character of the general
vicinity and that the proposal will not adversely affect the public
infrastructure. These criteria are established by the evidence.
For each of the above referenced reasons, the recommendation of the
Hearing Examiner to the Auburn City Council on this application for a
Conditional Use Permit is approved and affirmed,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO
ORDAIN AS FOLLOWS:

Section 1. The above cited Hearing Examiner's Findings of Fact and
Conclusions, are herewith incorporated in this Ordinance.
Section 2. A Conditional Use Permit to allow a mini storage facility for
household goods on property zoned C-1 (Light Commercial), within the Villa
Shopping Center and located at 1345 22nd Street Northeast, situate in the City
of Auburn, County of King, State of Washington, and legally described as
follows, to -wit:

in NE 1/4 Sec 7, TWP 21, N R 5 EWM, City of Auburn, County
of King, State of Washington.
Section 3. Upon the passage, approval and publication of this Ordinance
as provided by law the Legal Department for the City of Auburn shall cause
this Ordinance to be recorded in the office of the King County -Auditor.
Section 4. The Mayor is hereby authorized to implement such administra-
tive procedures as may be necessary to carry out the directions of this
legislation.
Section 5. This Ordinance shall take effect and be in force five (5) days
from and after its passage, approval and publication, as provided by law.
