AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE REZONING OF
3 PROPERTY LOCATED AT 1035 HARVEY ROAD, WITHIN THE CITY OF AUBURN,
WASHINGTON, CHANGING THE ZONING CLASSIFICATION THEREOF FROM R-2
4 (SINGLE FAMILY) TO R-0 (RESIDENTIAL OFFICE).

WHEREAS, Application Number 13-88 has been submitted to the Council of
the City of Auburn, Washington, by EDWARD and VIVIEN HOHNSTEIN, requesting
the rezoning of the real property hereinafter described in Section 1 of this
Ordinance, which application was dated April 25, 1988; and
WHEREAS, said request above referred to, was referred to the Hearing
Examiner for study and public hearing thereon; and
WHEREAS, the Hearing Examiner, based upon staff review, held a public
hearing to consider said petition in the Council Chambers of the Auburn City
Hall, on May 18, 1988, at the conclusion of which the Hearing Examiner
recommended the approval of the rezoning of the said property based upon the
following Findings of Fact and Conclusions, to -wit:
FINDINGS OF FACT
1. The applicant, Edward Hohnstein, applies for a rezone from R-2 (Single
Family) to R-0 (Residential Office).
2. The subject site is located at 1035 Harvey Road and is presently zoned R-2
and is utilized as a single family residential property.
3. The Comprehensive Plan designates the subject site as Office -Residential.
Surrounding zoning and land uses include R-0, office, to the north; R-2
and R-4, single family, to the south; R-0, office, to the east; and R-2,
single family, to the west.
4. The applicant is not proposing any site specific development plan in con-
nection with this rezone request.
5. The site has access to the west side of Harvey Road which is classified as
a planned five lane arterial in the City's Comprehensive Plan. Currently,
Harvey Road has an average daily traffic count of 18,500 vehicle trips per
day.

6. The R-0, Residential Office District, is a new zone which was created to
implement the office residential land use classification of the City of
Auburn Comprehensive Plan.
7. The staff report, with its recommendation of approval, is incorporated
herein by reference as though set forth in full.
CONCLUSIONS'OF LAW
1. The requested rezone is consistent with the City of Auburn Comprehensive
Plan Land Use Map.
2. The Residential Office zone is intended to accommodate some professional
office uses for medical and business type services while protecting adja-
cent residential uses from commercial uses and activities.
3. When development on the site is proposed, the impacts of a specific deve-
lopment proposal can be analyzed and mitigated pursuant to the State
Environmental Policy Act.
For each of the above referenced reasons, the recommendation of the
Hearing Examiner to the Auburn City Council on this application for a
rezone is approved and affirmed.
NOW, THEREFORE, THE CITY. COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO
ORDAIN AS FOLLOWS THAT:
Section 1. The above cited Hearing Examiner's Findings of Fact and
Conclusions, are herewith incorporated in this Ordinance.
Section 2. The following legally described property located at 3320
Academy Drive, situate in the City of Auburn, County of King, State of
Washington, be and the same is hereby rezoned from R-2 (Single Family) to R-0
(Residential Office), to -wit:
Lot A: N 1/2 of N 1/2 of Lots 4, 5 and 6, and the N 1/2 of
N 1/2 of the E 1/2 of Lot 3 togw that por of the N 1/2 of
the N 1/2 of Lots 7 and 8 lying Wly of Harvey Road all in
Blk 16, C.D. Hillman's Auburndale Additoin to the City of
Seattle, Division 2. EXCEPT that portion of sd Lot 6, con-
veyed to King County for road purposes by deed recorded
uner Auditor's File No. 2533680.

Section 3. Upon the passage, approval and publication of this Ordinance
as provided by law, the Legal Department for the City of Auburn shall cause
this Ordinance to be recorded in the office of the King County Auditor.
Section 4. The Mayor is hereby authorized to implement such administra-
tive procedures as may be necessary to carry out the directions of this
legislation.
Section 5. This Ordinance shall take effect and be in force five (5) days
from and after its passage, approval and publication, as provided by law.

ordinances of the City of Auburn, entitled "AN ORDINANCE."
I certify that said Ordinance No. 4289 was duly passed
by the Council and approved by the Mayor of the said City of
Auburn, on the 20th day of June A.D., 1988.
I further certify that said Ordinance No. 4289 was
published as provided by law in the Valley Daily News, a
daily newspaper published in the City of Auburn, and of
general circulation therein, on the 26th day of June A.D.,
1988.
