AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE REZONING OF
PROPERTY LOCATED ON THE WEST SIDE OF "C" STREET S.W. IN THE 100 BLOCK,
WITHIN THE CITY OF AUBURN, WASHINGTON, CHANGING THE ZONING CLASSIFICATION
THEREOF FROM R-4 (MULTIPLE FAMILY RESIDENTIAL) TO C-3 (HEAVY COMMERCIAL).
WHEREAS, Application Number 4-88 has been submitted to the Council of
the -City of Auburn, Washington, by FRED THOMAS, requesting the rezoning of the
real property hereinafter described in Section 2 of this Ordinance, which
application was dated February 17, 1988; and
WHEREAS, said request above referred to, was referred to the Hearing
Examiner for study and public hearing thereon; and
WHEREAS, the Hearing Examiner, based upon staff review, held a public
hearing to consider said petition in the Council Chambers of the Auburn City
Hall, on July 25, 1988, at the conclusion of which the Hearing Examiner
recommended the approval of the rezoning of the said property based upon the
following Findings of Fact and Conclusions, to -wit:
FINDINGS OF FACT
1. The applicant, Fred Thomas, requests a rezone from R-4, Multiple Family
District, to C-3, Heavy Commercial District. There is no site specific
development proposal at this time.
2. The subject site is located on the west side of "C" Street S.W. in the 100
block and is 6,000 square feet in size (60' X 100').
3. Surrounding zoning and land uses in the vicinity include R-4/C-3, Multiple
Family/Heavy Commercial, to the north; R-4, Single Family, to the south;
C-3, Industrial, to the east; and R-4, Single Family/Multiple Family
Residential, to the west.
4. The subject site is designated for heavy commercial uses on the City of
Auburn Comprehensive Plan Map.
5. The site is located " on C Street which is designated as an existing
arterial in the City's Comprehensive Plan Map.
6. The site has access to "C" Street S.W. and access may also be provided
from a westerly alley. Currently this alley is unpaved and provides
secondary access to the subject site.
7. The property in the vicinity of this site has been recognized through the
area zoning process as having a potential for heavy commercial development
and uses.

8. The staff report with its recommendation of conditional, approval is incor-
porated herein by reference as though set forth in full.
CONCLUSIONS OF LAW
1. The rezone as proposed meets the goals and policies of the City's
Comprehensive Plan.
2. The "C" Street area has sufficiently changed since the initial multiple
family residential zoning was approved that a rezone is appropriate.
For each of the above referenced reasons, the recommendation of the
Hearing Examiner to the Auburn City Council on this application for a
rezone is approved and affirmed.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO
ORDAIN AS FOLLOWS THAT:
Section 1. The above cited Hearing Examiner's Findings of Fact and
Conclusions, are herewith incorporated in this Ordinance.
Section 2. The following legally described property located on the west
side of "C" Street S.W. in the 100 block, situate in the City of Auburn,
County of King, State of Washington, be and the same is hereby rezoned from
R-4 (Multiple Family Residential) to C-3 (Heavy Commercial), to -wit:
Lots 3 and 4, Block 5, Map of Milner Addition as recorded
in King County Plats Vol. 3, pg 39, records of King County,
situated in Sec 13, Twp 21 N, R 4 EWM, City of Auburn,
County of King, State of Washington.
Section 3. Upon the passage, approval and publication of this Ordinance
as provided by law, the City Clerk for the City of Auburn shall cause this
Ordinance to be recorded in the office of the King County Auditor.
Section 4. The Mayor is hereby authorized to implement such administra-
tive procedures as may be necessary to carry out the directions of this
legislation.

Section 5. This Ordinance shall take effect and be in force five (5) days
from and after its passage, approval and publication, as provided by law.

ordinances of the City of Auburn, entitled "AN ORDINANCE."
I certify that said Ordinance No. 4301 was duly passed
by the Council and approved by the Mayor of the said City of
Auburn, on the 6th day of September A.D., 1988.
I further certify that said Ordinance No. 4301 was
published as provided by law in the Valley Daily News, a
daily newspaper published in the City of Auburn, and of
general circulation therein, on the 11th day of September
A.D., 1988.
