AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR A CONDITIONAL
USE PERMIT TO ALLOW FOR AN OUTDOOR STORAGE YARD ON PROPERTY ZONED
M-1 (LIGHT INDUSTRIAL) AND LOCATED AT 1400 WEST MAIN STREET,
WITHIN THE CITY OF AUBURN, WASHINGTON.
WHEREAS, Application Number 26-88, dated June 27, 1988, together
with site plans therefore, has been submitted to the City of Auburn,
Washington, by WASHINGTON NATURAL GAS COMPANY, requesting a Conditional Use
Permit to allow for an outdoor storage yard on property located at 1400 West
Main Street, within the City of Auburn, Washington, hereinafter described in
Section 2 of this Ordinance; and
WHEREAS, said request above referred to, was referred to the Hearing
Examiner for study and public hearing thereon; and
WHEREAS, the Hearing Examiner based upon staff review, held a public
hearing to consider said petition in the Council Chambers of the Auburn City
Hall, on July 25, 1988, at 7:30 P.M., at the conclusion of which the Hearing
Examiner recommended approval of the issuance of a Conditional Use Permit to
allow for an outdoor storage yard based upon the following Findings of Fact
and Conclusions, to -wit:
FINDINGS OF FACT
1. The applicant, Washington Natural Gas Co., through its engineer, Reed,
Reinvald Architects, seeks a Conditional Use Permit to allow an outdoor
storage yard equivalent to 50% of the floor area the associated buildings.
2. The subject site is located at 1400 West Main Street in Auburn and is
zoned M-1. The existing land use is light industrial and site is
designated light industrial in the Comprehensive Plan.
3. The applicant requests a Conditional Use Permit to permit him to store up
to 50% of the associated on -site buildings as an outdoor storage yard.
There are 29,180 square feet of existing and proposed building area on the
site.
4. The applicant proposes to store plastic PCV pipe in varying lengths and
wire on spools.

5. The site plan as proposed establishes that approximately 40% of the
storage will be installed towards the rear of the site at this time. The
remaining 10% is proposed to be added towards the rear of the site at a
later date.
6. The Zoning Ordinance requires outdoor storage areas to be appropriately
landscaped and buffered.
7. The staff report with its recommendation of conditional approval is incor-
porated herein by reference as though set forth in full.
CONCLUSIONS OF LAW
1. The Zoning Ordinance at Section 18.64.040 sets forth a series of criteria
which must be established by the evidence prior to the time that a
Conditional Use Permit can be granted.
2. The first of these criteria is that the use as proposed will have no more
of an adverse effect on the health, safety, or comfort of persons living
or working in the area than will a use generally permitted in the
district. The evidence establishes that the type of use proposed by the
applicant, to -wit the outdoor storage of pipe, is harmonious with the uses
generally anticipated in an M-1 zoning district.
3. The applicant must also establish that the proposal complies with the
goals, policies and objectives of the Comprehensive Plan. This criteria
is established by the evidence since the site will be adequately buffered
and to screen any adverse visual effects.
4. The other requirements .for a conditional use permit have been established
by the evidence.
For each of the above referenced reasons, the recommendation of the
Hearing Examiner to the Auburn City Council on this application for a
Conditional Use Permit is approved and affirmed.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. The above cited Hearing Examiner's Findings of Fact and
Conclusions, are herewith incorporated in this Ordinance.
Section 2. A Conditional Use Permit to allow for an outdoor storage yard
the area of which is 50% of the floor area of the associated buildings on pro-
perty zoned M-1 (Light Industrial), located at 1400 West Main Street, situate
in the City of Auburn, County of King, State of Washington, and legally
described as follows, to -wit:

Section 3. A minimum width of five foot Type I landsaping shall be
installed to provide screening of the storage area to the east, west and south
as required by the Building Official. In addition, such screening shall be
provided to the north for storage area not screened by an adjacent building
structure.
Section 4. A landscaping plan, prepared in accordance with Chapter 18.50
of the Zoning Ordinance, shall be submitted and approved by the Building
Official prior to the issuance of construction permits, and installed prior to
occupancy of the proposed outdoor storage yard.
Section 5. Outdoor storage area shall not exceed 50% of the actual
constructed and occupied building area existing on -site at any time, up to a
maximum allowable outdoor storage area of 19,292 square feet.
Section 6. Upon the passage, approval and publication of this Ordinance
as provided by law the City Clerk of the City of Auburn shall cause this
Ordinance to be recorded in the office of the King County Auditor.

Section 7. The Mayor is hereby authorized to implement such administra-
tive procedures as may be necessary to carry out the directions of this
legislation.
Section 8. This Ordinance shall take effect and be in force five (5) days
from and after its passage, approval and publication, as provided by law.
