4308 TO INCORPORATE CONDITIONS WITHIN THE CONDITIONAL USE PERMIT.

WHEREAS, Ordinance No. 4308 was approved by the City Council on September

19, 1988; and

WHEREAS, certain conditions were inadvertently omitted;

Section 1. The purpose of this amending Ordinance is to correct the
11
omission of three conditions imposed upon the Conditional Use Permit.

Section 2. The ORDER provisions of Ordinance No. 4308 is amended to add
13
the following conditions:

6. Water shall be provided by the Federal Way Water and Sewer District
and shall meet Auburn's standards for fire flow.

7. The construction of the project shall be consistent with the
17
"Nikiska" site plans as amended in accordance with Exhibit #3, with
specific adherence to the park land and recreation facilities,
18
landscaping, erosion control measures, and the setbacks from the top
of slope. The parking spaces do need to be redesigned to preclude
19
any overhang from being considered as part of the parking space.

8. The vegetation retention areas as required by the surface mining per-
mit approved by Ordinance No. 4113 be retained.

Section 3. The remaining provisions of Ordinance No. 4308 shall remain
23
unchanged as fully as set forth in Ordinance No. 4308.

Section 4. Upon the passage, approval and publication of this Ordinance

as provided by law the City Clerk of the City of Auburn shall cause this
3
Ordinance to be recorded in the office of the King County Auditor.

Section 5. The Mayor is hereby authorized to implement such administra-
5
tive procedures as may be necessary to carry out the directions of this
6
legislation.
7
Section 6. This Ordinance shall take effect and be in force five (5) days
8
from and after its passage, approval and publication, as provided by law.

I, Robin Wohlhueter, the duly appointed, qualified City
Clerk of the City of Auburn, a Municipal Corporation and
Code City, situate in the County of King, State of
Washington, do hereby certify that the foregoing is a full,
true and correct copy of Ordinance No. 4309 of the
ordinances of the City of Auburn, entitled "AN ORDINANCE."
I certify that said Ordinance No. 4309 was duly passed
by the Council and approved by the Mayor of the said City of
Auburn, on the 3rd day of October A.D., 1988.
I further certify that said Ordinance No. 4309 was
published as provided by law in the Valley Daily News, a
daily newspaper published in the City of Auburn, and of
general circulation therein, on the 6th day of October A.D.,
1988.
