T1Hi' qTY OF AUBURN, WASHINGTON, AMENDING ORDINANCE NO. 3 4308 TO INCORPORATE CONDITIONS WITHIN THE CONDITIONAL USE PERMIT. 4 WHEREAS, Ordinance No. 4308 was approved by the City Council on September 5 19, 1988; and 6 WHEREAS, certain conditions were inadvertently omitted; Qom` 0 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO NOW, — 8 — ORDAIN AS FOLLOWS: co 9 CO 10 Section 1. The purpose of this amending Ordinance is to correct the 11 omission of three conditions imposed upon the Conditional Use Permit. 12 Section 2. The ORDER provisions of Ordinance No. 4308 is amended to add 13 the following conditions: 14 15 6. Water shall be provided by the Federal Way Water and Sewer District and shall meet Auburn's standards for fire flow. 16 7. The construction of the project shall be consistent with the 17 "Nikiska" site plans as amended in accordance with Exhibit #3, with specific adherence to the park land and recreation facilities, 18 landscaping, erosion control measures, and the setbacks from the top of slope. The parking spaces do need to be redesigned to preclude 19 any overhang from being considered as part of the parking space. 20 8. The vegetation retention areas as required by the surface mining per- mit approved by Ordinance No. 4113 be retained. 21 22 Section 3. Upon the passage, approval and publication of this Ordinance 2 as provided by law the City Clerk of the City of Auburn shall cause this 3 Ordinance to be recorded in the office of the King County Auditor. 4 Section 5. The Mayor is hereby authorized to implement such administra- 5 tive procedures as may be necessary to carry out the directions of this 6 legislation. 7 Section 6.
