AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR
THE REZONING OF PROPERTY LOCATED ON THE WEST SIDE OF WYMAN
DRIVE IN THE 2700 BLOCK, WITHIN THE CITY OF AUBURN,
WASHINGTON, CHANGING THE ZONING CLASSIFICATION THEREOF FROM P-
1 (PUBLIC USE DISTRICT) TO I (INSTITUTIONAL USE DISTRICT) WITH
A CONDITIONAL USE PERMIT TO ALLOW FOR THE CONSTRUCTION OF A
7500 SQUARE FOOT INDUSTRIAL BUILDING.
WHEREAS, Application No. 39-88 has been submitted to the
Council of the City of Auburn, Washington, by AUBURN ADVENTIST
ACADEMY, requesting the rezoning of the real property
hereinafter described in Section 2 of the Ordinance, together
with a Conditional Use Permit, which application was dated
December 13, 1988; and
WHEREAS, said request above referred to was referred to
the Planning Commission by the Auburn City Council for study
and public hearing thereon; and
WHEREAS, the Planning Commission based upon staff review,
held a public hearing to consider said petition in the Council
Chambers of the Auburn City Hall, on January 4, 1989, at the
conclusion of which the Planning Commission recommended the
approval of the rezoning together with a Conditional Use
Permit of said property based upon the following findings of
the Department of Planning and Community Development, to -wit:
FINDINGS OF FACT
1. The Auburn Adventist Academy has requested a rezone from
P-1 (Public Use) to an I (Institutional Use District),
together with a Conditional Use Permit to allow the
construction of a 7500 +/- square foot industrial building
situated on 7.5 +/- acre parcel. The industrial building will
replace the building which was damaged by the fire on October
31, 1988.
2. The property is currently zoned P-1 (Public Use) and
would not allow for the construction of the industrial
building as planned by the Academy.

3. This industrial building, together with the adjoining
industrial uses, are all part of the Auburn Adventist Academy.
The Academy area has also been designated on the Comprehensive
Plan as being a Special Planning Area. Later this year a
master plan will be done for the Academy which will be
implemented by the establishment of the Institutional zone on
the area.
The Institutional zone is a new zone which was created
primarily to recognize the various activities of the Academy
Area, which include the industrial uses.
4. Since the Academy is wishing to quickly replace the use
that was damaged by the fire a rezone to the Institutional
zone is now necessitated in order to accommodate their
building schedule.
5. Pursuant to Section 18.44.030(B)(2) of the Zoning
Ordinance a conditional use permit may be granted for
"assembly/light manufacturing" uses if the following findings
of fact are met pursuant to Section 18.64.040:

CV A. The use will have no more adverse effect on the
O health, safety or comfort of persons living or
r. working in the area, and will be no more injurious,
CV economically or otherwise, to property or
CV improvements in the surrounding area, than would any
� use generally permitted in the district.

The industrial building as proposed will be used as
a hand assembly and packaging facility for the sole
purpose of student employment for the Academy
students.
This is a continuation of industrial activities that
have occurred at the Academy for a number of years.
This proposal will be located adjacent to those
other industrial uses and therefore there are no
adverse impacts anticipated.
B. The proposal is in accordance with the goals,
policies and objectives of the Comprehensive Plan.
The Comprehensive Plan designates the Academy as
being a Special Planning Area and on page 70 the
following describes the planning area.
"The Academy Special Planning Area will include a
diverse mixture of uses, all of which shall be
related to the mission and objectives of the Auburn
Adventist Academy. In general, such uses will be
related to the education of Academy students
(including workstudy or similar employment
opportunities); to the residential and residential
care needs of elderly or handicapped persons; or to
religious activities. Single family homes shall

also be permitted within the Academy Special
Planning Area."
This rezone and Conditional Use Permit is consistent
with the Comprehensive Plan.
The proposal complies with all requirements of the
Zoning Code.
The use as proposed is permitted in the "I" zone
subject to the issuance of the Conditional Use
Permit. The site plan indicates the use is able
to meet all the development standards of the
Zoning Ordinance.
D. The proposal can be constructed and maintained so
as to be harmonious and appropriate in design,
character, and appearance with the existing or
intended character of the general vicinity.
The proposal is an industrial building that will
be constructed adjacent to the other existing
industrial uses and therefore will be appropriate
for the area.
E. The proposal will not adversely affect the public
infrastructure.
There have been no indications that any public
facility will be adversely affected.
CONCLUSION OF LAW
The rezone and Conditional Use Permit is consistent with
the existing land use and will be consistent with the proposed
Institutional zone and with the Special Planning Area as
envisioned by the Comprehensive Plan.
WHEREAS, the City Council of the City of Auburn, held a
public hearing in the Council Chambers of the Auburn City
Hall, at 7:30 P.M. on January 16, 1989, at which time the City
Council concurred with the findings and conclusions of the
Department of Community Development and Planning Commission as
hereinabove stated; and
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:

Section 1. The following legally described property
located on the west side of Wyman Drive in the 2700 block,
situate in the CIty of Auburn, County of King, State of
Washington, be and the same is hereby rezoned from P-1 (Public
Use District) to I (Institutional Use District) together with
a Conditional Use Permit to allow for the construction of a
7500 square foot industrial building , to -wit:

Section 3. The Mayor is hereby authorized to implement
such administrative procedures as may be necessary to carry
out the directions of this legislation.
