WHEREAS, Application No. 41-88 has been submitted to the Council of the City of Auburn, Washington, by RON ANDERSON, BERNIE SCHEUBLE, CHRISTINE LANCASTER and RUTH DONKELAAR, requesting the rezoning of the real property hereinafter described in Section 2 of the Ordinance, which application was dated December 12, 1988; and WHEREAS, said request above referred to, was referred to the Hearing Examiner for study and public hearing thereon; and WHEREAS, the Hearing Examiner, based upon staff review, held a public hearing to consider said petition in the Council Chambers of the Auburn City Hall, on January 17, 1989, at the conclusion of which the Hearing Examiner recommended the approval of the rezoning of said property based upon the following Findings of Fact and Conclusions, to -wit: ------------------- Ordinance No. 4334 Page 1 March 14, 1989 REC"D F 10.00 55 1 2 3 4 5 6 7 8 c7 9 co 10 O 11 0` 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 FINDINGS OF FACT 1. The applicants, owners of four parcels of land located at 1205, 1215, 1221, and 1225 Harvey Road have requested a rezone. The applicants request that their property be rezoned from existing R-2 (Single Family Residential) to R-O (Residential Office) zone. 2. Currently, each one of the four parcels contains a single family home and as previously indicated is zoned R-2 (Single Family). 3. The Comprehensive Plan designates this subject site for residential office uses. Existing zoning and land uses in the vicinity include C-1, Commercial, to the north; R-2/R-O, Single Family/Office, to the south; R-O and C- 1, Multi -Family, to the east; and R-2, Single Family, to the west. The Comprehensive Plan designations for land in the vicinity include commercial to the north, residential office to the south and east, and single family to the west. 4. The applicant does not propose any development plans currently. 5. The site, located to the west of Harvey Road, runs parallel to Harvey Road and has its southern boundary on 12th Street N.E. 6. The evidence establishes that uses adjacent to Harvey Road have been converting to Professional Office uses over the years. 7. The intent of the residential office zone is to be compatible with adjoining residential zones. Specifically, the zone provides a number of protections for adjacent residential zones including development standards which contain setbacks, lot coverage limits and other use restrictions typical of residential zones. Further, a 10 foot wide landscaping buffer is required to protect adjacent residential uses and to provide an adequate transition between the residential office and residential uses. 9. At the time of the public hearing, a number of citizens objected of the proposed use. Specifically, citizen objections were based upon increased traffic, incompatibility of office and residential uses, potential erosion of the residential area through potential off -site parking problems, and lack of citizen safety as a result of the fact that motorists use 12th Street, south of the site, to short-cut from Harvey Road to Auburn Way North. 10. The Planning Department responds that the traffic to be generated by the proposed use will not be a significant increase over the currently existing traffic situation. 11. Staff further explained that substantial areas of the Harvey Road Corridor have already been rezoned for office uses. However, existing single family zoned lots with single family uses on them were not rezoned, although they were designated for residential office uses. At the time of the adoption of the Comprehensive Plan, containing a residential office zoning district, it was deemed appropriate to wait for owners of specific single family zoned parcels in the Harvey Road area to initiate rezone requests. 12. The City of Auburn Comprehensive Plan, adopted after numerous public hearing, recommends the site for Office -Residential uses. 2. The goal of the Office -Residential zone is to preserve areas to accommodate professional offices for expanding medical and business uses, while providing a transition between residential uses and more intensive uses and activities. 3. The Office -Residential zoning district provides a buffer between heavily travelled arterials and established single family areas. The Comprehensive Plan notes that the Office -Residential zoning district is "particularly appropriate in areas where large traffic volumes have affected and established residential area..." 4. There is no question that the traffic which travels on Harvey Road has affected the single family residential areas to the west and south. In fact, the zoning proposed will provide an adequate buffer and will help preserve the neighborhood from the increasing traffic pressures on the Harvey Road Corridor. For each of the above referenced reasons, the recommendation of the Hearing Examiner to the Auburn City Council on the requested rezone is approval. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The following legally described property located on the west side of Harvey Road in the 1200 block, situate in the City of Auburn, County of King, State of Washington, be and the same is hereby rezoned from R2 (Single Family) to R-O (Office Residential), to -wit: Lots 1, 2, 6 & 9 of Strand's 1st Addition to the City of Auburn. According to plat recorded in Volume 47 of Plats, page 68, records of King County. Section 3. Upon the passage, approval and publication of this Ordinance as provided by law, the City Clerk of the City of Auburn shall cause this Ordinance to be recorded in the office of the King County Auditor. Section 4. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 5.
