HomeMy WebLinkAbout43361 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 ORDINANCE NO. 4 3 3 6 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, REPEALING AUBURN CITY CODE SECTION 9.40.010 ENTITLED "OFFENSES DESIGNATED" contained in chapter 9.40 entitled "DISORDERLY CONDUCT" AND ADDING A NEW 9.40.010 CLARIFYING AND ADDING OFFENSES CONSTITUTING DISORDERLY CONDUCT. THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. PURPOSE. The purpose for repealing Auburn City Code Section 9.40.010 is to create a new Section 9.40.010 which changes and adds offenses constituting disorderly conduct and which removes the offense of criminal trespass to a new chapter of the criminal code. Section 2. Auburn City Code Section 9.40.010 entitled "Offenses Designated" contained in Chapter 9.40 entitled "Disorderly Conduct", passed by Ordinance No. 2742 (1973) is herewith repealed in its entirety. Section 3. There is added a new Section 9.40.010 to the Auburn City Code which shall read as follows: 9.40.010 Offenses Designated. A. A person is guilty of disorderly conduct if, he/she intentionally: -------------------- Ordinance No. 4336 Page 1 March 15, 1989 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 1. Creates a disturbance of the public order by an act of violence or by any act likely to produce violence; or 2. Engages in fighting or in violent, threatening, or tumultuous behavior; or 3. Makes any unreasonably loud noise; or 4. Uses abusive language and thereby intentionally creates a risk of assault; or 5. Disrupts any lawful assembly or meeting of persons without lawful authority; or 6. Obstructs vehicular or pedestrian traffic without lawful authority; or 7. Fails to obey a lawful order of dispersal by a police officer where he/she congregates with a group of three (3) or more other persons and there are acts of conduct within that group which create a substantial risk of causing injury to any person or substantial harm to property; or 8. Damages, befouls or disturbs public property or property of another so as to create a hazardous, unhealthy or physically offensive condition. -------------------- Ordinance No. 4336 Page 2 March 15, 1989 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 B. This chapter shall not apply to peaceful picketing, public speaking or other lawful expressions of opinion not in contravention of other laws. Section 4. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation. Section 5.
