HomeMy WebLinkAbout43411 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 ORDINANCE NO. 4 3 4 1 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AMENDING ONE SECTION OF CHAPTER 1.22 OF THE AUBURN CITY CODE ENTITLED "CITY JAIL PRISONERS WORK RELEASE PROGRAM" AND ADDING NEW SECTIONS 1.22.030 AND 1.22.040 TO THAT CHAPTER PROVIDING FOR AN ELECTRONIC ARREST PROGRAM AND AUTHORIZING PAYMENT OF FEES TO THE CITY BY PARTICIPANTS. THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. PURPOSE. The purpose of this Ordinance is to amend one section of the work release provisions and to add new Sections to Chapter 1.22 of the Auburn City Code currently entitled "City Jail Prisoners Work Release Program." The amendment to the work release provisions would require up to thirty (30) days prepayment of costs to the City. The current ordinance requires prepayment of costs for one week. The new sections would authorize the implementation of an electronic house arrest program for eligible persons who are incarcerated in the Auburn City Jail. The electronic house arrest program would be developed and implemented by the Police Department in the form of a policy. The program has been endorsed by the Judges of Aukeen District Court. The program would also require that eligible persons may be charged an amount for participation in the program. ------------------- Ordinance No. 4341 Page 1 March 29, 1989 1' 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 Section 2. 1.22.010, passed by Ordinance No. 4222 passed May 4, 1987, is hereby amended to read as follows: 1.22.010 Work release participants -Fees paid.to city. Pursuant to the provisions of RCW 70.48.210 of the laws of the state of Washington, all persons ordered incarcerated in the Auburn City Jail by appropriate court order who are authorized by appropriate court order to engage in a work release program shall be charged by the city an amount to be established by the mayor that is less than or equal to the actual daily costs of incarceration in the Auburn City Jail during said work release program to be paid to the finance department for ((ene-week)) up to thirty (30) days in advance and a receipt of that payment shown as proof thereof. Section 3. There is added a new Section 1.22.030 to Chapter 1.22 of the Auburn City Code entitled "City Jail Prisoners Work Release Program" to read as follows: 1.22.030 - All persons ordered incarcerated in the Auburn City Jail by appropriate Court order may be allowed the option of participating in an electronic house arrest program as an alternative to incarceration ------------------- Ordinance No. 4341 Page 2 March 29, 1989 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 and only if the defendant is determined to be eligible for participation according to the City of Auburn procedures The defendant may be charged a fee by the City in an amount to be established by the Mayor that is less than or equal to the following amount: the billable costs to the City for the electronic house arrest equipment, multiplied by two and one-half, to cover the City's costs in administering and monitoring the program. The participant shall pay to the City for up to thirty (30) days of the electronic house arrest fee in advance and a receipt of that payment shall be issued to the participant. Such costs of the electronic house arrest program shall be paid by the participant to the City in accordance with the policies and requirements of the City Finance Department. Section 3. There is hereby added a Section 1.22.040 to Chapter 1.22 of the Auburn City Code which is entitled "City Jail Prisoners Work Release Program", to read as follows: 1.22.040. If a prisoner eligible for and participating in the electronic house arrest program violates the conditions of such electronic house arrest program, said person shall be returned to the Auburn City Jail for the remainder of their sentence. The City is authorized to adopt and implement the electronic house arrest program as a Policy of the City of Auburn Police Department which Policy shall establish the screening procedures, fees, agreements, and procedures to implement the policy. The Mayor and the City Clerk are authorized to enter into agreements for the lease of electronic house arrest monitorina eauipment for use in the program. Section 4. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation. ------------------- Ordinance No. 4341 Page 4 March 29, 1989 1 2 3 4 5 61 7 8 9 10 11 12 13 1 15 16 17 18 19 20 21 22 23 24 25 26 Section 5. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law.
