HomeMy WebLinkAbout4342P 0 0 In 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 ORDINANCE NO. 4 3 4 2 A ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, APPROVING THE VACATION OF A STREET RIGHT OF WAY DESIGNATED AS ROSE STREET, WITHIN THE CITY OF AUBURN, WASHINGTON, AND RETAINING A UTILITY EASEMENT TO THE CITY.. WHEREAS, a petition has been filed by the owners of two-thirds or.more of the property abutting the portion of right of way requested to be vacated; and WHEREAS, the statute requires that the City Council schedule a public hearing when a valid petition is filed with the City; and WHEREAS, the public hearing was held on March 20, 1989 before the City Council; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The street right of way to be vacated is located on that portion of land designated as Rose Street (S. 288th Street) located adjacent to the northern border of parcels B, C and D on the Plat of the Town of Christopher, legally described as follows: THAT PORTION OF ROSE STREET AS SHOWN ON THE PLAT OF THE TOWN OF CHRISTOPHER AS RECORDED IN VOLUME 7 OF PLATS PAGE 30, RECORDS OF KING COUNTY, WASHINGTON, LYING WEST OF THE WEST MARGIN OF THE BURLINGTON NORTHERN RAILROAD COMPANY RIGHT OF WAY AND LYING EAST OF THAT PORTION OF SAID ROSE STREET VACATED BY KING COUNTY. RECD F 7.00 �" � ------------------- CASHSL ***+::+:7. 00 Ordinance No. 4342 Page 1 March 30, 1989 55 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 LESS A 60.00 FOOT WIDE STRIP OF LAND HAVING 30.00 FEET ON BOTH SIDES OF THE FOLLOWING DESCRIBED CENTERLINE: BEGINNING AT THE SOUTHWEST CORNER OF LOT "C" OF SAID PLAT OF THE TOWN OF CHRISTOPHER; THENCE EASTERLY ALONG THE SOUTH BOUNDARY OF SAID LOT "C", 75.46 FEET TO THE TRUE POINT OF BEGINNING; THENCE NORTHERLY TO THE SOUTHWEST CORNER OF LOT No.12 OF WHITE RIVER VALLEY HOME TRACTS AS RECORDED IN VOLUME 13 OF PLATS, PAGE 17, RECORDS OF KING COUNTY, WASHINGTON. THE NORTHERLY TERMINUS OF SAID 60.00 FOOT STRIP OF LAND SHALL ABUT AND ADJOIN THE SOUTH BOUNDARY OF SAID PLAT OF WHITE RIVER VALLEY HOME TRACTS. be and the same is hereby vacated, and the property lying in said portion of a certain street right of way described hereinabove, shall be returned and belong to those persons entitled to receive the property in accordance with the law. Section 2. The City hereby reserves an easement for access and for the construction, repair and maintenance of public utilities and services over, across, upon and underneath the property described in Section 1 of this Ordinance. Section 3. Upon the passage, approval and publication of this Ordinance, the City Clerk for the City of Auburn shall cause this Ordinance to be recorded in the office of the King County Auditor. Section 5. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation. I certify that said Ordinance No. 4342 was duly passed by the Council and approved by the Mayor of the said City of Auburn, on the the 3rd day of April A.D., 1989. I further certify that said Ordinance No. 4342 was published as provided by law in the Valley Daily News, a daily newspaper published in the City of Auburn, and of general circulation therein, on the 9th day of April, A.D., 1989.
