HomeMy WebLinkAbout43451 8 LLJ RECD F 9.00 coUJ ORDINANCE NO. 4 3 4 5 S r 2 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE REZONING OF PROPERTY LOCATED AT 1015 HARVEY ROAD, 3 WITHIN THE CITY OF AUBURN, WASHINGTON, CHANGING THE ZONING CLASSIFICATION THEREOF FROM R-2 (SINGLE FAMILY) TO R-O 4 (OFFICE RESIDENTIAL). 5 6 7 CD 8 O 9 U0 �4 10 to 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 WHEREAS, Application No. REZ0001-89 has been submitted to the Council- of the City of Auburn, Washington, by JAMES and BEVERLY REICH, requesting the rezoning of the real property hereinafter described in Section 2 of the Ordinance, which application was dated February 1, 1989; and WHEREAS, said request above.referred to, was referred to the Hearing Examiner for study and public hearing thereon; and WHEREAS, the Hearing Examiner, based upon staff review, held a public hearing to consider said petition in the Council Chambers of the Auburn City Hall, on March 21, 1989, at the conclusion of which the Hearing Examiner recommended the approval of the rezoning of said property based upon the following Findings of Fact and Conclusions, to -wit: FINDINGS OF FACT 1. The applicants, James and Beverly Reich, request a rezone from R-2 (Single Family) to R-O (Residential Office) . 2. The subject site is designated for residential office uses in the Comprehensive Plan. 4. Existing zoning and land uses in the vicinity include R-0, Office, to the north; R-2/R-0, Single Family, to the south; R-0, Office/Multiple Family, to the east; and R-2, Single Family, to the west. The Comprehensive Plan designates adjacent uses to the north and east for residential office uses while land to the south is designated for residential office and single family uses and land to the west of the site is designated for single family uses. 5. The subject rezone site is located in the vicinity of Harvey Road which is a planned five land arterial. The evidence establishes that uses adjacent to Harvey Road have been converting to professional office uses over the years. 6. Almost all parcels such as this one abutting Harvey Road have been zoned to R-O, Residential Office. 7. It is the intent of the Comprehensive Plan to develop residential office uses in a manner compatible with adjoining residential zones. Specifically, the existing R-0 zone establishes development standards which are typical of residential zones in terms of setbacks and lot coverage. 8. The applicant does not propose a site specific development plan at this time. At the time that a site specific development plan is proposed, the plan will be evaluated pursuant to the State Environmental Policy Act. 9. There was no public testimony in connection with this application. 10. The rezone as proposed is consistent with the existing land uses in the vicinity and consistent with the office/residential land use classification in the City of Auburn Comprehensive Plan. 2. Conditions have changed substantially since the original single family zoning designation was placed on the site to justify the residential office zone. Specifically, the development of the Harvey Road Corridor and the planned conversion to a five lane arterial coupled with the rezoning of adjacent parcels in the vicinity for office uses justify the zoning change sought. 3. Impacts of future development on the site can be mitigated through the procedures set forth in the State Environmental Policy Act. For each of the above referenced reasons, the recommendation of the Hearing Examiner to the Auburn City Council on the requested rezone is approval. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The above cited Hearing Examiner's Findings of Fact and Conclusions, are herewith incorporated in this Ordinance. Section 2. The following legally described property located 1015 Harvey Road, situate in the City of Auburn, County of King, State of Washington, be and the same is hereby rezoned from R2 (Single Family) to R-O (Office Residential), to -wit: ------------------- Ordinance No. 4345 Page 3 April 12, 1989 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 That portion of Lots 7, 8, 9 and 10 lying westerly of Harvey Road. Except the southerly 120 feet thereof. Except that portion of the N 1/2 of the N 1/2 of Lots 7 and 8 lying westerly of Harvey Road. Plus the S 1/2 of the N 1/2 of Lots 4, 5, and 6 together with the S 1/2 of the N 1/2 of the east 1/2 of Lot 3. All within Block 16 of C.D. Hillman's Auburndale Addition to the City of Seattle, Division 2, as per plat recorded in Volume 13 of Plats, page 92 in King County, Washington. Section 3. Upon the passage, approval and publication of this Ordinance as provided by law, the City Clerk of the City of Auburn shall cause this Ordinance to be recorded in the office of the King County Auditor. Section 4. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 5.
