HomeMy WebLinkAbout43531 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 ORDINANCE NO. 4 3 5 3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, APPROVING AN APPROPRIATION NOT TO EXCEED ONE HUNDRED FORTY-THREE THOUSAND FOUR HUNDRED FIFTY-FOUR DOLLARS, ($143,454), AND AUTHORIZING THE MAYOR TO EXECUTE NARCOTICS CONTROL GRANT CONTRACT BETWEEN THE CITY AND THE STATE OF WASHINGTON DEPARTMENT OF COMMUNITY DEVELOPMENT. WHEREAS, the Auburn City Council of the City of Auburn must adopt and approve all appropriations by Ordinance pursuant to Chapter 35A.33 RCW; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Pursuant to Chapter 35A.33 RCW the City hereby approves the expenditure and appropriation of a maximum of ONE HUNDRED FORTY-THREE THOUSAND FOUR HUNDRED FIFTY-FOUR DOLLARS ($143,454), which constitutes a Narcotics Control Grant pursuant to the Agreement between the State of Washington Department of Community Development and the City of Auburn. Section 2. The Mayor and City Clerk of the City of Auburn are authorized to execute the Washington State Narcotics Control Program Agreement which will provide grant funding to the City of Auburn for use by the Regional Drug ------------------- Ordinance No. 4353 Page 1 June 9, 1989 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 Task Force for drug law enforcement. A copy of said Agreement is attached hereto and designated Exhibit A and is incorporated by reference in this Ordinance. Section 3. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation. Section 4. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law.. State of Washington Department of Community Development WASHINGTON STATE NARCOTICS CONTROL PROGRAM PROJECT STATUS REPORT Provide a narrative description of the operation and performance of the task force as funded from January through June 1989. Describe the status of the funds expended during that time period, the activities for that period, the results or performance of the task force operation, and any significant changes from the previous design or organization of the task force. The first quarter of 1989 was very active for the Task Force. Sixteen cases were initiated which produced the following results: Value cocaine seized - $15,200.00 Value marijuana seized - $3,238,140.00 Value other drugs seized - $60.00 Currency seized - $7,985.00 Vehicles seized - #7 Arrests - #24 Four of the sixteen cases are still open. The Task Force has expended approximately $48,000.00 of our budget in the first quarter of 1989. The Task Force design and organization does not have any significant changes. The King County Prosecutor's office could not provide a prosecutor part time and we are forced to hirer an attorney for legal advice on a case by case basis. -- State of Washington Department of Community Development �'s.,,,• WASHINGTON STATE NARCOTICS CONTROL PROGRAM 3. WORK PLAN Provide a narrative description of the work plan for which continued funding is requested. Include phases of the operation, personnel, and other resources needed, and the specific, targeted objectives to be attained relative to the goal of reducing drug trafficking in the region. The Task Force plans to continue targeting mid and upper level cocaine dealers. Organized marijuana grow operations are a problem in our area and have also been targeted. We expect to continue working joint cases with local, state, and federal agencies. Our goal for 1989 is to reduce drug trafficking in the region by: 'Successfully prosecuting 20 mid to upper level dealers. 'Seize and forfeit assets related to drug operations. 'Seize controlled substances so they are not available for street use. 'Work jointly with and share intelligence information with other agencies to develop a better understanding of supply routes. 'Increase citizen awareness of illicit drug use activity in the region. Task Force personnel include three investigators, one supervisor, and a secretary. Each agency is represented by a Commissioned Officer. The King County Prosecutor's office was unable to provide a prosecutor and the Task Force is forced to hirer an attorney for legal advice on a case by case basis. The equipment catagory covers lease, maintenance, and operating expenses for four vehicles. Maintenance and rent on pagers, communication equipment and copy machine are included in this catagory. Facilities include office rent and phone bills. Training includes one Western State Information Network Conference, one Washington State Narcotics Investigators Conference and computer training. Supplies are the usual office needs such as computer paper, copier paper, envelopes, stamps, type ribbon, printer supplies, etc. Operating expenses included petty cash and travel expenses. Parking fees, travel to other jurisdictions, emergency supplies and miscellaneous fees are budgeted in this catagory. Confidential funds cover the cost of purchasing services, purchasing information. and purchasing information, and purchasing evidence. CERTIFIED ASSURANCES The Applicant assures that, following the first fiscal year covered by this Agreement and each fiscal year thereafter, it shall submit to the Washington State Department of Community Development a summary of the activities carried out with grant funds and an assessment of the impact of such activities on meeting the needs identified in the Statewide Strategy submitted under section 1302 of the Anti -Drug Abuse Act of 1988 (hereinafter referred to as "the Act"). The Applicant assures that federal funds made available under section 1302 of the Act will not be used to supplant local funds, but will be used to increase the amounts of such funds that would, in the absence of federal funds, be made available for drug law enforcement activities. The Applicant assures that matching funds required to pay the non- federal portion of the cost of its program or project, for which federal grant funds are made available, shall be in addition to the Applicant's funds that would otherwise be made available for drug law enforcement. The Applicant assures that fund accounting, auditing, monitoring, and such evaluation procedures as may be necessary, to keep such records as the U.S. Bureau of Justice Assistance-(BJA) shall prescribe, shall be provided to assure fiscal control, proper management, and efficient disbursement of funds received under the Act. The Applicant assures that it shall maintain such data and information and submit such reports, in such form, at such times, and containing such information as BJA may require. The Applicant assures that it will comply, and all its subgrantees and contractors will comply, with the nondiscrimination requirements of Title VI of the Civil Rights Act of 1964; Section 504 of the Rehabilitation Act of 1973, as amended; Title IX of the Education Amendments of 1972; the Age Discrimination Act of 1975; the Department of Justice Nondiscrimination Regulations 28 CFR Part 42, Subparts C, D, E, and G; and, Executive Order 11246, as amended by Executive Order 11375, and their implementing regulations, 41 CFR Part 60.1 et sec., as applicable to construction contracts. The Applicant assures that in the event a federal or state court or federal or state administrative agency makes a finding of discrimination after a due process hearing on the grounds of race, color, religion, national origin, or sex against a recipient of funds, the recipient will forward a copy of the finding to the Office of Civil Rights Compliance, Office of Justice Programs. The Applicant assures that it will comply with the provisions of the Office of Justice Programs' "Financial and Administrative Guide for Grants," M7100.1C. The Applicant assures that it will enter into an Interagency Agreement with all agencies participating in the Task Force project. The Interagency Agreement shall specify the purpose of the Task Force, the organizational structure, the roles of each jurisdiction, the terms and conditions of programmatic and financial participation, and procedures for disposing of any equipment purchased with project funds or assets seized as a result of successful operations. CERTIFICATION I certify that the programs proposed in this application meet all the requirements of the Anti -Drug Abuse Act of 1988, Subtitle C-State and Local Narcotics Control and Justice Assistance Improvements of 1988, Public Law 100-690 (November 18, 1988), that all the information presented is correct, that there has been appropriate coordination with affected agencies, and that the Applicant will comply with the provisions of the Act and all other federal laws, regulations, and guidelines.
