HomeMy WebLinkAbout4356li 2 31 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 ORDINANCE NO. 4 3 5 6 AN ORDINANCE AMENDING CHAPTER 8.08 OF THE AUBURN CITY CODE ENTITLED "GARBAGE" TO ADD A NEW SUBPARAGRAPH E TO SECTION 8.08.240 ENTITLED, "COLLECTION - CHARGES - RESIDENTIAL OR COMMERCIAL COLLECTIONS," TO AUTHORIZE THE CITY TO CHARGE ALL THOSE RECEIVING SERVICES THE STATE REFUSE COLLECTION TAX, SOLID WASTE COLLECTION TAX AND BUSINESS AND OCCUPATIONAL TAX ASSESSED AGAINST THE CITY FOR ITS REFUSE COLLECTION SERVICE. WHEREAS, the State imposes taxes on collection services pursuant to Chapter 82.18 RCW and a business and occupation tax on the collection service pursuant to RCW 82.04.290; and WHEREAS, the current provisions of the Auburn City code providing for the collection of charges from residential or commercial users does not authorize the City to collect or "pass through" the refuse collection tax, solid waste collection tax, and the business and occupation tax assessed against the City for its refuse collection service; and WHEREAS, the current provisions of Auburn City Code Section 8.08.240 should provide authorization for the City to collect or "pass through" the state refuse collection tax, solid waste collection tax and business and occupation tax imposed on the City's refuse collection service. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: ------------------- Ordinance No. 4356 Page 1 July 7, 1989 1'I 2 3 4 5 6 7' 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 Section 1. PURPOSE. The purpose of this ordinance is to amend the Auburn City Code Chapter 8.08 entitled "Garbage", particularly Section 8.08.240 entitled "Collection - Charges - Residential or Commercial Collections" to authorize the City to charge all those receiving garbage collection services the state refuse collection tax, solid waste collection tax and business and occupation tax assessed against the City on its refuse collection service. Section 2. There is hereby added to Section 8.08.240, a Subparagraph E to read as follows: E. In addition to the rates and charges herein, all service users shall be charged the refuse collection tax and the solid waste collection tax imposed under Chapter 82.18 RCW and the state business and occupation tax imposed under RCW 82.04.290. Section 3. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 4.
