WHEREAS, Application No. REZ0009-89 has been submitted to the Council of the City of Auburn, Washington, by JERRY PERSON, requesting the rezone and Comprehensive Plan Map amendment of the real property hereinafter described in Section 2 of the Ordinance, which application was dated September 20, 1989; and, WHEREAS, said request above referred to, was referred to the Planning Commission for study and public hearing thereon; and WHEREAS, the Planning Commission, based upon staff review, held a public hearing to consider said petition in the Council Chambers of the Auburn City Hall, on November 7, 1989, at the conclusion of which the Planning Commission recommended the approval of the request for rezone and Comprehensive Plan amendment of said property based upon the following Findings of Fact and Conclusions, to -wit: ------------------- Ordinance No. 4384 November 27, 1989 Page 1 89f 12rt13 #1100 RECG F 10.00 RECFEE 2.00 CASHSL ***12. 00 35 CITY CL RK'S OFFICE CITY OF AUBURN 25 West Main Auburn, WA 98001 1 2 3 4 5 6 7 8 9 ® 10 ,F4 11 a-4 12 cd 13 X 14 15 16 17 18 19 20 21 22 23 24 25 26 FINDINGS OF FACT 1. The applicant is requesting a rezone from R-MHP (Residential Mobile Home Park) to C-3 (Heavy Commercial). A Comprehensive Plan Map amendment from high density residential to heavy commercial is also part of the application. 2. The proposed rezone is part of a larger parcel that has frontage on "A" Street S.E. The portion of the parcel that abuts "A" Street is zoned C-3 and extends 220 feet deep. 3. The Comprehensive Map designation of high density residential and the R-MHP zone were established on the parcel as a result of the 1986 Comprehensive Plan and 1987 area wide zoning. The map designation and zone were put on the parcel because the property was zoned R-5. The R-5 zone was an old mobile home park zone that was established in the 1960's. 4. The site of the proposed rezone is currently vacant and is not part of the adjoining two mobile home parks. 5. If the property is zoned C-3 the Zoning Code requires that a 10 foot wide landscaped area will be required to be placed adjacent to the R-MHP zoned property upon development of the C-3 area. 6. The proposed rezone has access to "A" Street S.E. which is developed as a 5 lane arterial with the utilities necessary to serve a commercial development. 7. Related Comprehensive Plan Objectives and Policies: Objective 20.3. To encourage the appropriate use of areas adjacent to heavily travelled arterials while minimizing land use and traffic conflicts by: ------------------- Ordinance No. 4384 November 27, 1989 Page 2 CITY CLE K'S OFFICE CITY 0 AUBURN 25 st Main Auburn, A 98001 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 Managing the continued commercial development of existing commercial arterials in a manner which minimizes traffic and land use conflicts. Policy 20.3.1. The City shall identify those existing commercial arterials that are appropriate for continued general (heavy) commercial development, and those arterials that are appropriate for continued or future limited (i.e. professional office type) commercial development. Policy 20.3.2. The City shall encourage the grouping of individual commercial enterprises along commercial arterials in order to promote the sharing of parking areas, access drives and signs. Such grouping can be encouraged through land division regulations, sign regulations and development standards. CONCLUSIONS OF LAW 1. The proposal is consistent with the Comprehensive Plan Map designations, zoning and existing commercial uses that are developing along the "A" Street corridor. 2. The proposal is consistent with the Comprehensive Plan policies in that it provides for commercial uses along a heavily travelled arterial and also provides for a larger C-3 zoned area that could allow for the grouping of commercial uses. ------------------- Ordinance No. 4384 November 27, 1989 Page 3 G�1 OITY C4- RK'S OFFICE CITY F A68URN 25 est Main Auburn, WA 98001 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 19 20 21 22 23 24 25 26 For each of the above referenced reasons, the recommendation of the Planning Commission to the Auburn City Council on the requested rezone and Comprehensive Plan Map amendment is approved. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The above cited Planning Commission's Findings of Fact and Conclusions, are herewith incorporated in this Ordinance. Section 2. The property located at 3802 "A" Street S.E. and legally described in the attached Exhibit A, situate in the City of Auburn, County of King, State of Washington, be and the same is hereby rezoned from R-MHP (Residential Mobile Home Park) to C-3 (Heavy Commercial) togetherwith a Comprehensive Plan Map amendment from high density residential to heavy commercial is hereby approved. Section 3. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 5. This Ordinance shall take effect and be in force five days from and after its passage, approval and publication as provided by law.
