PROVIDING FOR
THE REZONING OF PROPERTY LOCATED ON THE WEST
SIDE
OF "F"
STREET
S.E. IN THE 1700-1800 BLOCKS, WITHIN
THE
CITY OF
AUBURN,
WASHINGTON, CHANGING THE ZONING CLASSIFICATION
THEREOF
FROM I
(INSTITUTIONAL) TO R-4 (MULTI -FAMILY) AND
COMPREHENSIVE
PLAN MAP AMENDMENT FROM PUBLIC AND QUASI PUBLIC
TO HIGH
DENSITY
RESIDENTIAL.
WHEREAS, Application No. REZ0010-89 has been submitted to
the Council of the City of Auburn, Washington, by GEORGE
SMITH, requesting the rezone and Comprehensive Plan Map
amendment of the real property hereinafter described in
Section 2 of the Ordinance, which application was dated
September 25, 1989; and,
WHEREAS, said request above referred to, was referred to
the Planning Commission for study and public hearing thereon;
and
WHEREAS, the Planning Commission, based upon staff
review, held a public hearing to consider said petition in the
Council Chambers of the Auburn City Hall, on November 7, 1989,
at the conclusion of which the Planning Commission recommended
the approval of the request for rezone and Comprehensive Plan
amendment of said property based upon the following Findings
of Fact and Conclusions, to -wit:

FINDINGS OF FACT
1. The applicant is requesting a rezone from the "I"
(Institutional) zone to the R-4 (Multi -Family) zone
togetherwith a Comprehensive Plan Map amendment from
public and quasi public to high density residential.
2. The parcel is vacant, 2± acres in size and has been
part of the First Christian Church property.
3. The proposal lies adjacent to a vacant R-4 zoned
parcel to the west and to a developed R-4 zoned
parcel to the south. To the north is the First
Christian Church and to the east is the Auburn Stake
Center.
4. The proposal fronts on "F" Street S.E. which is a
designated arterial which is currently developed to
City standards.
5. The applicant is proposing a 17 unit multi -family
complex. The site, if zoned R-4, would be large
enough to accommodate 36 units.
6. The "I" (Institutional) zone, was established on the
property in 1987 as part of the area wide zoning
done by the City. The primary reason the "I" zone
was placed on the property was to recognize the
ownership boundaries of the First Christian Church.
7. Related Comprehensive Plan Objectives and Policies:
Objective 19.4. To provide for the need for
multiple family dwellings by people within the local
area, while avoiding conflict with single family
residential areas.
Policies:
19.4.1. Multiple family dwellings shall not be
permitted as a matter of right in Designated Single
Family neighborhoods, but should be permitted only
where necessary to remove potential blight, to

buffer single family uses from incompatible uses or
activities, or to allow effective use of vacant
areas. Standards for such siting should provide for
design review to ensure compatibility and provide
that the density of development is consistent with
the density of the adjoining single family uses.
19.4.2. Siting of moderate density units shall be
encouraged as a buffer between single family areas
and more intense uses. Such buffering is
appropriate along arterials where existing platting
prevents effective lot layout for single family
units. Also, such buffering is appropriate between
single family areas and commercial and industrial
uses. Where there are established single family
areas the design and siting of these units shall be
controlled to reduce potential conflicts and to
ensure buffering of uses. Higher density units are
not to be considered such a buffer.
19.4.3. Higher density developments or larger scale
multiple family developments should be limited to
residential areas which are either not well suited
for single family uses or areas in which such
development can be developed as a unit with the
necessary supporting facilities. Such development
shall provide adequate access by developed arterials
with minimal potential to generate traffic through
designated single family areas. Extensive buffering
measures may be required where such areas adjoin
single family residential areas. Where feasible,
new multi -family development should be planned in
conjunction with single family and moderate density
development
19.4.4. In considering where future higher density
development should locate, priority shall be given
to designated Special Planning Areas where such use
can be balanced and planned with single family
areas.
19.4.5. Unless required for other purposes, the
need for new higher density developments shall be
based on local need for such units and should not

substantially exceed a fair regional share of such
housing.
19.4.6. Multiple -family developments should be
located functionally convenient to the necessary
supporting facilities including utilities,
arterials, parks, transit service, etc.
CONCLUSIONS OF LAW
1. The proposal is consistent with the Comprehensive
Plan Map designations, zoning and existing uses in
the area.
2. The proposal is consistent with the Comprehensive
Plan policies in that it does not conflict with
single family areas, the reduced density is
compatible with adjoining uses, all the supporting
facilities, i.e. utilities and arterials are present
to serve the proposal.
3. The existing Public/Quasi/Public Comprehensive Plan
Map designation and "I" zone reflect the church
ownership. If there were to be a use proposed other
than related to the church, the most appropriate
would be a compatible multi -family use.
For each of the above referenced reasons, the
recommendation of the Planning Commission to the Auburn City

Council on the requested rezone and Comprehensive Plan Map
amendment is approved.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. The above cited Planning Commission's
Findings of Fact and Conclusions, are herewith incorporated in
this Ordinance.
Section 2. The property located on the west side of "F"
Street S.E. in the 1700-1800 blocks and legally described as
follows, situate in the City of Auburn, County of King, State
of Washington, be and the same is hereby rezoned from I
(Institutional) to R-4 (Multi -Family) togetherwith a
Comprehensive Plan Map amendment from public and quasi public
to high density residential.
The east 1/2 of the northwest 1/4 of the
northwest 1/4 of the southwest 1/4 of Section
19, Township 21 North, Range 5 East, W.M.;
Except the south 90 feet; and except the north
30 feet for 17th Street S.E.; and except the
north 35 feet conveyed to the City of Auburn by
deed recorded under recording No. 8011050753;
and except the east 25 feet conveyed to the
City of Auburn by deed recorded under Recording
No. 860751185; situate in the City of Auburn,
County of King, State of Washington.

Section 3. In order to ensure compatibility with the
adjoining church uses and the condominiums to the south, the
proposal shall be limited to the 17 units as proposed.
Section 4. Construction of the project should be
generally consistent with the site plan entitled "Emerald
Villa".
Section 5. Upon the passage, approval and publication of
this Ordinance as provided by law, the City Clerk of the City
of Auburn shall cause this Ordinance to be recorded in the
office of the King County Auditor.
Section 6. The Mayor is hereby authorized to implement
such administrative procedures as may be necessary to carry
out the directions of this legislation.
Section 7. This Ordinance shall take effect and be in
force five days from and after its passage, approval and
publication as provided by law.
