WHEREAS, the City of Auburn, has been contacted by numerous citizens complaining that the riders of these devices have not operated with care in high volume pedestrian and vehicular traffic areas of the city, and WHEREAS, the City Council finds that the riding of these devices, even if done in.a non -negligent manner, is a serious matter of public safety and public well being, including that of the riders of these devices, due to the inherent speed, maneuverability and danger of these devices and the potential for serious injuries, and WHEREAS, the Council finds that the provisions of this ordinance are necessary and in the public interest and safety; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, KING COUNTY, WASHINGTON, DO ORDAIN AS FOLLOWS: ------------------ Ordinance No. 4386 December 19, 1989 Page 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 Section 1. NEW CHAPTER. Title 10 of the City of Auburn Code entitled, VEHICLES AND TRAFFIC, is amended to add a new chapter designated Chapter 10.58, entitled "SKATEBOARD, ROLLER SKATES AND COASTERS", to read as follows: CHAPTER 10.58 SKATEBOARD, ROLLER SKATES AND COASTERS SECTIONS 10.58.010 Definitions 10.58.020 Traffic Regulations 10.58.030 Speed 10.58.040 Prohibited Areas 10.58.050 Violations - Penalty 10.58.010 DEFINITIONS The following words and phrases when used in this chapter shall, for the purpose of this chapter, have the meanings respectively ascribed to them in this section. A. "Skateboard" means a footboard mounted upon four or more wheels and is usually propelled by the user who sometimes stands, sits, kneels, or lays upon the device while it is in motion. B. "Roller Skates" means a pair of shoes, mounted upon two sets of wheels and is most often propelled by the user in an upright, standing position or kneeling. ------------------ Ordinance No. 4386 December 19, 1989 Page 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 C. "Coasters" means a footboard mounted upon two or more wheels and controlled by an upright steering handle. This device is propelled by the user in usually an upright position. D. "To operate in a negligent manner" means the operation of one or more of the above described devices in such a manner as to endanger or be likely to endanger any person or property. Examples of operating in a negligent manner include, but are not limited to, failure to obey all traffic control devices, failure to yield right of way to pedestrians and/or vehicular traffic. 10.58.020 TRAFFIC CONTROL DEVICES Any person operating a skateboard, roller skates or coasters shall obey the instructions of official traffic control signals, signs, and other control devices applicable to vehicles, unless otherwise directed by a police officer. 10.58.030 SPEED No skateboard, roller skates or coasters, shall be ridden in a negligent manner but shall be operated with reasonable regard for the safety of the operator and other persons. 10.58.040 PROHIBITED AREAS It is unlawful for any person to operate or ride upon any skateboard, roller skates or coasters, upon any street, alley, sidewalk, or publicly owned parking lot in the Central Business District of the City of Auburn as described in Chapter 18.06.010, Subsection A-11 of the City Code Book and as delineated in the map attached, designated Exhibit A and incorporated in this ordinance. ------------------ Ordinance No. 4386 December 19, 1989 Page 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 10.58.050 VIOLATION - PENALTY Any person violating any provision of this chapter shall be guilty of an infraction and shall be punished by the imposition of a monetary penalty of not more than One Hundred ($100.00) dollars. Further, that person shall be subject to the impound of the device ridden at the time of violation, for a period of ten (10) days. Section 2. SEVERABILITY If any provision of this ordinance, or its application to any person or circumstances is held invalid, the remainder of the ordinance, or application of the provision to other persons or circumstances, shall be unaffected. Section 3. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. ------------------ Ordinance No. 4386 December 19, 1989 Page 4 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 19 20 21 22 23 24 25 26 Section 4. This Ordinance shall take effect and be in force five days from and after its passage, approval and publication as provided by law.
