(SO. 277TH) AND EAST OF "I" STREET N.E. (IF EXTENDED), WITHIN THE CITY OF AUBURN, WASHINGTON, CHANGING THE ZONING CLASSIFICATION THEREOF FROM R-4 (MULTI FAMILY) TO R-2 (SINGLE FAMILY). WHEREAS, Application No. REZ0011-89 has been submitted to the Council of the City of Auburn, Washington, by RIVERBEND ESTATES LIMITED PARTNERSHIP, requesting the rezoning of the real property hereinafter described in Section 2 of the Ordinance, which application was dated November 9, 1989; and WHEREAS, said request above referred to, was referred to the Hearing Examiner for study and public hearing thereon; and WHEREAS, the Hearing Examiner, based upon staff review, held a public hearing to consider said petition in the Council Chambers of the Auburn City Hall, on December 19, 1989, at the conclusion of which the Hearing Examiner recommended the approval of the rezoning of said property based upon the following Findings of Fact and Conclusions, to -wit: ------------------- Ordinance No. 4408 January 25, 1990 Page 1 555 A 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 Q 17,: 18 19 20 21 22 23 24 25 26 FINDINGS OF FACT 1. The applicant, P. Hendley & Associates Inc. for Riverbend Estates Limited Partnership applies for a rezone from R- 4, Multiple Family Residential to R-2, Single Family Residential District. 2. The area which the applicant is proposing to rezone is located in the northern section of the plat. Currently approximately 25 of the single family lots proposed in the preliminary plat are located in an R-4 zone. Thus the applicant seeks a rezone to R-2 so that all of the single family lots will have consistent zoning and uses. 3. Surrounding zoning and land uses in the vicinity include King County, rural to the north; R-2, vacant to the south; R-2, vacant to the east; and R-4, vacant to the west. The subject site is designated for single and multi -family uses consistent with the proposed location of the single and multi -family uses on the site. Property to the south and east is designated for single family uses in the Comprehensive Plan while multiple family uses are recommended to the west. As previously indicated, property to the north is located in King County. 4. The subject property is located on the south side of 52nd Street N.E. (South 277th) if extended and adjacent to the Green River. The City of Auburn issued a Final Environmental Impact Statement in May of 1980 for a project involving 390 single family lots and 540 multiple family units. Currently the multiple family has been limited to 50'0 units which will be located on the western portion of the site within an existing R-4 zone. The requirements of the R-4 zone include 2400 square feet of land area per unit. The 500 units which will be developed are located on a parcel that provides in excess of the 2400 square foot land per unit requirement as approximately 2,867 square feet per unit are being provided. 5. The proposal is consistent with the Comprehensive Plan Map designations, zoning and existing uses in the area. 2. The rezone implements a single family subdivision and is consistent with the previously issued EIS. For each of the above referenced reasons, the recommendation of the Hearing Examiner to the Auburn City Council on the requested rezone is approved. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The above cited Hearing Examiner's Findings of Fact and Conclusions, are herewith incorporated in this Ordinance. Section 2. The legal description in attached Exhibit A of property located on the south side of 52nd Street N.E. (So. 277th) and east of "I" Street N.E. Upon the passage, approval and publication of this Ordinance as provided by law, the City Clerk of the City of Auburn shall cause this Ordinance to be recorded in the office of the King County Auditor, Division of Records and Elections. Section 4. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 5.
