HomeMy WebLinkAbout44131 2 3 4 r_ v 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 ORDINANCE NO. 4 4 1 3 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO SOLID WASTE MANAGEMENT, ADOPTING THE PROPOSED KING COUNTY COMPREHENSIVE SOLID WASTE MANAGEMENT PLAN, AND DETERMINING THAT KING COUNTY SHALL NOT EXERCISE ANY POWERS REGARDING THE' LEVELS AND TYPES OF SOLID WASTE SERVICE FOR ANY ASPECT OF SOLID WASTE HANDLING IN THE CITY OF AUBURN, AND DESIGNATING THE PLAN FOR THE EXERCISE OF SUBSTANTIVE AUTHORITY UNDER SEPA. WHEREAS, RCW 70.95.080 requires that each city develop its own comprehensive solid waste management plan, enter into an agreement to prepare a joint city/county plan, or authorize the County to prepare the plan for the City's solid waste management; and, WHEREAS, the City of Auburn and King County entered into an Interlocal Agreement whereby the parties agreed that they shall cooperate in the County's development of a Comprehensive Solid Waste Management Plan; and WHEREAS, King County has prepared and proposed a Draft Comprehensive Solid Waste Management Plan and submitted it to the City for approval and adoption; and WHEREAS, the City, through the Suburban Cities Association, participates in the Solid- ste Interlocal Forum which, through Resolution No. 89-005, has recommended approval and adoption of the Draft Comprehensive Solid Waste Management Plan with addenda; and ------------------- Ordinance No. 4413 February 6, 1990 Page 1 S 1 2 3 4tj II 6 7 8 9i 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 WHEREAS, Section 10 of Chapter 431 of the Laws of the State of Washington, 1989 Regular Session, amending RCW 70.95.160, authorizes the City to determine that King County shall not exercise any powers regarding the levels and type of service for any aspect of solid waste handling in the City of Auburn: NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The City of Auburn hereby adopts the King County Comprehensive Solid Waste Management Plan with addenda as recommended by the Solid Waste Interlocal Forum through Resolution No. 89-005 (hereafter "Plan"). The Plan as adopted herein, is further designated for the exercise of substantive authority under the State Environmental Policy Act Rules pursuant to RCW 43.21C.060. Section 2. Pursuant to RCW 70.95.160, the City of Auburn hereby determines that King County shall not exercise any powers regarding the levels and types of service for any aspect of solid waste handling in the City of Auburn. Section 3. Pursuant to RCW 70.95.030, the City of Auburn hereby designates the following materials as recyclable materials: 1. Container glass 2. Paper 3. Aluminum 4. Tin cans 5. Yard waste Other materials may be designated as recyclable as markets become available and as the net cost of collecting and recycling that material becomes equal to our less than the cost of collection, transfer, long haul and disposal. Items in the above list may be removed due to market or other variations. Section 4. The City shall determine solid waste and recycling collection rates by ordinance and not as set forth in the King County Comprehensive Solid Waste Management Plan. Section S. The recycling service areas for the City of Auburn are hereby designated in the attached map marked Exhibit A and incorporated in this Ordinance. Section 6. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 7. This Ordinance shall take effect and be in force five days from and after its passage, approval and publication as provided by law.
