HomeMy WebLinkAbout4414\q 1 2 3 4 5 6 7 8 9 10 11 1 12 13 14 15 16 171 18 19 20 21 22 23 24 25 26 ORDINANCE NO.-4 4 1 4 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AUTHORIZING THE MAYOR AND CITY CLERK TO ACCEPT A STATUTORY WARRANTY DEED, AUTHORIZING PAYMENT OF $115,000 FROM THE INTEREST OF THE CEMETERY ENDOWED CARE FUND FOR THE PURCHASE OF A 4.48 ACRE PARCEL OF LAND ADJACENT TO MOUNTAIN VIEW CEMETERY,, AND DECLARING AN EMERGENCY. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, ORDAINS AS FOLLOWS: Section 1. Purpose. The purpose of this Ordinance is to approve the purchase of a 4.48 acre parcel of land adjacent to Mountain View Cemetery. Raney W. Wright, a certified appraiser with ABC Associates, was hired by the City to prepare a Letter of Consultation to reach an opinion on the fair market value of the property. He valued the property at $95,000. Based on 1990 cemetery development costs and revenue potential, the property could be developed for $500,000 and would generate over $1,700,000 in grave sales over a period of years. Section 2. Conveyance. The record owner of the property, Mr. Wayne Parker, has agreed to sell the property to the City for a sales price of $115,000. Mr. Parker shall transfer the property to the City by Statutory Warranty Deed in a form approved by the City Attorney, along with a title ------------------- Ordinance No. 4414 Page 1 February 9, 1990 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 1 18 19 20 21 22 23 24 25 26 insurance policy. The Mayor and City Clerk are hereby authorized to accept the approved Statutory Warranty Deed conveying the 4.48 acre parcel to the City of Auburn. A legal description of the parcel is as follows: Lot(s) 50, WEST AUBURN FIVE ACRE TRACTS, according to the plat thereof, recorded in Volume 15 of Plats, Page(s) 12, records of King County, Washington. Situate in the County of King, State of Washington. Section 3. Consideration. Upon approval and acceptance of the Statutory Warranty Deed, the City will remit payment to Mr. Wayne Parker, the sum of ONE HUNDRED FIFTEEN THOUSAND and No/100 DOLLARS ($115,000), in consideration for the conveyance herein. The proceeds shall be paid from the interest of The Cemetery Endowed Care Fund. Section 4. Appropriation. An appropriation is hereby authorized in the amount of $115,000 from The Cemetery Endowed Care Fund. Section S. Recording. The Statutory Warranty Deed shall be recorded with King County Records Division, by the escrow agent agreed to by the parties. The recorded deed shall be transmitted to the City Clerk after its recording. ------------------- Ordinance No. 4414 Page 2 February 9, 1990 Section 6. Authority. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation. section 7. Emergency Clause. A public emergency is hereby declared to exist which requires that this ordinance take effect upon passage by the City Council.
