AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR
A CONDITIONAL USE PERMIT TO ALLOW A PROFESSIONAL OFFICE
LOCATED AT 1315 "M" STREET S.E., WITHIN THE CITY OF AUBURN,
WASHINGTON.
WHEREAS, Application No. CUP0009-89 dated January 16,
1990, together with site plans therefore, has been submitted
to the City of Auburn, Washington, by BRUCE COURTRIGHT,
requesting a Conditional Use Permit to allow a professional
office to be located at 1315 "M"" Street S.E., within the City
of Auburn, Washington, hereinafter described in Section 2 of
the Ordinance; and
WHEREAS, said request above referred to, was referred to
the Hearing Examiner for study and public hearing thereon; and
WHEREAS, the Hearing Examiner, based upon staff review,
held a public hearing to consider said petition in the Council
Chambers of the Auburn City Hall, on January 22, 1990, at the
conclusion of which the Hearing Examiner recommended the
approval of the issuance of a Conditional Use Permit to allow
a professional office to be located at 1315 "M" Street S.E.,
based upon the following Findings of Fact and Conclusions, to -
wit:

FINDINGS OF FACT
1. The applicant, Bruce Courtright, applied for a
Conditional Use Permit for a professional office use
to be located at 1315 "M" Street S.E. within an
existing single family residential home.
2 The subject property is zoned R-3 (Duplex) and the
applicant's representative Brian and Janet Van
proposes to locate the office of their contracting
business within the existing single family home.
3. The house contains approximately 1320 square feet.
Following conversion to an office, five parking
spaces will be required to be provided on -site. The
applicant proposes to develop the parking lot in the
rear yard.
4. The property to the south contains a single family
home and to the west is a parking lot serving a
clinic and to the north there is a four-plex. To
reduce the impact of the required parking lot a
sight -obscuring fence should be provided.
5. The proposal is located on "M" Street S.E. which is
a designated arterial. Uses along "M" Street have
been converting to multi -family or professional
office uses.
6. Upon conversion of the site to an office use,
standard sidewalk and driveway should be provided.
7. The staff report, with its recommendation of
conditional approval, is incorporated herein by
reference as though set forth in full.
CONCLUSIONS OF LAW
1. The Zoning Ordinance sets forth a series of criteria
which must be established before a conditional use
permit can be granted.

2. The proponent must establish that the use will have
no more of an adverse effect on the area and people
residing in the area than would any use generally
permitted in the district. The proposed office use
will not have an adverse impact and with a sight -
obscuring fence all potential impact from the
parking lot would be minimized.
3. The proposal is in accordance with the goals,
policies and objectives of the Comprehensive Plan
since the Comprehensive Plan states that office uses
are appropriate within a moderate density
residential district.
4. The proposal complies with the Zoning Ordinance.
5. All of the other criteria which are required for a
conditional use permit are established by the
evidence.
For each of the above referenced reasons, the
recommendation of the Hearing Examiner to the Auburn City
Council on this Conditional Use Permit to allow a professional
office is approved and affirmed.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. The above cited Hearing Examiner's Findings
of Fact and Conclusions, are herewith incorporated in this
Ordinance.

Section 2. A Conditional Use Permit is hereby approved
to allow a professional office located at 1315 "M" Street
S.E., situate in the City of Auburn, County of King, State of
Washington, and legally described as follows:
Lot 6, Lloyd A. Knowles Third Addition as
recorded in Plats, Page 49, page 66,
records of King County, Washington and
situated in Section 19, Township 21 North,
Range 5 EWM, City of Auburn, County of
King, State of Washington.
Section 3. A 6 foot high wooden, sight -obscuring fence,
shall be constructed along the north and south property lines
and be set back 20 feet from the "M" Street S.E. right of way.
Section 4. The sidewalk and driveway shall be installed
to City standards on that portion of "M" Street that abuts the
proposal.
Section 5. Upon the passage, approval and publication of
this Ordinance as provided by law, the City Clerk of the City
of Auburn shall cause this Ordinance to be recorded in the
office of the King County Auditor.
Section 6. The Mayor is hereby authorized to implement
such administrative procedures as may be necessary to carry
out the directions of this legislation.
Section 7. This Ordinance shall take effect and be in
force five days from and after its passage, approval and
publication as provided by law.
