AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR
THE REZONING OF PROPERTY LOCATED ON THE EAST SIDE OF "I" STREET
N.E.(IF EXTENDED) IN THE 3200 BLOCK, WITHIN THE CITY OF AUBURN,
WASHINGTON, CHANGING THE ZONING CLASSIFICATION THEREOF FROM R-2
(SINGLE FAMILY) TO R-4 (MULTI -FAMILY).
WHEREAS, Application No. REZ0008-89 has been submitted to
the Council of the City of Auburn, Washington, by RICHARD
WAKAZURU and TRIMEN DEVELOPMENT COMPANY, requesting the rezoning
of the real property hereinafter described in Section 2 of the
Ordinance; and
WHEREAS, said request above referred to, was referred to
the Hearing Examiner for study and public hearing thereon; and
WHEREAS, the Hearing Examiner, based upon staff review,
held a public hearing to consider said petition in the Council
Chambers of the Auburn City Hall, on April 17, 1990, at the
conclusion of which the Hearing Examinek recommended the
approval of the rezoning of said property, based upon the
following Findings of Fact and Conclusions, to -wit:
FINDINGS OF FACT
1. The applicant, Richard Wakazuru, by his agent, Trimen
Development Company, seeks a rezone from R-2, Single Family
to R-4, Multi -Family.
2. The subject site is 6 acres in size and is located on the
east side of "I" Street N.E.

3. The site is part of a 135 lot preliminary plat. The
subject lot which is being rezoned will be the only
multiple family lot and the remaining 134 lots will be
utilized for single family residential purposes.
4. To the north and south of the proposal there are existing
R-4 zones developed as multiple family. However, one lot
of an existing R-2 zoned plat abuts the southeast corner of
the proposed rezone. This lot will be over 100 feet away a
multi -family unit due to the intervening street and
required setbacks. At the time of the public hearing,
several citizens expressed concern regarding the proximity
of the multiple -family use which will exist on this site to
the already existing single family uses located to the
southeast. The citizens witnesses suggested that
additional setbacks and/or buffering should be required to
provide for a more adequate transition between the multiple
family and single family uses.
5. The subject site is designated by the Comprehensive Plan
for multiple family uses.
6. The staff report, with its recommendation of conditional
approval, is incorporated herein by reference as though set
forth in full.
CONCLUSIONS OF LAW
1. The proposal is consistent with the Comprehensive Plan Map
and Text.
2. The proposal is consistent with Comprehensive Plan policy
in that adequate public services are available and the
proposal will not adversely impact existing single family
neighborhoods. The undersigned concludes that there is
sufficient space between the multiple family uses which
will be developed on the subject site and the existing
single family uses to the southeast in order for the two
types of residential uses to coexist harmoniously.
3. As a result of the proposed preliminary plat which is being
processed concurrently with this application, and its
resultant completion of the "I" Street length,
circumstances have changed so that multiple family zoning
will be more appropriate than single family zoning for this
particular site.

For each of the above referenced reasons, the
recommendation of the Hearing Examiner to the Auburn City
Council on this rezone from R-2 (Single Family) to R-4 (Multi -
Family) is approved and affirmed.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. The above cited Hearing Examiner's Findings of
Fact and Conclusions, are herewith incorporated in this
Ordinance.
Section 2. The following described property located on the
east side of "I" Street N.E. (if extended) in the 3200 block,
situate in the City of Auburn, County of King, State of
Washington, be and the same is hereby rezoned from R-2 (Single
Family) to R-4 (Multi -Family) and legally described as follows:
The North 378.84 feet of the South 906.84
feet of the Harvey M. Jones Donation Land
Claim No. 39 in Section 6, Township 21
North, Range 5 East of the Willamette
Meridian;
EXCEPT the West 2,239 feet thereof.
ALSO EXCEPT that portion lying Easterly of
the Southerly extension of the East line of
Parcel "C" of the City of Auburn Short Plat
No. SP-20-80, as filed under King County
Recording No. 8101079005 and as amended by
document filed under King County Recording
No. 8104280802.
ALL situate in the City of Auburn, King
County, Washington.

ALL situate in the City of Auburn, King
County, Washington.
Section 3. Tract 'A' shall be a non -buildable tract to be
used for utilities.
Section 4. Tract 'A' shall be landscaped with a 5 foot
width of Type I landscaping on the south and east property
lines. The detention ponds shall also be designed to reflect a
residential neighborhood. This shall include aesthetics and
public safety.
A design plan shall be prepared by the applicant and be
approved by the Public Works Director and Planning Director.
Section 5. "I" Street adjacent to the rezone area shall be
dedicated prior to issuance of building permits. "I" Street
shall be constructed to the standards required of the Public
Works Director prior to occupancy of buildings.
Section 6. Upon the passage, approval and publication of
this Ordinance as provided by law, the City Clerk of the City of
Auburn shall cause this Ordinance to be recorded in the office
of the King County Auditor, Division of Records and Elections.
Section 7. The Mayor is hereby authorized to implement
such administrative procedures as may be necessary to carry out
the directions of this legislation.
Section 8. This Ordinance shall take effect and be in
force five days from and after its passage, approval and
publication as provided by law.
