HomeMy WebLinkAbout4434CITY CLERK'S OFF l I C� CITY OF AUBURN ` 25 West main Auburn, WA 98001 1 ORDINANCE NO. 4 4 3 4 2 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR 3 THE REZONING OF PROPERTY LOCATED AT 801 "C" STREET S.W., WITHIN THE CITY OF AUBURN, WASHINGTON, CHANGING THE ZONING 4 CLASSIFICATION THEREOF FROM M-2 (HEAVY INDUSTRIAL) TO C-3 (HEAVY COMMERCIAL). 5 WHEREAS, Application No. REZ0002-90 has been submitted to 6 the Council of the City of Auburn, Washington, by ARJAN 7 c BHATIA, requesting the rezoning of the real property CD 8 C\J hereinafter described in Section 2 of the Ordinance; and � 9 CD WHEREAS, said request above referred to, was referred to C 10 the Hearing Examiner for study and public hearing thereon; and 11 WHEREAS, the Hearing Examiner, based upon staff review, 12 held a public hearing to consider said petition in the Council 13 Chambers of the Auburn City Hall, on April 25, 1990, at the 14 conclusion of which the Hearing Examiner recommended the 15 approval of the rezoning of said property, based upon the 16 following Findings of Fact and Conclusions, to -wit: 17 18 FINDINGS OF FACT 19 1. The applicant, Arjan Bhatia, applies for a rezone from M- 20 2 (Heavy Industrial) to C-3 (Heavy Commercial). 21 2. The subject property is located at 801 "C" Street S.W. 22 and is 6,970 square feet in size. 3. The applicant proposes to construct an 1,856 square foot addition to the existing building and utilize the addition for general commercial uses. The applicant has no tenant for the new addition but believes that there is some possibility that the tenant who currently occupies the existing office building may wish to expand in the future. 4. The subject property is located at the southwest corner of 8th Street S.W. and "C" Street S.W. Currently, 8th Street is a private street while "C" Street is a designated arterial. 5. The Comprehensive Plan designates the subject site for commercial uses. Existing zoning and land uses in the vicinity include C-3, vacant restaurant, to the north; M- 2, office, to the south; M-1, railroad, to the east; M-2, parking lot, to the west. 6. The existing parking lot does not meet current City requirements. Each parking space currently backs out directly into 8th Street and accordingly additional parking lots or driveways will have to be designed to meet City requirements. 7. The rezone proposal is consistent with the Comprehensive Plan designation for the site. 8. The staff report, with its recommendation of approval is incorporated herein by reference, as though set forth in full. CONCLUSIONS OF LAW 1. The proposal is consistent with the Comprehensive Plan Map and zoning and existing uses in the area. 2. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The above cited Hearing Examiner's Findings of Fact and Conclusions, are herewith incorporated in this Ordinance. Section 2. The following described property located at 801 "C" Street S.W., situate in the City of Auburn, County of King, State of Washington, is hereby rezoned from M-2 (Heavy Industrial) to C-3 and is legally described as follows: That portion of Section 24, Township 21 N, Range 4 E.W.M. in King County, WA, described as follows: Beginning at 1559.69 feet east and 16 feet south of the north quarter corner of said Section 241 thence south 52.9 feet; thence east 113.04 feet; thence north 52.9 feet; thence west to the point of beginning. Upon the passage, approval and publication of this Ordinance as provided by law, the City Clerk of the City of Auburn shall cause this Ordinance to be recorded in the office of the King County Auditor, Division of Records and Elections. Section 4. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 5.
