AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR
A CONDITIONAL USE PERMIT TO ALLOW AN OUTDOOR STORAGE YARD FOR
VEHICLES AND EQUIPMENT 325 FEET EAST OF "B" STREET N.W. IN THE
3800 BLOCK, WITHIN THE CITY OF AUBURN, WASHINGTON.
WHEREAS, Application No. CUP0007-90 dated May 7, 1990,
together with site plans therefore, has been submitted to the
City of Auburn, Washington, by MPS INVESTMENTS, requesting a
Conditional Use Permit to allow an outdoor storage yard for
VEHICLES and equipment 325 feet east of "B" Street N.W. in the
3800 block, within the City of Auburn, Washington, hereinafter
described in Section 2 of the Ordinance; and
WHEREAS, said request above referred to, was referred to
the Hearing Examiner for study and public hearing thereon; and
WHEREAS, the Hearing Examiner, based upon staff review,
held a public hearing to consider said petition in the Council
Chambers of the Auburn City Hall, on June 19, 1990, at the
conclusion of which the Hearing Examiner recommended the
approval of the issuance of a Conditional Use Permit to allow
an outdoor storage yard for VEHICLES and equipment 325 feet
east of "B" Street N.W. in the 3800 block, based upon the
following Findings of Fact and Conclusions, to -wit:

FINDINGS OF FACT
1. The applicant, MPS Investments, applies for a Conditional
Use Permit to allow an outdoor storage yard for vehicles
and equipment.
2. The subject property is located 325 feet east of "B"
Street N.W. in the 3800 block and is 2900 square feet in
size.
3. The site is zoned M-1 (Light Industrial) and is
designated for light industrial uses in the Comprehensive
Plan. Although the subject site is currently vacant, a
light industrial development is proposed.
4. Existing zoning and land uses in the vicinity include M-
1, Light Industrial zoning in all directions and
industrial uses exist to the south and west of the site.
Land to the north and east of the site is vacant while
land in all directions is designated for light industrial
uses in the Comprehensive Plan.
5. Outdoor storage yards are permitted in an M-1 zone if the
requirements of a conditional use permit can be
established.
6. The Zoning Ordinance limits the size of the outdoor
storage yard to 500 of the associated building area.
7. The building area associated with this application is
6,000 square feet and accordingly the proposed 2900
square foot storage yard meets the requirements of
Section 18.32.040(H) of the Zoning Ordinance.
8. The storage yard will abut the associated building to the
north. The Zoning Ordinance requires a 10 foot width of
Type I landscaping next to the street. The Zoning
Ordinance also requires a five foot width of Type I
landscaping on the south and west sides of the storage
yard.
9. The staff report, with its recommendation of approval, is
incorporated herein by reference as though set forth in
full.

CONCLUSIONS OF LAW
1. The requirements of a Conditional Use Permit are set
forth in Section 18.64.040 of the Zoning Ordinance.
2. The applicant must establish that the use as proposed
will have no more of an adverse effect on the health,
safety, or comfort of persons living or working in the
area than would any use generally permitted in the
district. The size and location of the storage yard,
together with the required landscaping, will result in
the lack of an adverse impact upon adjoining properties.
3. The proposal complies with the goals and policies and
objectives of the Comprehensive Plan and the requirements
of the Zoning Ordinance.
4. The proposal can be constructed and maintained so as to
be harmonious with the general character of the vicinity
since the location of the storage yard and the required
landscaping will make the project an appropriate addition
to the industrial character of the vicinity.
5. The proposal will not adversely affect the public
infrastructure.
For each of the above referenced reasons, the
recommendation of the Hearing Examiner to the Auburn City
Council on this Conditional Use Permit to allow an outdoor
storage yard for vehciles and equipment is approved and
affirmed.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:

Section 1. The above cited Hearing Examiner's Findings
of Fact and Conclusions, are herewith incorporated in this
Ordinance.
Section 2. A Conditional Use Permit is hereby approved
to allow an outdoor storage yard for vehciles and equipment
325 feet east of "B" Street N.W. in the 3800 block, situate in
the City of Auburn, County of King, State of Washington, and
is legally described as follows:
Lot 3 of City of Auburn Short Plat No. 9-87, as
recorded under Auditor's File #8707130609 and
situated in Section 1, Township 21 North, Range
4, EWM, City of Auburn, County of King, State
of Washington.
Section 3. Upon the passage, approval and publication of
this Ordinance as provided by law, the City Clerk of the City
of Auburn shall cause this Ordinance to be recorded in the
office of the King County Auditor.
Section 4. The Mayor is hereby authorized to implement
such administrative procedures as may be necessary to carry
out the directions of this legislation.
Section 5. This Ordinance shall take effect and be in
force five days from and after its passage, approval and
publication as provided by law.
